| 1 | AMENDMENT TO SENATE BILL 381
| ||||||
| 2 | AMENDMENT NO. ______. Amend Senate Bill 381 by replacing | ||||||
| 3 | everything after the enacting clause with the following:
| ||||||
| 4 | "Section 5. The Water Commission Act of 1985 is amended by | ||||||
| 5 | changing Section 2.1 as follows:
| ||||||
| 6 | (70 ILCS 3720/2.1) | ||||||
| 7 | Sec. 2.1. Cessation of commission organization. | ||||||
| 8 | (a) Notwithstanding any other provision of law, if a | ||||||
| 9 | majority vote of the water commission is in favor of the | ||||||
| 10 | proposition to annex the commission to another commission whose | ||||||
| 11 | boundaries are contiguous, or consolidate the commission into a | ||||||
| 12 | municipality with which the commission is coterminous or | ||||||
| 13 | substantially coterminous, or consolidate the commission into | ||||||
| 14 | the county in which the commission sits, and if the governing | ||||||
| 15 | authorities of the governmental unit assuming the functions of | ||||||
| 16 | the former commission agree by resolution to accept the | ||||||

| 1 | functions (and jurisdiction over the territory, if applicable) | ||||||
| 2 | of the consolidated or annexed commission, then the commission | ||||||
| 3 | shall cease. On the effective date of the annexation or | ||||||
| 4 | consolidation, all the rights, powers, duties, assets, | ||||||
| 5 | property, liabilities, indebtedness, obligations, bonding | ||||||
| 6 | authority, taxing authority, and responsibilities of the | ||||||
| 7 | commission shall vest in and be assumed by the governmental | ||||||
| 8 | unit assuming the functions of the former commission. | ||||||
| 9 | The employees of the former commission shall be transferred | ||||||
| 10 | to the governmental unit assuming the functions of the former | ||||||
| 11 | commission. The governmental unit assuming the functions of the | ||||||
| 12 | former commission shall exercise the rights and | ||||||
| 13 | responsibilities of the former commission with respect to those | ||||||
| 14 | employees. The status and rights of the employees of the former | ||||||
| 15 | commission under any applicable contracts or collective | ||||||
| 16 | bargaining agreements, historical representation rights under | ||||||
| 17 | the Illinois Public Labor Relations Act, or under any pension, | ||||||
| 18 | retirement, or annuity plan shall not be affected by this | ||||||
| 19 | amendatory Act.
| ||||||
| 20 | (b) This Section shall not apply to any water commission | ||||||
| 21 | organized in DuPage County. | ||||||

| 23 | Section 99. Effective date. This Act takes effect upon | ||||||
| 24 | becoming law.".
