| 1 | AMENDMENT TO SENATE BILL 1641
| ||||||
| 2 | AMENDMENT NO. ______. Amend Senate Bill 1641 by replacing | ||||||
| 3 | everything after the enacting clause with the following:
| ||||||
| 4 | "Section 5. The Illinois Public Aid Code is amended by | ||||||
| 5 | adding Sections 12-4.13b and 12-4.13c as follows:
| ||||||
| 6 | (305 ILCS 5/12-4.13b) | ||||||
| 7 | Sec. 12-4.13b. College student eligibility for | ||||||
| 8 | supplemental nutrition assistance benefits. | ||||||
| 9 | (a) For the purposes of Section 273.5(b)(11)(ii) of Title 7 | ||||||
| 10 | of the Code of Federal Regulations, a career and technical an | ||||||
| 11 | educational program offered at a community college and approved | ||||||
| 12 | by the Illinois Community College Board under the Carl D. | ||||||
| 13 | Perkins Career and Technical Education Improvement Act of 2006 | ||||||
| 14 | (Public Law 109-270) that could be a component of a SNAP | ||||||
| 15 | Employment and Training (E&T) program, as identified by the | ||||||
| 16 | Department of Human Services, shall be considered an employment | ||||||
| |||||||
| |||||||
| 1 | and training program under Section 273.7 of Title 7 of the Code | ||||||
| 2 | of Federal Regulations, unless prohibited by federal law. | ||||||
| 3 | (b) The Department of Human Services, in consultation with | ||||||
| 4 | representatives of the Illinois Community College Board, the | ||||||
| 5 | Illinois Student Assistance Commission ISAC, the Illinois | ||||||
| 6 | Workforce Innovation Board Investment Board, and advocates for | ||||||
| 7 | students and SNAP recipients, shall establish a protocol to | ||||||
| 8 | identify and verify all potential exemptions to the eligibility | ||||||
| 9 | rule described in Section 273.5(a) of Title 7 of the Code of | ||||||
| 10 | Federal Regulations, and to identify and verify a student's | ||||||
| 11 | participation in educational programs, including, but not | ||||||
| 12 | limited to, self-initiated placements, that would exempt a | ||||||
| 13 | student from the eligibility rule described in Section 273.5(a) | ||||||
| 14 | of Title 7 of the Code of Federal Regulations. To the extent | ||||||
| 15 | possible, this consultation shall take place through existing | ||||||
| 16 | workgroups convened by the Department of Human Services. | ||||||
| 17 | (c) If the United States Department of Agriculture requires | ||||||
| 18 | federal approval of the exemption designation established | ||||||
| 19 | pursuant to subsection (a) and the protocol established | ||||||
| 20 | pursuant to subsection (b), the Department of Human Services | ||||||
| 21 | shall seek and obtain that approval before publishing the | ||||||
| 22 | guidance or regulation required by subsection (e). | ||||||
| 23 | (d)(1) This Section does not require the Department of | ||||||
| 24 | Human Services to offer a particular component, support | ||||||
| 25 | services, or workers' compensation to a college student found | ||||||
| 26 | eligible for an exemption pursuant to this Section. | ||||||

| 1 | (2) This Section does not restrict or require the use of | ||||||
| 2 | federal funds for the financing of SNAP E&T programs. | ||||||
| 3 | (3) This Section does not require an institution of higher | ||||||
| 4 | education to verify eligibility for SNAP. | ||||||
| 5 | (e) The Department of Human Services shall adopt any rules | ||||||
| 6 | necessary to implement the provisions of subsections (a), (b), | ||||||
| 7 | (c), and (d).

| 10 | Sec. 12-4.13c. SNAP eligibility notification; college | ||||||
| 11 | students. | ||||||
| 12 | (a) To complement student financial assistance programs | ||||||
| 13 | and to enhance their effectiveness by more fully addressing the | ||||||
| 14 | costs of attendance for students with financial needs, the | ||||||
| 15 | Illinois Student Assistance Commission (ISAC) shall identify | ||||||
| 16 | and flag college students who are potentially eligible to | ||||||
| 17 | receive Supplemental Nutrition Assistance Program (SNAP) | ||||||
| 18 | benefits. The factors to be used to determine potential SNAP | ||||||
| 19 | eligibility shall be prescribed by ISAC in consultation with | ||||||
| 20 | the Department of Human Services, but at a minimum shall | ||||||
| 21 | include income information reported on a college student's Free | ||||||
| 22 | Application for Federal Student Aid. ISAC, in consultation with | ||||||
| 23 | the Department of Human Services, shall develop a notice that | ||||||
| 24 | ISAC shall make available electronically to institutions of | ||||||
| 25 | higher education that includes, at a minimum, college student | ||||||
| |||||||
| |||||||
| 1 | SNAP eligibility criteria, the Application for Benefits | ||||||
| 2 | Eligibility's website address, and the Illinois Hunger | ||||||
| 3 | Coalition's Hunger Hotline. | ||||||
| 4 | (b) Illinois institutions of higher education that | ||||||
| 5 | participate in the Monetary Award Program shall provide the | ||||||
| 6 | notice described in subsection (a) in writing to all students | ||||||
| 7 | who are enrolled or accepted for enrollment and are identified | ||||||
| 8 | by ISAC as potentially SNAP eligible and, if possible, may | ||||||
| 9 | designate a public benefits liaison or single point person to | ||||||
| 10 | assist students in taking the necessary steps to obtain public | ||||||
| 11 | benefits if eligible. | ||||||
| 12 | (c) ISAC shall adopt any rules necessary to implement the | ||||||
| 13 | provisions of this Section on or before October 1, 2020.
| ||||||
| 14 | Section 99. Effective date. This Act takes effect upon | ||||||
| 15 | becoming law.".
