| 1 | AMENDMENT TO SENATE BILL 807
| ||||||
| 2 | AMENDMENT NO. ______. Amend Senate Bill 807 by replacing | ||||||
| 3 | everything after the enacting clause with the following:
| ||||||
| 4 | "Section 5. The Counties Code is amended by changing | ||||||
| 5 | Section 6-1001 as follows:
| ||||||
| 6 | (55 ILCS 5/6-1001) (from Ch. 34, par. 6-1001)
| ||||||
| 7 | Sec. 6-1001. Annual budget. In all counties not required by | ||||||
| 8 | law
to pass an annual appropriation bill within the first | ||||||
| 9 | quarter of the fiscal
year, the county board or board of county | ||||||
| 10 | commissioners, as the case may
be, shall adopt each year an | ||||||
| 11 | annual budget under the terms of this Division
for the | ||||||
| 12 | succeeding fiscal year. Such budget shall be prepared by some
| ||||||
| 13 | person or persons designated by the county board and such | ||||||
| 14 | budget shall be
made conveniently available to public | ||||||
| 15 | inspection and provided to the public at a public meeting for | ||||||
| 16 | at least fifteen days
prior to final action thereon except that | ||||||
| |||||||
| |||||||
| 1 | nothing in this Act shall restrict a county board or board of | ||||||
| 2 | county commissioners from acting at a public meeting to amend a | ||||||
| 3 | budget after making that budget available to the public and | ||||||
| 4 | prior to final adoption. Notices pertaining to the meeting and | ||||||
| 5 | the proposed budget shall be posted on the county's website, if | ||||||
| 6 | it maintains one. If a county does not maintain a website, then | ||||||
| 7 | the county shall comply with the Open Meetings Act in giving | ||||||
| 8 | notice of such agenda items and make the proposed budget | ||||||
| 9 | available for public inspection. The vote on such budget shall | ||||||
| 10 | be taken by
ayes and nays and entered on the record of the | ||||||
| 11 | meeting. The annual budget
adopted under this Act shall cover | ||||||
| 12 | such a fiscal period of one year to be
determined by the county | ||||||
| 13 | board of each county except as hereinafter
provided and all | ||||||
| 14 | appropriations made therein shall terminate with the close
of | ||||||
| 15 | said fiscal period except as hereinafter provided, provided, | ||||||
| 16 | however,
that any remaining balances shall be available until | ||||||
| 17 | 30 days after the
close of the fiscal year in counties with a | ||||||
| 18 | population of less
than
100,000, and until 90 days after the | ||||||
| 19 | close of the fiscal year in
counties
with a population of more | ||||||
| 20 | than 100,000 but less than 3,000,000 inhabitants,
only for the | ||||||
| 21 | authorization of the payment of
obligations incurred prior to | ||||||
| 22 | the close of said fiscal period. Any county
which determines to | ||||||
| 23 | change its fiscal year may adopt a budget to cover such
period | ||||||
| 24 | greater or less than a year as may be necessary to effect such
| ||||||
| 25 | change and appropriations made therein shall terminate with the | ||||||
| 26 | close
of such period.
