AMENDMENT TO HOUSE BILL 5006
AMENDMENT NO. ______. Amend House Bill 5006 by replacing
everything after the enacting clause with the following:
"Section 5. The Animal Welfare Act is amended by adding
Section 18.5 as follows:
(225 ILCS 605/18.5 new)
Sec. 18.5. Prohibition of the sale, trade, or exchange of
cats or dogs at flea markets. No person, whether licensed under
this Act or not, shall sell, trade, or exchange cats or dogs at
flea markets.
For the purposes of this Section, "flea market" means any
location, other than a permanent retail store, at which space
is rented or otherwise made available to others for the conduct
of business as a transient merchant or an itinerant vendor, as
defined in the Transient Merchant Act of 1987. "Flea market"
does not include:

(1) an event held by a 4-H Club, Junior Farmers Club,
or Future Farmers of America Club;
(2) the Illinois State Fair, the DuQuoin State Fair, an
agricultural association fair, or a county fair;
(3) a stockyard with respect to which the Secretary of
the United States Department of Agriculture has posted
notice that the stockyard is regulated by the federal
Packers and Stockyards Act of 1921 (7 U.S.C. 181 et seq.);
or
(4) an animal control agency or shelter, society for
the prevention of cruelty to animals shelter, humane
society shelter, or rescue group.
For the purposes of this Section, "rescue group" means a
not-for-profit entity whose primary purpose is the placement of
dogs, cats, or other animals that have been removed from an
animal control agency or shelter, society for the prevention of
cruelty to animals shelter, or humane society shelter, or that
have been surrendered or relinquished to the entity by the
previous owner.
Section 99. Effective date. This Act takes effect upon
becoming law.".
