AMENDMENT TO HOUSE BILL 5236
AMENDMENT NO. ______. Amend House Bill 5236 by replacing
everything after the enacting clause with the following:
"Section 5. The School Code is amended by adding Section
22-17.5 as follows:
(105 ILCS 5/22-17.5 new)
Sec. 22-17.5. Task Force on Zoning and Schools.
(a) There is created the Task Force on Zoning and Schools,
composed of the following voting members:
Four members of the General Assembly, one appointed by
the Speaker of the House of Representatives, one appointed
by the Minority Leader of the House of Representatives, one
appointed by the President of the Senate, and one appointed
by the Minority Leader of the Senate. The Speaker of the
House of Representatives and the President of the Senate
shall each appoint a co-chair for the Task Force.

One member appointed by the State Board of Education.
One member representing an organization representing
school administrators and school districts, appointed by
the co-chairs.
One member representing regional superintendents of
schools, appointed by the co-chairs.
One member representing municipal governments in
Illinois, appointed by the co-chairs.
One member representing county officials in Illinois,
appointed by the co-chairs.
One member representing the general public, appointed
by the co-chairs.
One member representing architects, appointed by the
co-chairs.
One member representing civil engineers, appointed by
the co-chairs.
One member representing land surveyors, appointed by
the co-chairs.
At their discretion, the co-chairs may appoint additional,
non-voting members to the Task Force.
The members of the Task Force shall serve without
compensation. Vacancies shall be filled by the respective
appointing authorities in the same manner as the original
appointment.
(b) The Task Force shall examine the needs of
municipalities and counties to establish comprehensive systems

of local land use that promote the public health, safety, and
welfare through zoning as well as the needs of schools as
unique property owners serving the public good by providing
free public education. The Task Force shall investigate laws,
rules, and ordinances applicable to the interaction of zoning
and school buildings, together with efforts at practical
solutions via ordinance, regulation, intergovernmental
agreement, or otherwise implemented in this State or other
jurisdictions, including, but not limited to, the results of
the implementation of any such practical solutions.
Based on its findings, the Task Force shall make specific
recommendations for change and shall provide its
recommendations in the form of proposed legislation drafted by
the Legislative Reference Bureau.
(c) The State Board of Education shall provide meeting
space and technical and administrative support to the Task
Force.
(d) The Task Force shall report its findings and
recommendations, including proposed legislation, to the
Governor and the General Assembly no later than January 1,
2017.
(e) This Section is repealed on January 1, 2018.
Section 99. Effective date. This Act takes effect upon
becoming law.".
