AMENDMENT TO SENATE BILL 1733
AMENDMENT NO. ______. Amend Senate Bill 1733 by replacing
everything after the enacting clause with the following:
"Section 5. The Freedom of Information Act is amended by
Section 3.7 as follows:
(5 ILCS 140/3.7 new)
Sec. 3.7. Personal identifying information.
(a) Notwithstanding any other provision of this Act, a
person who is incarcerated in any State, local, or federal
correctional facility for any offense under the laws of this
State may not request public documents containing personal
identifying information except as provided in this Section.
(b) A public record containing personal identifying
information which is requested by a person who is incarcerated
in any State, local, or federal correctional facility for any
offense under the laws of this State may be released only if

the information is necessary to assist in the defense of the
requester. Upon motion by the requester, or his or her
representative, alleging that the information is necessary to
assist in the requester's defense, the court shall make a
determination and issue a written order directing the public
body to either release the public record, in whole or in part,
or to withhold the public record from release to the
incarcerated person.".
