| 2 | AMENDMENT NO. ______. Amend Senate Bill 1846 by replacing | ||||||
| 3 | everything after the enacting clause with the following:

| 4 | "Section 5. The Department of State Police Law of the
Civil | ||||||
| 5 | Administrative Code of Illinois is amended by changing Section | ||||||
| 6 | 2605-485 as follows:
| ||||||
| 7 | (20 ILCS 2605/2605-485) | ||||||
| 8 | Sec. 2605-485. Endangered Missing Person Advisory. | ||||||
| 9 | (a) A coordinated program known as the Endangered Missing | ||||||
| 10 | Person Advisory is established within the Department of State | ||||||
| 11 | Police. The purpose of the Endangered Missing Person Advisory | ||||||
| 12 | is to provide a regional system for the rapid dissemination of | ||||||
| 13 | information regarding a missing person who is believed to be a | ||||||
| 14 | high-risk missing person as defined in Section 10 of the | ||||||
| 15 | Missing Persons Identification Act. | ||||||
| 16 | (b) The AMBER Plan Task Force, established under Section | ||||||
| |||||||
| |||||||
| 1 | 2605-480 of the Department of State Police Law, shall serve as | ||||||
| 2 | the task force for the Endangered Missing Person Advisory. The | ||||||
| 3 | AMBER Plan Task Force shall monitor and review the | ||||||
| 4 | implementation and operation of the regional system developed | ||||||
| 5 | under subsection (a), including procedures, budgetary | ||||||
| 6 | requirements, and response protocols. The AMBER Plan Task Force | ||||||
| 7 | shall also develop additional network resources for use in the | ||||||
| 8 | system. | ||||||
| 9 | (c) The Department of State Police, in coordination with | ||||||
| 10 | the Illinois Department on Aging, shall develop and implement a | ||||||
| 11 | community outreach program to promote awareness among the | ||||||
| 12 | State's healthcare facilities, nursing homes, assisted living | ||||||
| 13 | facilities, and other senior centers. The guidelines and | ||||||
| 14 | procedures shall ensure that specific health information about | ||||||
| 15 | the missing person is not made public through the alert or | ||||||
| 16 | otherwise. | ||||||
| 17 | (d) The Child Safety Coordinator, created under Section | ||||||
| 18 | 2605-480 of the Department of State Police Law, shall act in | ||||||
| 19 | the dual capacity of Child Safety Coordinator and Endangered | ||||||
| 20 | Missing Person Coordinator. The Coordinator shall assist in the | ||||||
| 21 | establishment of State standards and monitor the availability | ||||||
| 22 | of federal funding that may become available to further the | ||||||
| 23 | objectives of the Endangered Missing Person Advisory. The | ||||||
| 24 | Department shall provide technical assistance for the | ||||||
| 25 | Coordinator from its existing resources.
| ||||||
| 26 | (e)(1) The Department of State Police, in cooperation with | ||||||
| |||||||
| |||||||
| 1 | the Silver Search Task Force, shall develop as part of the | ||||||
| 2 | Endangered Missing Person Advisory a coordinated statewide | ||||||
| 3 | awareness program and toolkit to be used when a person 21 years | ||||||
| 4 | of age or older who is believed to have Alzheimer's disease, | ||||||
| 5 | other related dementia, or other dementia-like cognitive | ||||||
| 6 | impairment is reported missing, which shall be referred to as | ||||||
| 7 | Silver Search. | ||||||
| 8 | (2)
The Department shall complete development and | ||||||
| 9 | deployment of the Silver Search Awareness Program and toolkit | ||||||
| 10 | on or before July 1, 2017. | ||||||
| 11 | (3)
The Department of State Police shall establish a Silver | ||||||
| 12 | Search Task Force within 90 days after the effective date of | ||||||
| 13 | this amendatory Act of the 99th General Assembly to assist the | ||||||
| 14 | Department in development and deployment of the Silver Search | ||||||
| 15 | Awareness Program and toolkit. The Task Force shall establish | ||||||
| 16 | the criteria and create a toolkit, which may include usage of | ||||||
| 17 | Department of Transportation signs, under Section 2705-505.6 | ||||||
| 18 | of the Department of Transportation Law of the Civil | ||||||
| 19 | Administrative Code of Illinois. The Task Force shall monitor | ||||||
| 20 | and review the implementation and operation of that program, | ||||||
| 21 | including procedures, budgetary requirements, standards, and | ||||||
| 22 | minimum requirements for the training of law enforcement | ||||||
| 23 | personnel on how to interact appropriately and effectively with | ||||||
| 24 | individuals that suffer from Alzheimer's disease, other | ||||||
| 25 | dementia, or other dementia-like cognitive impairment. The | ||||||
| 26 | Task Force shall also develop additional network and financial | ||||||
| |||||||
| |||||||
| 1 | resources for use in the system. The Task Force shall include, | ||||||
| 2 | but is not limited to, one representative from each of the | ||||||
| 3 | following: | ||||||
| 4 | (A) the Department of State Police; | ||||||
| 5 | (B) the Department on Aging; | ||||||
| 6 | (C) the Department of Public Health; | ||||||
| 7 | (D) the Illinois Law Enforcement Training Standards | ||||||
| 8 | Board; | ||||||
| 9 | (E) the Illinois Emergency Management Agency; | ||||||
| 10 | (F) the Secretary of State; | ||||||
| 11 | (G) the Department of Transportation; | ||||||
| 12 | (H) the Department of the Lottery; | ||||||
| 13 | (I) the Illinois Toll Highway Authority; | ||||||
| 14 | (J) the Alzheimer's Association; | ||||||
| 15 | (K) AARP of Illinois; | ||||||
| 16 | (L) Illinois Area Agencies on Aging; | ||||||
| 17 | (M) the Illinois Sheriffs' Association; | ||||||
| 18 | (N) the Illinois Association of Chiefs of Police; | ||||||
| 19 | (O) the Illinois Press Association; | ||||||
| 20 | (P) the Illinois Broadcasters Association; | ||||||
| 21 | (Q) a member of a large wireless telephone carrier; and | ||||||
| 22 | (R) a member of a small wireless telephone carrier. | ||||||
| 23 | The members of the Task Force designated in subparagraphs | ||||||
| 24 | (A) through (I) of this paragraph (3) shall be appointed by the | ||||||
| 25 | head of the respective agency. The members of the Task Force | ||||||
| 26 | designated in subparagraphs (J) through (R) of this paragraph | ||||||
| |||||||
| |||||||
| 1 | (3) shall be appointed by the Director of State Police. The | ||||||
| 2 | Director of State Police or his or her designee shall serve as | ||||||
| 3 | Chair of the Task Force. | ||||||
| 4 | The Task Force shall meet at least twice a year and shall | ||||||
| 5 | provide a report on the operations of the Silver Search Program | ||||||
| 6 | to the General Assembly and the Governor each year by June 30. | ||||||
| 7 | (4)
Subject to appropriation, the Department of State | ||||||
| 8 | Police, in coordination with the Department on Aging and the | ||||||
| 9 | Silver Search Task Force, shall develop and implement a | ||||||
| 10 | community outreach program to promote awareness of the Silver | ||||||
| 11 | Search Program as part of the Endangered Missing Person | ||||||
| 12 | Advisory among law enforcement agencies, the State's | ||||||
| 13 | healthcare facilities, nursing homes, assisted living | ||||||
| 14 | facilities, other senior centers, and the general population on | ||||||
| 15 | or before January 1, 2017. | ||||||

The Child Safety Coordinator, created under Section | ||||||
| 17 | 2605-480 of the Department of State Police Law of the Civil | ||||||
| 18 | Administrative Code of Illinois, shall act in the capacity of | ||||||
| 19 | Child Safety Coordinator, Endangered Missing Person | ||||||
| 20 | Coordinator, and Silver Search Program Coordinator. The | ||||||
| 21 | Coordinator, in conjunction with the members of the Task Force, | ||||||
| 22 | shall assist the Department and the Silver Search Task Force, | ||||||
| 23 | in the establishment of State standards and monitor the | ||||||
| 24 | availability of federal and private funding that may become | ||||||
| 25 | available to further the objectives of the Endangered Missing | ||||||
| 26 | Person Advisory and Silver Search Awareness Program. The | ||||||

| 1 | Department shall provide technical assistance for the | ||||||
| 2 | Coordinator from its existing resources. | ||||||

| 4 | Section 10. The Department of Transportation Law of the

| 5 | Civil Administrative Code of Illinois is amended by adding | ||||||
| 6 | Section 2705-505.6 as follows:
| ||||||
| 7 | (20 ILCS 2705/2705-505.6 new) | ||||||
| 8 | Sec. 2705-505.6. Endangered Missing Persons Advisory | ||||||
| 9 | message signs. The Department of Transportation shall | ||||||
| 10 | coordinate with the Department of State Police in the use of | ||||||
| 11 | electronic message signs on roads and highways to immediately | ||||||
| 12 | provide critical information to the public concerning missing | ||||||
| 13 | persons who are believed to be high risk, missing persons with | ||||||
| 14 | Alzheimer's disease, other related dementia, or other | ||||||
| 15 | dementia-like cognitive impairment, as allowed by federal | ||||||
| 16 | guidelines.

| 17 | Section 15. The Illinois Police Training Act is amended by | ||||||
| 18 | changing Section 10.10 as follows:
| ||||||
| 19 | (50 ILCS 705/10.10)
| ||||||
| 20 | Sec. 10.10. Training in child abduction and missing | ||||||
| 21 | endangered senior alert system. | ||||||
| 22 | (a) The Board shall
conduct
training programs for law | ||||||
| |||||||
| |||||||
| 1 | enforcement personnel of local governmental agencies
in the
| ||||||
| 2 | statewide coordinated child abduction alert system developed | ||||||
| 3 | under Section
2605-480 of
the Department of State Police Law of | ||||||
| 4 | the Civil Administrative Code of
Illinois and the statewide | ||||||
| 5 | coordinated missing endangered senior alert system developed | ||||||
| 6 | under Section 2605-375 of the Department of State Police Law of | ||||||
| 7 | the
Civil Administrative Code of Illinois.
| ||||||
| 8 | (b) The Board shall conduct a training program for law | ||||||
| 9 | enforcement personnel of local governmental agencies in the | ||||||
| 10 | statewide Alzheimer's disease, other related dementia, or | ||||||
| 11 | other dementia-like cognitive impairment coordinated Silver | ||||||
| 12 | Search Awareness Program and toolkit developed under Section | ||||||
| 13 | 2605-485 of the Department of State Police Law of the Civil | ||||||
| 14 | Administrative Code of Illinois. The Board shall adopt written | ||||||
| 15 | protocols and guidelines for the handling of missing persons | ||||||
| 16 | cases involving Alzheimer's disease, other related dementia, | ||||||
| 17 | or other dementia-like cognitive impairment based upon | ||||||
| 18 | protocols developed by the Silver Search Task Force in | ||||||
| 19 | conjunction with the Department of State Police on or before | ||||||
| 20 | July 1, 2016. | ||||||
