AMENDMENT TO SENATE BILL 381
2 AMENDMENT NO. ______. Amend Senate Bill 381 by replacing
3everything after the enacting clause with the following:
4 "Section 5. The Water Commission Act of 1985 is amended by
5changing Section 2.1 as follows:
6 (70 ILCS 3720/2.1)
7 Sec. 2.1. Cessation of commission organization.
8 (a) Notwithstanding any other provision of law, if a
9majority vote of the water commission is in favor of the
10proposition to annex the commission to another commission whose
11boundaries are contiguous, or consolidate the commission into a
12municipality with which the commission is coterminous or
13substantially coterminous, or consolidate the commission into
14the county in which the commission sits, and if the governing
15authorities of the governmental unit assuming the functions of
16the former commission agree by resolution to accept the

1functions (and jurisdiction over the territory, if applicable)
2of the consolidated or annexed commission, then the commission
3shall cease. On the effective date of the annexation or
4consolidation, all the rights, powers, duties, assets,
5property, liabilities, indebtedness, obligations, bonding
6authority, taxing authority, and responsibilities of the
7commission shall vest in and be assumed by the governmental
8unit assuming the functions of the former commission.
9 The employees of the former commission shall be transferred
10to the governmental unit assuming the functions of the former
11commission. The governmental unit assuming the functions of the
12former commission shall exercise the rights and
13responsibilities of the former commission with respect to those
14employees. The status and rights of the employees of the former
15commission under any applicable contracts or collective
16bargaining agreements, historical representation rights under
17the Illinois Public Labor Relations Act, or under any pension,
18retirement, or annuity plan shall not be affected by this
19amendatory Act.
20 (b) This Section shall not apply to any water commission
21organized in DuPage County.

23 Section 99. Effective date. This Act takes effect upon
24becoming law.".
