AMENDMENT TO SENATE BILL 13
AMENDMENT NO. ______. Amend Senate Bill 13 by replacing
everything after the enacting clause with the following:
"Section 5. The Child Care Act of 1969 is amended by adding
Section 8.5 as follows:
(225 ILCS 10/8.5 new)
Sec. 8.5. Failure to report. The Department shall address
through rules the Department's policy regarding individual
staff at child care facilities or child welfare agencies who
fail to report suspected abuse or neglect of children within
the facility, as required by the Abused and Neglected Child
Reporting Act. When the Department learns of the facility
staff's failure to report, it shall take immediate action
directly with the individual staff involved. The Department
shall also investigate whether the staff failure to report was
a single incident or part of a larger incident involving

additional staff members who fail to report, or even if the
failure to report abuse or neglect is a system-wide problem
within the entity. The Department rules shall also include the
use of corrective action plans and the use of supervisory teams
to review and reiterate staff understanding of their reporting
obligations and assure staff that the entity's administration
requires staff to report suspected abuse and neglect. The
Department shall establish these rules no later than January 1,
2016.
Section 99. Effective date. This Act takes effect upon
becoming law.".
