| 2 | AMENDMENT NO. ______. Amend House Bill 5081 by replacing | ||||||
| 3 | everything after the enacting clause with the following: | ||||||
| 4 | "Section 5. The Illinois Vehicle Code is amended by | ||||||
| 5 | changing Sections 11-208.8, 11-601, 11-602, and 11-604 and by | ||||||
| 6 | adding Section 1-214.2 as follows: | ||||||
| 7 | (625 ILCS 5/1-214.2 new) | ||||||
| 8 | Sec. 1-214.2. Target speed. The target speed is the | ||||||
| 9 | highest desired operating speed given land-use contexts, | ||||||
| 10 | multimodal activity, and vehicular mobility and shall be | ||||||
| 11 | established by the entity with jurisdiction over that roadway. | ||||||
| 12 | (625 ILCS 5/11-208.8) | ||||||
| 13 | Sec. 11-208.8. Automated speed enforcement systems in | ||||||
| 14 | safety zones. | ||||||
| 15 | (a) As used in this Section: | ||||||
| |||||||
| |||||||
| 1 | "Automated speed enforcement system" means a photographic | ||||||
| 2 | device, radar device, laser device, or other electrical or | ||||||
| 3 | mechanical device or devices installed or utilized in a safety | ||||||
| 4 | zone and designed to record the speed of a vehicle and obtain a | ||||||
| 5 | clear photograph or other recorded image of the vehicle and | ||||||
| 6 | the vehicle's registration plate or digital registration plate | ||||||
| 7 | while the driver is violating Article VI of Chapter 11 of this | ||||||
| 8 | Code or a similar provision of a local ordinance. | ||||||
| 9 | An automated speed enforcement system is a system, located | ||||||
| 10 | in a safety zone which is under the jurisdiction of a | ||||||
| 11 | municipality, that produces a recorded image of a motor | ||||||
| 12 | vehicle's violation of a provision of this Code or a local | ||||||
| 13 | ordinance and is designed to obtain a clear recorded image of | ||||||
| 14 | the vehicle and the vehicle's license plate. The recorded | ||||||
| 15 | image must also display the time, date, and location of the | ||||||
| 16 | violation. | ||||||
| 17 | "Owner" means the person or entity to whom the vehicle is | ||||||
| 18 | registered. | ||||||
| 19 | "Recorded image" means images recorded by an automated | ||||||
| 20 | speed enforcement system on: | ||||||
| 21 | (1) 2 or more photographs; | ||||||
| 22 | (2) 2 or more microphotographs; | ||||||
| 23 | (3) 2 or more electronic images; or | ||||||
| 24 | (4) a video recording showing the motor vehicle and, | ||||||
| 25 | on at least one image or portion of the recording, clearly | ||||||
| 26 | identifying the registration plate or digital registration | ||||||
| |||||||
| |||||||
| 1 | plate number of the motor vehicle. | ||||||
| 2 | "Safety zone" means an area that is within one-eighth of a | ||||||
| 3 | mile from the nearest property line of any public or private | ||||||
| 4 | elementary or secondary school, or from the nearest property | ||||||
| 5 | line of any facility, area, or land owned by a school district | ||||||
| 6 | that is used for educational purposes approved by the Illinois | ||||||
| 7 | State Board of Education, not including school district | ||||||
| 8 | headquarters or administrative buildings. A safety zone also | ||||||
| 9 | includes an area that is within one-eighth of a mile from the | ||||||
| 10 | nearest property line of any facility, area, or land owned by a | ||||||
| 11 | park district used for recreational purposes. However, if any | ||||||
| 12 | portion of a roadway is within either one-eighth mile radius, | ||||||
| 13 | the safety zone also shall include the roadway extended to the | ||||||
| 14 | furthest portion of the next furthest intersection. The term | ||||||
| 15 | "safety zone" does not include any portion of the roadway | ||||||
| 16 | known as Lake Shore Drive or any controlled access highway | ||||||
| 17 | with 8 or more lanes of traffic or any roadway in which the 30 | ||||||
| 18 | mile per hour maximum speed limit is decreased by local | ||||||
| 19 | ordinance without an engineering or traffic investigation in | ||||||
| 20 | accordance with subsection (b) of Section 11-604 after the | ||||||
| 21 | effective date of this amendatory Act of the 104th General | ||||||
| 22 | Assembly. | ||||||
| 23 | (a-5) The automated speed enforcement system shall be | ||||||
| 24 | operational and violations shall be recorded only at the | ||||||
| 25 | following times: | ||||||
| 26 | (i) if the safety zone is based upon the property line | ||||||
| |||||||
| |||||||
| 1 | of any facility, area, or land owned by a school district, | ||||||
| 2 | only on school days and no earlier than 6 a.m. and no later | ||||||
| 3 | than 8:30 p.m. if the school day is during the period of | ||||||
| 4 | Monday through Thursday, or 9 p.m. if the school day is a | ||||||
| 5 | Friday; and | ||||||
| 6 | (ii) if the safety zone is based upon the property | ||||||
| 7 | line of any facility, area, or land owned by a park | ||||||
| 8 | district, no earlier than one hour prior to the time that | ||||||
| 9 | the facility, area, or land is open to the public or other | ||||||
| 10 | patrons, and no later than one hour after the facility, | ||||||
| 11 | area, or land is closed to the public or other patrons. | ||||||
| 12 | (b) A municipality that produces a recorded image of a | ||||||
| 13 | motor vehicle's violation of a provision of this Code or a | ||||||
| 14 | local ordinance must make the recorded images of a violation | ||||||
| 15 | accessible to the alleged violator by providing the alleged | ||||||
| 16 | violator with a website address, accessible through the | ||||||
| 17 | Internet. | ||||||
| 18 | (c) Notwithstanding any penalties for any other violations | ||||||
| 19 | of this Code, the owner of a motor vehicle used in a traffic | ||||||
| 20 | violation recorded by an automated speed enforcement system | ||||||
| 21 | shall be subject to the following penalties: | ||||||
| 22 | (1) if the recorded speed is no less than 6 miles per | ||||||
| 23 | hour and no more than 10 miles per hour over the legal | ||||||
| 24 | speed limit, a civil penalty not exceeding $50, plus an | ||||||
| 25 | additional penalty of not more than $50 for failure to pay | ||||||
| 26 | the original penalty in a timely manner; or | ||||||
| |||||||
| |||||||
| 1 | (2) if the recorded speed is more than 10 miles per | ||||||
| 2 | hour over the legal speed limit, a civil penalty not | ||||||
| 3 | exceeding $100, plus an additional penalty of not more | ||||||
| 4 | than $100 for failure to pay the original penalty in a | ||||||
| 5 | timely manner. | ||||||
| 6 | A penalty may not be imposed under this Section if the | ||||||
| 7 | driver of the motor vehicle received a Uniform Traffic | ||||||
| 8 | Citation from a police officer for a speeding violation | ||||||
| 9 | occurring within one-eighth of a mile and 15 minutes of the | ||||||
| 10 | violation that was recorded by the system. A violation for | ||||||
| 11 | which a civil penalty is imposed under this Section is not a | ||||||
| 12 | violation of a traffic regulation governing the movement of | ||||||
| 13 | vehicles and may not be recorded on the driving record of the | ||||||
| 14 | owner of the vehicle. A law enforcement officer is not | ||||||
| 15 | required to be present or to witness the violation. No penalty | ||||||
| 16 | may be imposed under this Section if the recorded speed of a | ||||||
| 17 | vehicle is 5 miles per hour or less over the legal speed limit. | ||||||
| 18 | The municipality may send, in the same manner that notices are | ||||||
| 19 | sent under this Section, a speed violation warning notice | ||||||
| 20 | where the violation involves a speed of 5 miles per hour or | ||||||
| 21 | less above the legal speed limit. | ||||||
| 22 | (d) The net proceeds that a municipality receives from | ||||||
| 23 | civil penalties imposed under an automated speed enforcement | ||||||
| 24 | system, after deducting all non-personnel and personnel costs | ||||||
| 25 | associated with the operation and maintenance of such system, | ||||||
| 26 | shall be expended or obligated by the municipality for the | ||||||
| |||||||
| |||||||
| 1 | following purposes: | ||||||
| 2 | (i) public safety initiatives to ensure safe passage | ||||||
| 3 | around schools, and to provide police protection and | ||||||
| 4 | surveillance around schools and parks, including but not | ||||||
| 5 | limited to: (1) personnel costs; and (2) non-personnel | ||||||
| 6 | costs such as construction and maintenance of public | ||||||
| 7 | safety infrastructure and equipment; | ||||||
| 8 | (ii) initiatives to improve pedestrian and traffic | ||||||
| 9 | safety; | ||||||
| 10 | (iii) construction and maintenance of infrastructure | ||||||
| 11 | within the municipality, including but not limited to | ||||||
| 12 | roads and bridges; and | ||||||
| 13 | (iv) after school programs. | ||||||
| 14 | (e) For each violation of a provision of this Code or a | ||||||
| 15 | local ordinance recorded by an automated speed enforcement | ||||||
| 16 | system, the municipality having jurisdiction shall issue a | ||||||
| 17 | written notice of the violation to the registered owner of the | ||||||
| 18 | vehicle as the alleged violator. The notice shall be delivered | ||||||
| 19 | to the registered owner of the vehicle, by mail, within 30 days | ||||||
| 20 | after the Secretary of State notifies the municipality of the | ||||||
| 21 | identity of the owner of the vehicle, but in no event later | ||||||
| 22 | than 90 days after the violation. | ||||||
| 23 | (f) The notice required under subsection (e) of this | ||||||
| 24 | Section shall include: | ||||||
| 25 | (1) the name and address of the registered owner of | ||||||
| 26 | the vehicle; | ||||||
| |||||||
| |||||||
| 1 | (2) the registration number of the motor vehicle | ||||||
| 2 | involved in the violation; | ||||||
| 3 | (3) the violation charged; | ||||||
| 4 | (4) the date, time, and location where the violation | ||||||
| 5 | occurred; | ||||||
| 6 | (5) a copy of the recorded image or images; | ||||||
| 7 | (6) the amount of the civil penalty imposed and the | ||||||
| 8 | date by which the civil penalty should be paid; | ||||||
| 9 | (7) a statement that recorded images are evidence of a | ||||||
| 10 | violation of a speed restriction; | ||||||
| 11 | (8) a warning that failure to pay the civil penalty or | ||||||
| 12 | to contest liability in a timely manner is an admission of | ||||||
| 13 | liability; | ||||||
| 14 | (9) a statement that the person may elect to proceed | ||||||
| 15 | by: | ||||||
| 16 | (A) paying the fine; or | ||||||
| 17 | (B) challenging the charge in court, by mail, or | ||||||
| 18 | by administrative hearing; and | ||||||
| 19 | (10) a website address, accessible through the | ||||||
| 20 | Internet, where the person may view the recorded images of | ||||||
| 21 | the violation. | ||||||
| 22 | (g) (Blank). | ||||||
| 23 | (h) Based on inspection of recorded images produced by an | ||||||
| 24 | automated speed enforcement system, a notice alleging that the | ||||||
| 25 | violation occurred shall be evidence of the facts contained in | ||||||
| 26 | the notice and admissible in any proceeding alleging a | ||||||
| |||||||
| |||||||
| 1 | violation under this Section. | ||||||
| 2 | (i) Recorded images made by an automated speed enforcement | ||||||
| 3 | system are confidential and shall be made available only to | ||||||
| 4 | the alleged violator and governmental and law enforcement | ||||||
| 5 | agencies for purposes of adjudicating a violation of this | ||||||
| 6 | Section, for statistical purposes, or for other governmental | ||||||
| 7 | purposes. Any recorded image evidencing a violation of this | ||||||
| 8 | Section, however, may be admissible in any proceeding | ||||||
| 9 | resulting from the issuance of the citation. | ||||||
| 10 | (j) The court or hearing officer may consider in defense | ||||||
| 11 | of a violation: | ||||||
| 12 | (1) that the motor vehicle or registration plates or | ||||||
| 13 | digital registration plates of the motor vehicle were | ||||||
| 14 | stolen before the violation occurred and not under the | ||||||
| 15 | control or in the possession of the owner or lessee at the | ||||||
| 16 | time of the violation; | ||||||
| 17 | (1.5) that the motor vehicle was hijacked before the | ||||||
| 18 | violation occurred and not under the control of or in the | ||||||
| 19 | possession of the owner or lessee at the time of the | ||||||
| 20 | violation; | ||||||
| 21 | (2) that the driver of the motor vehicle received a | ||||||
| 22 | Uniform Traffic Citation from a police officer for a | ||||||
| 23 | speeding violation occurring within one-eighth of a mile | ||||||
| 24 | and 15 minutes of the violation that was recorded by the | ||||||
| 25 | system; and | ||||||
| 26 | (3) any other evidence or issues provided by municipal | ||||||
| |||||||
| |||||||
| 1 | ordinance. | ||||||
| 2 | (k) To demonstrate that the motor vehicle was hijacked or | ||||||
| 3 | the motor vehicle or registration plates or digital | ||||||
| 4 | registration plates were stolen before the violation occurred | ||||||
| 5 | and were not under the control or possession of the owner or | ||||||
| 6 | lessee at the time of the violation, the owner or lessee must | ||||||
| 7 | submit proof that a report concerning the motor vehicle or | ||||||
| 8 | registration plates was filed with a law enforcement agency in | ||||||
| 9 | a timely manner. | ||||||
| 10 | (l) A roadway equipped with an automated speed enforcement | ||||||
| 11 | system shall be posted with a sign conforming to the national | ||||||
| 12 | Manual on Uniform Traffic Control Devices that is visible to | ||||||
| 13 | approaching traffic stating that vehicle speeds are being | ||||||
| 14 | photo-enforced and indicating the speed limit. The | ||||||
| 15 | municipality shall install such additional signage as it | ||||||
| 16 | determines is necessary to give reasonable notice to drivers | ||||||
| 17 | as to where automated speed enforcement systems are installed. | ||||||
| 18 | (m) A roadway where a new automated speed enforcement | ||||||
| 19 | system is installed shall be posted with signs providing 30 | ||||||
| 20 | days notice of the use of a new automated speed enforcement | ||||||
| 21 | system prior to the issuance of any citations through the | ||||||
| 22 | automated speed enforcement system. | ||||||
| 23 | (n) The compensation paid for an automated speed | ||||||
| 24 | enforcement system must be based on the value of the equipment | ||||||
| 25 | or the services provided and may not be based on the number of | ||||||
| 26 | traffic citations issued or the revenue generated by the | ||||||
| |||||||
| |||||||
| 1 | system. | ||||||
| 2 | (n-1) No member of the General Assembly and no officer or | ||||||
| 3 | employee of a municipality or county shall knowingly accept | ||||||
| 4 | employment or receive compensation or fees for services from a | ||||||
| 5 | vendor that provides automated speed enforcement system | ||||||
| 6 | equipment or services to municipalities or counties. No former | ||||||
| 7 | member of the General Assembly shall, within a period of 2 | ||||||
| 8 | years immediately after the termination of service as a member | ||||||
| 9 | of the General Assembly, knowingly accept employment or | ||||||
| 10 | receive compensation or fees for services from a vendor that | ||||||
| 11 | provides automated speed enforcement system equipment or | ||||||
| 12 | services to municipalities or counties. No former officer or | ||||||
| 13 | employee of a municipality or county shall, within a period of | ||||||
| 14 | 2 years immediately after the termination of municipal or | ||||||
| 15 | county employment, knowingly accept employment or receive | ||||||
| 16 | compensation or fees for services from a vendor that provides | ||||||
| 17 | automated speed enforcement system equipment or services to | ||||||
| 18 | municipalities or counties. | ||||||
| 19 | (o) (Blank). | ||||||
| 20 | (p) No person who is the lessor of a motor vehicle pursuant | ||||||
| 21 | to a written lease agreement shall be liable for an automated | ||||||
| 22 | speed or traffic law enforcement system violation involving | ||||||
| 23 | such motor vehicle during the period of the lease; provided | ||||||
| 24 | that upon the request of the appropriate authority received | ||||||
| 25 | within 120 days after the violation occurred, the lessor | ||||||
| 26 | provides within 60 days after such receipt the name and | ||||||
| |||||||
| |||||||
| 1 | address of the lessee. The drivers license number of a lessee | ||||||
| 2 | may be subsequently individually requested by the appropriate | ||||||
| 3 | authority if needed for enforcement of this Section. | ||||||
| 4 | Upon the provision of information by the lessor pursuant | ||||||
| 5 | to this subsection, the municipality may issue the violation | ||||||
| 6 | to the lessee of the vehicle in the same manner as it would | ||||||
| 7 | issue a violation to a registered owner of a vehicle pursuant | ||||||
| 8 | to this Section, and the lessee may be held liable for the | ||||||
| 9 | violation. | ||||||
| 10 | (q) A municipality using an automated speed enforcement | ||||||
| 11 | system must provide notice to drivers by publishing the | ||||||
| 12 | locations of all safety zones where system equipment is | ||||||
| 13 | installed on the website of the municipality. | ||||||
| 14 | (r) A municipality operating an automated speed | ||||||
| 15 | enforcement system shall conduct a statistical analysis to | ||||||
| 16 | assess the safety impact of the system following installation | ||||||
| 17 | of the system and every 2 years thereafter. A municipality | ||||||
| 18 | operating an automated speed enforcement system before the | ||||||
| 19 | effective date of this amendatory Act of the 103rd General | ||||||
| 20 | Assembly shall conduct a statistical analysis to assess the | ||||||
| 21 | safety impact of the system by no later than one year after the | ||||||
| 22 | effective date of this amendatory Act of the 103rd General | ||||||
| 23 | Assembly and every 2 years thereafter. Each statistical | ||||||
| 24 | analysis shall be based upon the best available crash, | ||||||
| 25 | traffic, and other data, and shall cover a period of time | ||||||
| 26 | before and after installation of the system sufficient to | ||||||
| |||||||
| |||||||
| 1 | provide a statistically valid comparison of safety impact. | ||||||
| 2 | Each statistical analysis shall be consistent with | ||||||
| 3 | professional judgment and acceptable industry practice. Each | ||||||
| 4 | statistical analysis also shall be consistent with the data | ||||||
| 5 | required for valid comparisons of before and after conditions | ||||||
| 6 | and shall be conducted within a reasonable period following | ||||||
| 7 | the installation of the automated traffic law enforcement | ||||||
| 8 | system. Each statistical analysis required by this subsection | ||||||
| 9 | shall be made available to the public and shall be published on | ||||||
| 10 | the website of the municipality. | ||||||
| 11 | (s) This Section applies only to municipalities with a | ||||||
| 12 | population of 1,000,000 or more inhabitants. | ||||||
| 13 | (t) If a county or municipality selects a new vendor for | ||||||
| 14 | its automated speed enforcement system and must, as a | ||||||
| 15 | consequence, apply for a permit, approval, or other | ||||||
| 16 | authorization from the Department for reinstallation of one or | ||||||
| 17 | more malfunctioning components of that system and if, at the | ||||||
| 18 | time of the application for the permit, approval, or other | ||||||
| 19 | authorization, the new vendor operates an automated speed | ||||||
| 20 | enforcement system for any other county or municipality in the | ||||||
| 21 | State, then the Department shall approve or deny the county or | ||||||
| 22 | municipality's application for the permit, approval, or other | ||||||
| 23 | authorization within 90 days after its receipt. | ||||||
| 24 | (u) The Department may revoke any permit, approval, or | ||||||
| 25 | other authorization granted to a county or municipality for | ||||||
| 26 | the placement, installation, or operation of an automated | ||||||
| |||||||
| |||||||
| 1 | speed enforcement system if any official or employee who | ||||||
| 2 | serves that county or municipality is charged with bribery, | ||||||
| 3 | official misconduct, or a similar crime related to the | ||||||
| 4 | placement, installation, or operation of the automated speed | ||||||
| 5 | enforcement system in the county or municipality. | ||||||
| 6 | The Department shall adopt any rules necessary to | ||||||
| 7 | implement and administer this subsection. The rules adopted by | ||||||
| 8 | the Department shall describe the revocation process, shall | ||||||
| 9 | ensure that notice of the revocation is provided, and shall | ||||||
| 10 | provide an opportunity to appeal the revocation. Any county or | ||||||
| 11 | municipality that has a permit, approval, or other | ||||||
| 12 | authorization revoked under this subsection may not reapply | ||||||
| 13 | for such a permit, approval, or other authorization for a | ||||||
| 14 | period of 1 year after the revocation. | ||||||
| 15 | (v) The University of Illinois Chicago Urban | ||||||
| 16 | Transportation Center shall conduct a study that includes the | ||||||
| 17 | following: | ||||||
| 18 | (1) a comprehensive review of the City of Chicago's | ||||||
| 19 | website multi-year crash data on North and South DuSable | ||||||
| 20 | Lake Shore Drive; | ||||||
| 21 | (2) the available research on potential effectiveness | ||||||
| 22 | of cameras powered by artificial intelligence in improving | ||||||
| 23 | compliance and reducing crashes and road fatalities on | ||||||
| 24 | North and South DuSable Lake Shore Drive; | ||||||
| 25 | (3) an analysis of driving behavior to detect risky | ||||||
| 26 | driving patterns and to address the DuSable Lake Shore | ||||||
| |||||||
| |||||||
| 1 | Drive crash corridors; | ||||||
| 2 | (4) an assessment of the effectiveness of | ||||||
| 3 | psychological deterrence in reducing habitual speeding; | ||||||
| 4 | and | ||||||
| 5 | (5) an assessment of how fatalities can be reduced | ||||||
| 6 | using these cameras powered by artificial intelligence and | ||||||
| 7 | other technical options that may be available in place of | ||||||
| 8 | cameras powered by artificial intelligence. | ||||||
| 9 | The Department shall adopt any rules necessary to | ||||||
| 10 | implement this subsection (v). | ||||||

| 12 | (625 ILCS 5/11-601) (from Ch. 95 1/2, par. 11-601) | ||||||
| 13 | Sec. 11-601. General speed restrictions. | ||||||
| 14 | (a) No vehicle may be driven upon any highway of this State | ||||||
| 15 | at a speed which is greater than is reasonable and proper with | ||||||
| 16 | regard to traffic conditions and the use of the highway, or | ||||||
| 17 | endangers the safety of any person or property. The fact that | ||||||
| 18 | the speed of a vehicle does not exceed the applicable maximum | ||||||
| 19 | speed limit does not relieve the driver from the duty to | ||||||
| 20 | decrease speed when approaching and crossing an intersection, | ||||||
| 21 | approaching and going around a curve, when approaching a hill | ||||||
| 22 | crest, when traveling upon any narrow or winding roadway, or | ||||||
| 23 | when special hazard exists with respect to pedestrians, | ||||||
| 24 | bicyclists, or other traffic or by reason of weather or | ||||||
| 25 | highway conditions. Speed must be decreased as may be | ||||||
| |||||||
| |||||||
| 1 | necessary to avoid colliding with any person or vehicle on or | ||||||
| 2 | entering the highway in compliance with legal requirements and | ||||||
| 3 | the duty of all persons to use due care. | ||||||
| 4 | (a-5) For purposes of this Section, "urban district" does | ||||||
| 5 | not include any interstate highway as defined by Section | ||||||
| 6 | 1-133.1 of this Code which includes all highways under the | ||||||
| 7 | jurisdiction of the Illinois State Toll Highway Authority. | ||||||
| 8 | (b) No person may drive a vehicle upon any highway of this | ||||||
| 9 | State at a speed which is greater than the applicable | ||||||
| 10 | statutory maximum speed limit established by paragraphs (c), | ||||||
| 11 | (d), (e), (f) or (g) of this Section, by Section 11-605 or by a | ||||||
| 12 | regulation or ordinance made under this Chapter. | ||||||
| 13 | (c) Unless some other speed restriction is established | ||||||
| 14 | under this Chapter, the maximum speed limit in an urban | ||||||
| 15 | district for all vehicles is: | ||||||
| 16 | 1. 30 miles per hour; and | ||||||

| 5 | for all or part of highways that are designated by the | ||||||
| 6 | Department, have at least 4 lanes of traffic, and have a | ||||||
| 7 | separation between the roadways moving in opposite directions; | ||||||
| 8 | and (3) 55 miles per hour for all other highways, roads, and | ||||||
| 9 | streets. The counties of Cook, DuPage, Kane, Lake, Madison, | ||||||
| 10 | McHenry, St. Clair, and Will may adopt ordinances setting a | ||||||
| 11 | maximum speed limit on highways, roads, and streets that is | ||||||
| 12 | lower than the limits established by this Section. | ||||||
| 13 | (e) In the counties of Cook, DuPage, Kane, Lake, McHenry, | ||||||
| 14 | and Will, unless some lesser speed restriction is established | ||||||
| 15 | under this Chapter, the maximum speed limit outside an urban | ||||||
| 16 | district for a second division vehicle designed or used for | ||||||
| 17 | the carrying of a gross weight of 8,001 pounds or more | ||||||
| 18 | (including the weight of the vehicle and maximum load) is 60 | ||||||
| 19 | miles per hour on any interstate highway as defined by Section | ||||||
| 20 | 1-133.1 of this Code and 55 miles per hour on all other | ||||||
| 21 | highways, roads, and streets. | ||||||
| 22 | (e-1) (Blank). | ||||||
| 23 | (f) Unless some other speed restriction is established | ||||||
| 24 | under this Chapter, the maximum speed limit outside an urban | ||||||
| 25 | district for a bus is: | ||||||
| 26 | 1. 65 miles per hour upon any highway which has at | ||||||

| 2 | traffic moving in opposite directions are separated by a | ||||||

| 5 | a bus on all highways, roads, or streets not under the | ||||||
| 6 | jurisdiction of the Department or the Illinois State Toll | ||||||
| 7 | Highway Authority is 55 miles per hour; | ||||||
| 8 | 1.5. 70 miles per hour upon any interstate highway as | ||||||
| 9 | defined by Section 1-133.1 of this Code outside the | ||||||
| 10 | counties of Cook, DuPage, Kane, Lake, McHenry, and Will; | ||||||
| 11 | and | ||||||

| 17 | Sec. 11-602. Alteration of limits by Department. | ||||||
| 18 | (a) Whenever the Department determines, upon the basis of | ||||||
| 19 | an engineering and traffic investigation concerning any | ||||||
| 20 | highway for which the Department has maintenance | ||||||
| 21 | responsibility, that a maximum speed limit prescribed in | ||||||
| 22 | Section 11-601 of this Chapter is greater or less than is | ||||||
| 23 | reasonable or safe with respect to the conditions found to | ||||||
| 24 | exist at any intersection or other place on such highway or | ||||||
| 25 | along any part or zone thereof, the Department shall determine | ||||||
| |||||||
| |||||||
| 1 | and declare a reasonable and safe absolute maximum speed limit | ||||||
| 2 | applicable to such intersection or place, or along such part | ||||||
| 3 | or zone. However, such limit shall conform with the maximum | ||||||
| 4 | speed limit restrictions provided for in Section 11-601 of | ||||||
| 5 | this Code. | ||||||
| 6 | (b) Where any highway under the Department's jurisdiction | ||||||
| 7 | lies within the jurisdictional boundary of a local authority, | ||||||
| 8 | the Department may, at the local authority's request or by its | ||||||
| 9 | own initiative, set a reduced maximum speed limit upon the | ||||||
| 10 | basis of an engineering and traffic investigation. If the | ||||||
| 11 | highway falls within an urban district and if the local | ||||||
| 12 | authority's request or Department initiative is to decrease | ||||||
| 13 | the maximum speed limit to 25 miles per hour, the reduction may | ||||||
| 14 | occur without performing an engineering and traffic | ||||||
| 15 | investigation if the reduction aligns with the determined | ||||||
| 16 | target speed, as defined in Section 1-214.2, for that portion | ||||||
| 17 | of the highway. | ||||||
| 18 | (c) Where a highway under the Department's jurisdiction is | ||||||
| 19 | contiguous to school property, the Department may, at the | ||||||
| 20 | school district's request, set a reduced maximum speed limit | ||||||
| 21 | for student safety purposes in the portion of the highway that | ||||||
| 22 | faces the school property and in the portions of the highway | ||||||
| 23 | that extend one-quarter mile in each direction from the | ||||||
| 24 | opposite ends of the school property. | ||||||
| 25 | (d) A limit determined and declared as provided in this | ||||||
| 26 | Section becomes effective, and suspends the applicability of | ||||||
| |||||||
| |||||||
| 1 | the limit prescribed in Section 11-601 of this Chapter, when | ||||||
| 2 | appropriate signs giving notice of the limit are erected at | ||||||
| 3 | such intersection or other place, or along such part or zone of | ||||||
| 4 | the highway. Electronic speed-detecting devices shall not be | ||||||
| 5 | used within 500 feet beyond any such sign in the direction of | ||||||
| 6 | travel; if so used in violation hereof, evidence obtained | ||||||
| 7 | thereby shall be inadmissible in any prosecution for speeding. | ||||||
| 8 | However, nothing in this Section prohibits the use of such | ||||||
| 9 | electronic speed-detecting devices within 500 feet of a sign | ||||||
| 10 | within a special school speed zone indicating such zone, | ||||||
| 11 | conforming to the requirements of Section 11-605 of this Act, | ||||||
| 12 | nor shall evidence obtained thereby be inadmissible in any | ||||||
| 13 | prosecution for speeding provided the use of such device shall | ||||||
| 14 | apply only to the enforcement of the speed limit in such | ||||||
| 15 | special school speed zone. | ||||||

| 18 | Sec. 11-604. Alteration of limits by local authorities. | ||||||
| 19 | (a) Subject to the limitations set forth in this Section, | ||||||
| 20 | the county board of a county may establish absolute maximum | ||||||
| 21 | speed limits on all county highways, township roads and | ||||||
| 22 | district roads as defined in the Illinois Highway Code, except | ||||||
| 23 | those under the jurisdiction of the Department or of the | ||||||
| 24 | Illinois State Toll Highway Authority, as described in | ||||||
| 25 | Sections 11-602 and 11-603 of this Chapter; and any park | ||||||
| |||||||
| |||||||
| 1 | district, city, village, or incorporated town may establish | ||||||
| 2 | absolute maximum speed limits on all streets which are within | ||||||
| 3 | its corporate limits and which are not under the jurisdiction | ||||||
| 4 | of the Department or of such Authority, and for which the | ||||||
| 5 | county or a highway commissioner of such county does not have | ||||||
| 6 | maintenance responsibility. | ||||||
| 7 | (b) Whenever any such park district, city, village, or | ||||||
| 8 | incorporated town determines, upon the basis of an engineering | ||||||
| 9 | or traffic investigation concerning a highway or street on | ||||||
| 10 | which it is authorized by this Section to establish speed | ||||||
| 11 | limits, that a maximum speed limit prescribed in Section | ||||||
| 12 | 11-601 of this Chapter is greater or less than is reasonable or | ||||||
| 13 | safe with respect to the conditions found to exist at any place | ||||||
| 14 | or along any part or zone of such highway or street, the local | ||||||
| 15 | authority or park district shall determine and declare by | ||||||
| 16 | ordinance a reasonable and safe absolute maximum speed limit | ||||||
| 17 | at such place or along such part or zone, which: | ||||||
| 18 | (1) Decreases the limit within an urban district, | ||||||
| 19 | which shall not require an engineering or traffic | ||||||
| 20 | investigation to a maximum speed limit of 25 miles per | ||||||
| 21 | hour, but not to less than 20 miles per hour and a maximum | ||||||
| 22 | speed limit of 10 miles per hour in an alley; or | ||||||
| 23 | (2) Increases the limit within an urban district, but | ||||||
| 24 | not to more than 55 miles per hour; or | ||||||
| 25 | (3) Decreases the limit outside of an urban district, | ||||||
| 26 | but not to less than 35 miles per hour, except as otherwise | ||||||
| |||||||
| |||||||
| 1 | provided in subparagraph 4 of this paragraph; or | ||||||
| 2 | (4) Decreases the limit within a residence district, | ||||||
| 3 | which shall not require an engineering or traffic | ||||||
| 4 | investigation to a maximum speed limit of 20 , but not to | ||||||
| 5 | less than 25 miles per hour, except as otherwise provided | ||||||
| 6 | in paragraph (1) subparagraph 1 of this paragraph. | ||||||
| 7 | The park district, city, village, or incorporated town may | ||||||
| 8 | make such limit applicable at all times or only during certain | ||||||
| 9 | specified times. Not more than 6 such alterations shall be | ||||||
| 10 | made per mile along a highway or street; and the difference in | ||||||
| 11 | limit between adjacent altered speed zones shall not be more | ||||||
| 12 | than 10 miles per hour. | ||||||
| 13 | A limit so determined and declared by a park district, | ||||||
| 14 | city, village, or incorporated town shall be posted with signs | ||||||
| 15 | designating the new speed limit and becomes effective, and | ||||||
| 16 | suspends the application of the limit prescribed in Section | ||||||
| 17 | 11-601 of this Chapter, when appropriate signs giving notice | ||||||
| 18 | of the limit are erected at the proper place or along the | ||||||
| 19 | proper part or zone of the highway or street. Electronic | ||||||
| 20 | speed-detecting devices shall not be used within 500 feet | ||||||
| 21 | beyond any such sign in the direction of travel; if so used in | ||||||
| 22 | violation of this Section evidence obtained thereby shall be | ||||||
| 23 | inadmissible in any prosecution for speeding. However, nothing | ||||||
| 24 | in this Section prohibits the use of such electronic | ||||||
| 25 | speed-detecting devices within 500 feet of a sign within a | ||||||
| 26 | special school speed zone indicating such zone, conforming to | ||||||
| |||||||
| |||||||
| 1 | the requirements of Section 11-605 of this Act, nor shall | ||||||
| 2 | evidence obtained thereby be inadmissible in any prosecution | ||||||
| 3 | for speeding provided the use of such device shall apply only | ||||||
| 4 | to the enforcement of the speed limit in such special school | ||||||
| 5 | speed zone. | ||||||
| 6 | (b-1) A county, municipality, or township may request that | ||||||
| 7 | the Department perform an engineering and traffic | ||||||
| 8 | investigation concerning any portion of highway under the | ||||||
| 9 | Department's jurisdiction, which lies within the geographic | ||||||
| 10 | boundary of the requesting local authority, to determine a | ||||||
| 11 | reasonable or safe absolute maximum speed limit for that | ||||||
| 12 | portion of highway. The Department shall perform the | ||||||
| 13 | engineering and traffic investigation and report the results | ||||||
| 14 | to the requesting local authority unless otherwise specified | ||||||
| 15 | in Section 11-602. | ||||||
| 16 | (c) A county engineer or superintendent of highways may | ||||||
| 17 | submit to the Department for approval, a county policy for | ||||||
| 18 | establishing altered speed zones on township and county | ||||||
| 19 | highways based upon engineering and traffic investigations. | ||||||
| 20 | (d) Whenever the county board of a county determines that | ||||||
| 21 | a maximum speed limit is greater or less than is reasonable or | ||||||
| 22 | safe with respect to the conditions found to exist at any place | ||||||
| 23 | or along any part or zone of the highway or road, the county | ||||||
| 24 | board shall determine and declare by ordinance a reasonable | ||||||
| 25 | and safe absolute maximum speed limit at that place or along | ||||||
| 26 | that part or zone. However, the maximum speed limit shall not | ||||||
| |||||||
| |||||||
| 1 | exceed 55 miles per hour. Upon receipt of an engineering study | ||||||
| 2 | for the part or zone of highway in question from the county | ||||||
| 3 | engineer, and notwithstanding any other provision of law, the | ||||||
| 4 | county board of a county may determine and declare by | ||||||
| 5 | ordinance a reduction in the maximum speed limit at any place | ||||||
| 6 | or along any part or zone of a county highway whenever the | ||||||
| 7 | county board, in its sole discretion, determines that the | ||||||
| 8 | reduction in the maximum speed limit is reasonable and safe. | ||||||
| 9 | The county board shall may post signs designating the new | ||||||
| 10 | speed limit. The limit becomes effective, and suspends the | ||||||
| 11 | application of the limit prescribed in Section 11-601 of this | ||||||
| 12 | Chapter, when appropriate signs giving notice of the limit are | ||||||
| 13 | erected at the proper place or along the proper part of the | ||||||
| 14 | zone of the highway. Electronic speed-detecting devices shall | ||||||
| 15 | not be used within 500 feet beyond any such sign in the | ||||||
| 16 | direction of travel; if so used in violation of this Section, | ||||||
| 17 | evidence obtained thereby shall be inadmissible in any | ||||||
