AMENDMENT TO SENATE BILL 481
AMENDMENT NO. ______. Amend Senate Bill 481 by replacing
everything after the enacting clause with the following:
"Section 5. The Abraham Lincoln Presidential Library and
Museum Act is amended by changing Section 15 and adding Section
52 as follows:
(20 ILCS 3475/15)
Sec. 15. Board. There shall be a Board of Trustees of the
Abraham Lincoln Presidential Library and Museum to set policy
and advise the Abraham Lincoln Presidential Library and Museum
and the Executive Director on programs related to the Abraham
Lincoln Presidential Library and Museum and to exercise the
powers and duties given to it under Section 25 of this Act. If
the Chief Executive Officer of the Abraham Lincoln Presidential
Library Foundation is appointed by the Governor with advice and
consent of the Senate, then the The Abraham Lincoln

Presidential Library and Museum and the Abraham Lincoln
Presidential Library Foundation shall mutually co-operate to
maximize resources available to the Abraham Lincoln
Presidential Library and Museum and to support, sustain, and
provide educational programs and collections at the Abraham
Lincoln Presidential Library and Museum. Any membership fees
collected by the Abraham Lincoln Presidential Library
Foundation may be used to support the Abraham Lincoln
Presidential Library and Museum programs or collections at the
Foundation's discretion. The Abraham Lincoln Presidential
Library Foundation Board shall select and submit to the
Governor's Office potential applicants for the office of Chief
Executive Officer of the Abraham Lincoln Presidential Library
Foundation. Within 30 days after receiving the potential
applicants, the Governor shall appoint a Chief Executive
Officer of the Abraham Lincoln Presidential Library Foundation
with advice and consent of the Senate. A Chief Executive
Officer shall serve a term of 4 years.

Sec. 52. Examinations and audit reports.
(a) While the Agency and the Abraham Lincoln Presidential
Library Foundation are mutually co-operating as provided under
Section 15, at least once during every biennium the Auditor
General shall conduct a management audit of the relationship

between the Agency and the Abraham Lincoln Presidential Library
Foundation. The management audit shall examine, at a minimum,
the following:
(1) the type and amount of direct and indirect support
provided by the Agency to the Foundation;
(2) the type and amount of direct and indirect support
provided by the Foundation to the Agency;
(3) the revenues and expenditures related to the
Foundation's operation of the store and restaurant;
(4) the extent to which the Agency has monitored its
agreement with the Foundation and whether required reports
are being submitted in a timely manner;
(5) any other actions taken by the Agency to oversee
the Foundation to ensure that the purpose of the
relationship is being fulfilled to the fullest extent
possible; and
(6) whether the Foundation has received any other State
moneys from any other State agency and, if so, the amount
and purpose of those funds.
(b) Upon written notice from the Agency indicating the date
upon which the Agency and the Abraham Lincoln Presidential
Library Foundation ceased mutually co-operating as provided
under Section 15, the Auditor General shall conduct a final
management audit of the relationship between the Agency and the
Abraham Lincoln Presidential Library Foundation on that date.
The management audit shall examine, at a minimum, the matters

set forth in subsection (a), together with such other matters
as the Agency may indicate in its notice, or the Auditor
General may determine, are relevant to the transition of the
Abraham Lincoln Presidential Library Foundation from mutual
cooperation with the Agency.
The Agency and the State of Illinois shall have no
responsibility for the debts or other liabilities incurred by
the Abraham Lincoln Presidential Library Foundation on and
after the date that mutual cooperation ceased.
(c) The Auditor General shall report the results of each
audit conducted under this Section to the Governor and the
General Assembly.
Section 99. Effective date. This Act takes effect upon
becoming law.".
