AMENDMENT TO HOUSE BILL 5050
AMENDMENT NO. ______. Amend House Bill 5050, AS AMENDED,
by replacing everything after the enacting clause with the
following:
"Section 5. The Decennial Committees on Local Government
Efficiency Act is amended by changing Section 25 and by adding
Sections 35 and 40 as follows:
(50 ILCS 70/25)
Sec. 25. Report. Each committee shall summarize its work
and findings within a written report, which shall include
recommendations in respect to increased accountability and
efficiency, and shall provide the report to the administrative
office of each county board in which the governmental unit is
located no later than March 31, 2025. Thereafter, the report
shall be filed no later than 18 months after the formation of
the committee. The report shall be made available to the

public.
For purposes of this Section, if a governmental unit is
located in multiple counties, the committee may, if required,
provide the same report to the county board of each of those
counties.

Sec. 35. Penalties for failure to submit a report. The
county may impose a civil penalty of up to $1,000 by board vote
in a public meeting against a governmental unit whose
decennial committee failed to submit to the administrative
office of the county board a decennial report under Section
25. The civil penalty shall be paid to the county that imposes
the civil penalty.
The States Attorney for the county that imposed the civil
penalty may bring an action in the circuit court to enforce the
collection of a civil penalty imposed under this Section.

Sec. 40. County board commission; report.
(a) Each county board shall create a decennial commission
every 10 years to review the efficiency and cost reduction
analysis reports submitted by decennial committees under this
Act. The first county decennial commission must be formed by
April 1, 2025.

(b) Each county decennial commission shall conduct
interviews with representatives from each governmental unit to
review the decennial committee report for the governmental
unit and ask follow-up questions, including questions related
to: (1) any additional information discovered after the
efficiency and cost reduction analysis was completed by the
committee; (2) what steps the representatives believe can be
achieved in an effort to reduce costs; and (3) how the
governmental unit can work with the county to increase
efficiency.
(c) Each county decennial commission shall compile all
findings into a report that also shall recommend ways to
reduce costs, increase efficiency, and consolidate services
and shall include the names of each governmental unit whose
decennial committee failed to submit a decennial report
required under Section 25. The first county decennial
commission report must be filed with the General Assembly by
December 31, 2025. Thereafter, the report shall be filed no
later than 24 months after the committees were required to be
formed under Section 10.
(d) After a county decennial commission has submitted the
report required under subsection (c), the commission is
dissolved until it is reestablished under subsection (a).
