| 2 | AMENDMENT NO. ______. Amend House Bill 5539, AS AMENDED, | ||||||
| 3 | with reference to page and line numbers of Senate Amendment No. | ||||||
| 4 | 1, by replacing lines 1 through 5 on page 18 with | ||||||
| 5 | "Notwithstanding any other provision to the contrary, the | ||||||
| 6 | Department shall not seek recovery of overpayments, | ||||||
| 7 | adjustments, or other amounts due that are more than 6 years | ||||||
| 8 | old, unless during the 6-year period an active investigation is | ||||||
| 9 | initiated by the Department of State Police or any other State | ||||||
| 10 | or federal law enforcement agency in which case the 6-year | ||||||
| 11 | limitation for the recovery of overpayments, adjustments, or | ||||||
| 12 | other amounts due is tolled for the period of time the matter | ||||||
| 13 | is under investigation or prosecution.".
