1 | AMENDMENT TO SENATE BILL 919
| ||||||
2 | AMENDMENT NO. ______. Amend Senate Bill 919 by replacing | ||||||
3 | everything after the enacting clause with the following:
| ||||||
4 | "Section 5. The Broadband Advisory Council Act is amended | ||||||
5 | by changing Section 15 as follows:
| ||||||
6 | (220 ILCS 80/15)
| ||||||
7 | Sec. 15. Broadband Advisory Council; members of
Council; | ||||||
8 | administrative support.
| ||||||
9 | (a) The Broadband Advisory Council is hereby established.
| ||||||
10 | The Department of Commerce and Economic Opportunity shall | ||||||
11 | house
the Council and provide administrative, personnel, and
| ||||||
12 | technical support services.
| ||||||
13 | (b) The Council shall consist of the following 25 21 | ||||||
14 | voting
members: | ||||||
15 | (1) the Director of Commerce and Economic Opportunity
| ||||||
16 | or his or her designee, who shall serve as chair of the |
| |||||||
| |||||||
1 | Council; | ||||||
2 | (2) the Secretary of Innovation and Technology or his
| ||||||
3 | or her designee; | ||||||
4 | (3) the Director of Aging or his or her designee; | ||||||
5 | (4) the Attorney General or his or her designee;
| ||||||
6 | (5) the Chairman of the Illinois Commerce Commission | ||||||
7 | or
his or her designee;
| ||||||
8 | (6) one member appointed by the Director of Healthcare
| ||||||
9 | and Family Services to represent the needs of disabled
| ||||||
10 | citizens; | ||||||
11 | (7) one member appointed by the Director of Commerce
| ||||||
12 | and Economic Opportunity and nominated by the president of
| ||||||
13 | a statewide organization representing electric
| ||||||
14 | cooperatives; | ||||||
15 | (8) one member appointed by the Director of Commerce
| ||||||
16 | and Economic Opportunity and nominated by the executive
| ||||||
17 | director of a statewide organization representing
| ||||||
18 | municipalities; | ||||||
19 | (9) one member appointed by the Director of Commerce
| ||||||
20 | and Economic Opportunity and nominated by the president of
| ||||||
21 | a statewide organization representing libraries; | ||||||
22 | (10) one member appointed by the Director of Commerce
| ||||||
23 | and Economic Opportunity and nominated by the president of
| ||||||
24 | a statewide organization representing public housing
| ||||||
25 | authorities; | ||||||
26 | (11) one member appointed by the Chair of the Illinois

| |||||||
1 | Community College Board; | ||||||
2 | (12) one member appointed by the Chair of the Illinois
| ||||||
3 | Board of Higher Education; and | ||||||
4 | (13) one member appointed by the Director of Commerce | ||||||
5 | and Economic Opportunity and nominated by the president of | ||||||
6 | the State's largest general farm organization; | ||||||
7 | (14) one member appointed by the Director of Aging and | ||||||
8 | nominated by an organization representing Illinois' senior | ||||||
9 | population with a membership of at least 1,500,000; | ||||||
10 | (15) seven members to represent broadband providers | ||||||
11 | for
3-year terms appointed by the Governor as follows: | ||||||
12 | (A) one member representing an incumbent local
| ||||||
13 | exchange carrier that serves rural areas; | ||||||
14 | (B) one member representing an incumbent local
| ||||||
15 | exchange carrier that serves urban areas; | ||||||
16 | (C) one member representing wireless carriers that
| ||||||
17 | offer broadband Internet access; | ||||||
18 | (D) one member representing cable companies that
| ||||||
19 | serve Illinois; | ||||||
20 | (E) one member representing a statewide rural | ||||||
21 | broadband association;
| ||||||
22 | (F) one member representing a telecommunications | ||||||
23 | carrier issued a certificate of public convenience and | ||||||
24 | necessity or a certificate of service authority from | ||||||
25 | the Illinois Commerce Commission, whose principal | ||||||
26 | place of business is located in east central Illinois |

1 | and who is engaged in providing broadband access in | ||||||
2 | rural areas through the installation of broadband | ||||||
3 | lines that connect telecommunications facilities to | ||||||
4 | other telecommunications facilities or to end-users; | ||||||
5 | and | ||||||
6 | (G) one member representing satellite providers ; . | ||||||
7 | (16) four members to represent underrepresented and | ||||||
8 | ethnically diverse communities for 3-year terms appointed | ||||||
9 | by the Governor as follows: | ||||||
10 | (A) one member from a community-based organization | ||||||
11 | representing the interests of African-American or | ||||||
12 | Black individuals; | ||||||
13 | (B) one member from a community-based organization | ||||||
14 | representing the interests of Hispanic or Latino | ||||||
15 | individuals; | ||||||
16 | (C) one member from a community-based organization | ||||||
17 | representing the interests of Asian-American or | ||||||
18 | Pacific Islander individuals; and | ||||||
19 | (D) one member from a community-based organization | ||||||
20 | representing the interests of ethnically diverse | ||||||
21 | individuals. | ||||||
22 | (c) In addition to the 25 21 voting members of the Council, | ||||||
23 | the President of the Senate, the Minority Leader of the | ||||||
24 | Senate, the Speaker of the House of Representatives, and the | ||||||
25 | Minority Leader of the House of Representatives shall each | ||||||
26 | appoint one non-voting member of the Council.

1 | (d) All voting and non-voting members must be appointed | ||||||
2 | within 90 days after the effective date of this Act. | ||||||
3 | (e) The members shall select a vice chair from
their | ||||||
4 | number. In the absence of the chair, the vice chair shall
serve | ||||||
5 | as chair. The Council shall appoint a secretary-treasurer
who | ||||||
6 | need not be a member of the Council and who, among other
tasks | ||||||
7 | or functions designated by the Council, shall keep
records of | ||||||
8 | its proceedings.
| ||||||
9 | (f) The Council may appoint working groups to investigate
| ||||||
10 | and make recommendations to the full Council. Members of these
| ||||||
11 | working groups need not be members of the Council.
| ||||||
12 | (g) Nine Seven voting members of the Council constitute a
| ||||||
13 | quorum, and the affirmative vote of a simple majority of those
| ||||||
14 | members present is necessary for any action taken by vote of
| ||||||
15 | the Council.
| ||||||
16 | (h) The Council shall conduct its first meeting within 30 | ||||||
17 | days after all members have been appointed. The Council shall | ||||||
18 | meet quarterly after its first meeting. Additional hearings | ||||||
19 | and public meetings are permitted at the discretion of the | ||||||
20 | members. The Council may meet in person or through video or | ||||||
21 | audio conference. | ||||||
22 | (i) Members shall serve without compensation and may be
| ||||||
23 | reimbursed for reasonable expenses incurred in the performance
| ||||||
24 | of their duties from funds appropriated for that purpose.
