AMENDMENT TO SENATE BILL 168
2 AMENDMENT NO. ______. Amend Senate Bill 168 by replacing
3everything after the enacting clause with the following:
4 "Section 5. The Illinois Health Facilities Planning Act is
5amended by adding Section 8.9 as follows:
6 (20 ILCS 3960/8.9 new)
7 Sec. 8.9. Re-establishing discontinued general acute care
8hospital. Notwithstanding any provision of law to the
9contrary, a party seeking to re-establish a previously
10discontinued general acute care hospital under this Act shall
11be authorized to file a certificate of exemption under the Act
12if the following conditions are met:
13 (1) the previously discontinued general acute care
14 hospital was a safety net hospital, as defined pursuant to
15 Section 5-5e.1 of the Illinois Public Aid Code, at the
16 time the Review Board approved the closure of the

1 previously discontinued general acute care hospital;
2 (2) the previously discontinued general acute care
3 hospital surrendered its general acute hospital license to
4 the Department of Public Health between January 1, 2019
5 and December 31, 2020;
6 (3) the certificate of exemption seeks to re-establish
7 the same number of total licensed beds as were previously
8 licensed by the Department of Public Health at the
9 previously discontinued general acute care hospital;
10 (4) the party seeking to re-establish a previously
11 discontinued general acute care hospital commits to spend
12 at least $20,000,000 to re-establish the previously
13 discontinued general acute care hospital, which would
14 include the cost of land acquisition, building
15 acquisition, new construction, and new equipment;
16 (5) the party seeking to re-establish a previously
17 discontinued general acute care hospital will adopt and
18 maintain for at least a period of 2 years a charity care
19 policy that is no less restrictive than was in place at the
20 previously discontinued general acute care hospital;
21 (6) the party seeking to re-establish a previously
22 discontinued general acute care hospital will accept
23 Medicaid and Medicaid managed care patients; and
24 (7) the party seeking to re-establish a previously
25 discontinued general acute care hospital will agree to
26 maintain ownership of the re-established general acute

1 care hospital for no less than 5 years after the
2 re-established general acute care hospital has been issued
3 a new general acute care hospital license from the
4 Department of Public Health.
5 Section 99. Effective date. This Act takes effect upon
6becoming law.".
