| 1 | AMENDMENT TO SENATE BILL 765
| ||||||
| 2 | AMENDMENT NO. ______. Amend Senate Bill 765 by replacing | ||||||
| 3 | everything after the enacting clause with the following:
| ||||||
| 4 | "Section 5. The Illinois Highway Code is amended by | ||||||
| 5 | changing Section 6-115 as follows:
| ||||||
| 6 | (605 ILCS 5/6-115) (from Ch. 121, par. 6-115)
| ||||||
| 7 | Sec. 6-115.
| ||||||
| 8 | (a) Except as provided in Section 10-20 of the Township | ||||||
| 9 | Code or subsection (b), no
person shall be eligible to the | ||||||
| 10 | office of highway
commissioner unless he shall be a legal voter | ||||||
| 11 | and has been one year a
resident of the district. In road | ||||||
| 12 | districts that elect a clerk the same
limitation shall apply to | ||||||
| 13 | the district clerk.
| ||||||
| 14 | (b) A board of trustees may (i) appoint a non-resident or a | ||||||
| 15 | resident that has not resided in the district for one year to | ||||||
| 16 | be a highway commissioner, or (ii) contract with a neighboring | ||||||
| |||||||
| |||||||
| 1 | township to provide highway commissioner services if: | ||||||
| 2 | (1) the district is within a township with no | ||||||
| 3 | incorporated town; | ||||||
| 4 | (2) the township is a population of less than 500; and | ||||||
| 5 | (3) no qualified candidate who has resided in the | ||||||
| 6 | township for at least one year is willing to serve as | ||||||
| 7 | highway commissioner. | ||||||
