| 1 | AMENDMENT TO SENATE BILL 1085

| 2 | AMENDMENT NO. ______. Amend Senate Bill 1085 by replacing | ||||||
| 3 | everything after the enacting clause with the following:
| ||||||
| 4 | "Section 5. The Department of Professional Regulation Law | ||||||
| 5 | of the
Civil Administrative Code of Illinois is amended by | ||||||
| 6 | adding Section 2105-20 as follows:
| ||||||
| 7 | (20 ILCS 2105/2105-20 new) | ||||||
| 8 | Sec. 2105-20. Criminal history records checks. Licensees | ||||||
| 9 | or applicants applying for expedited licensure through an | ||||||
| 10 | interstate compact enacted into law by the General Assembly, | ||||||
| 11 | including, but not limited to, the Interstate Medical Licensure | ||||||
| 12 | Compact Act, who have designated Illinois as the principal | ||||||
| 13 | state of licensure for the purposes of the compact shall have | ||||||
| 14 | his or her fingerprints submitted to the Department of State | ||||||
| 15 | Police in an electronic format that complies with the form and | ||||||
| 16 | manner for requesting and furnishing criminal history record | ||||||
| |||||||
| |||||||
| 1 | information as prescribed by the Department of State Police. | ||||||
| 2 | These fingerprints shall be checked against the Department of | ||||||
| 3 | State Police and Federal Bureau of Investigation criminal | ||||||
| 4 | history record databases now and hereafter filed. The | ||||||
| 5 | Department of State Police shall charge applicants or licensees | ||||||
| 6 | a fee for conducting the criminal history records check, which | ||||||
| 7 | shall be deposited into the State Police Services Fund and | ||||||
| 8 | shall not exceed the actual cost of the records check. The | ||||||
| 9 | Department of State Police shall furnish, pursuant to positive | ||||||
| 10 | identification, records of Illinois convictions to the | ||||||
| 11 | Department. The Department may require applicants or licensees | ||||||
| 12 | to pay a separate fingerprinting fee, either to the Department | ||||||
| 13 | or to a vendor designated or approved by the Department. The | ||||||
| 14 | Department, in its discretion, may allow an applicant or | ||||||
| 15 | licensee who does not have reasonable access to a designated | ||||||
| 16 | vendor to provide his or her fingerprints in an alternative | ||||||
| 17 | manner. The Department may adopt any rules necessary to | ||||||
| 18 | implement this Section. Communication between the Department | ||||||
| 19 | and an interstate compact governing body, including, but not | ||||||
| 20 | limited to, the Interstate Commission as defined in Section 180 | ||||||
| 21 | of the Interstate Medical Licensure Compact Act, may not | ||||||
| 22 | include information received from the Federal Bureau of | ||||||
| 23 | Investigation relating to a State and federal criminal history | ||||||
| 24 | records check.

| 25 | Section 99. Effective date. This Act takes effect upon | ||||||

| 1 | becoming law.".
