AMENDMENT TO SENATE BILL 313
AMENDMENT NO. ______. Amend Senate Bill 313 by replacing
everything after the enacting clause with the following:
"Section 5. The Illinois Food, Drug and Cosmetic Act is
amended by adding Section 21.4 as follows:
(410 ILCS 620/21.4 new)
Sec. 21.4. Restaurants; transglutaminase.
(a) As used in this Section:
"Restaurant" means any business that is primarily engaged
in the sale of ready-to-eat food for immediate consumption.
"Primarily engaged" means having sales of ready-to-eat food for
immediate consumption comprising at least 51% of the total
sales, excluding the sale of liquor.
"Transglutaminase" means an enzyme derived from
Streptoverticillium mobaraense that is approved for use as a
binder to form smaller cuts of meat into a larger serving of

meat.
(b) A restaurant must disclose if an item on the
restaurant's menu uses transglutaminase to form smaller cuts of
meat into a larger serving of meat by (1) including the term
"formed" in the item's name on the menu, and (2) by denoting on
the menu that the item is "made with transglutaminase".
Meat products or poultry products produced in accordance
with the Federal Meat Inspection Act (21 U.S.C. 601), the
federal Poultry Products Inspection Act (21 U.S.C. 451), or the
Meat and Poultry Inspection Act are exempt from the provisions
of this Section.
(c) The Department of Public Health may adopt any rules
necessary to implement this Section.".
