| 2 | AMENDMENT NO. ______. Amend House Bill 4645, on page 1, | ||||||
| 3 | immediately above line 4, by inserting the following: | ||||||
| 4 | "Section 3. The Illinois State Police Law of the Civil | ||||||
| 5 | Administrative Code of Illinois is amended by changing Section | ||||||
| 6 | 2605-51 as follows: | ||||||
| 7 | (20 ILCS 2605/2605-51) | ||||||
| 8 | Sec. 2605-51. Division of the Academy and Training. | ||||||
| 9 | (a) The Division of the Academy and Training shall | ||||||
| 10 | exercise, but not be limited to, the following functions: | ||||||
| 11 | (1) Oversee and operate the Illinois State Police | ||||||
| 12 | Training Academy. | ||||||
| 13 | (2) Train and prepare new officers for a career in law | ||||||
| 14 | enforcement, with innovative, quality training and | ||||||
| 15 | educational practices. | ||||||
| 16 | (3) Offer continuing training and educational programs | ||||||
| |||||||
| |||||||
| 1 | for Illinois State Police employees. | ||||||
| 2 | (4) Oversee the Illinois State Police's recruitment | ||||||
| 3 | initiatives. | ||||||
| 4 | (5) Oversee and operate the Illinois State Police's | ||||||
| 5 | quartermaster. | ||||||
| 6 | (6) Duties assigned to the Illinois State Police in | ||||||
| 7 | Article 5, Chapter 11 of the Illinois Vehicle Code | ||||||
| 8 | concerning testing and training officers on the detection | ||||||
| 9 | of impaired driving. | ||||||
| 10 | (7) Duties assigned to the Illinois State Police in | ||||||
| 11 | Article 108B of the Code of Criminal Procedure of 1963. | ||||||
| 12 | (a-5) Successful completion of the Illinois State Police | ||||||
| 13 | Academy satisfies the minimum standards pursuant to | ||||||
| 14 | subsections (a), (b), and (d) of Section 7 of the Illinois | ||||||
| 15 | Police Training Act and exempts Illinois State Police officers | ||||||
| 16 | from the Illinois Law Enforcement Training Standards Board's | ||||||
| 17 | State Comprehensive Examination and Equivalency Examination. | ||||||
| 18 | Satisfactory completion shall be evidenced by a commission or | ||||||
| 19 | certificate issued to the officer. | ||||||
| 20 | (b) The Division of the Academy and Training shall | ||||||
| 21 | exercise the rights, powers, and duties vested in the former | ||||||
| 22 | Division of State Troopers by Section 17 of the Illinois State | ||||||
| 23 | Police Act. | ||||||
| 24 | (c) Specialized training. The Division of the Academy and | ||||||
| 25 | Training shall provide the following specialized training: | ||||||
| 26 | (1) Crash reconstruction specialist; training. The | ||||||
| |||||||
| |||||||
| 1 | Division of the Academy and Training shall cooperate with | ||||||
| 2 | the Division of Forensic Services to provide specialized | ||||||
| 3 | training in crash reconstruction for Illinois State Police | ||||||
| 4 | officers. Only Illinois State Police officers who | ||||||
| 5 | successfully complete the training may be assigned as | ||||||
| 6 | crash reconstruction specialists. | ||||||
| 7 | (2) Death and homicide investigations; training. The | ||||||
| 8 | Division of the Academy and Training shall provide | ||||||
| 9 | training in death and homicide investigation for Illinois | ||||||
| 10 | State Police officers. Only Illinois State Police officers | ||||||
| 11 | who successfully complete the training may be assigned as | ||||||
| 12 | lead investigators in death and homicide investigations. | ||||||
| 13 | Satisfactory completion of the training shall be evidenced | ||||||
| 14 | by a certificate issued to the officer by the Division of | ||||||
| 15 | the Academy and Training. The Director shall develop a | ||||||
| 16 | process for waiver applications for officers whose prior | ||||||
| 17 | training and experience as homicide investigators may | ||||||
| 18 | qualify them for a waiver. The Director may issue a | ||||||
| 19 | waiver, at his or her discretion, based solely on the | ||||||
| 20 | prior training and experience of an officer as a homicide | ||||||
| 21 | investigator. | ||||||
| 22 | (A) The Division of the Academy and Training shall | ||||||
| 23 | require all homicide investigator training to include | ||||||
| 24 | instruction on victim-centered, trauma-informed | ||||||
| 25 | investigation. This training must be implemented by | ||||||
| 26 | July 1, 2023. | ||||||
| |||||||
| |||||||
| 1 | (B) The Division of the Academy and Training shall | ||||||
| 2 | cooperate with the Division of Criminal Investigation | ||||||
| 3 | to develop a model curriculum on victim-centered, | ||||||
| 4 | trauma-informed investigation. This curriculum must be | ||||||
| 5 | implemented by July 1, 2023. | ||||||
| 6 | (3) Investigation of officer-involved criminal sexual | ||||||
| 7 | assault; training. The Division of the Academy and | ||||||
| 8 | Training shall cooperate with the Division of Criminal | ||||||
| 9 | Investigation to provide a specialized criminal sexual | ||||||
| 10 | assault and sexual abuse investigation training program | ||||||
| 11 | for Illinois State Police officers. Only Illinois State | ||||||
| 12 | Police officers who successfully complete the training may | ||||||
| 13 | be assigned as investigators in officer-involved criminal | ||||||
| 14 | sexual assault investigations under Section 10 of the Law | ||||||
| 15 | Enforcement Criminal Sexual Assault Investigation Act. | ||||||
| 16 | (4) Investigation of officer-involved deaths; | ||||||
| 17 | training. The Division of the Academy and Training shall | ||||||
| 18 | have a written policy regarding the investigation of | ||||||
| 19 | officer-involved deaths that involve a law enforcement | ||||||
| 20 | officer employed by the Illinois State Police as required | ||||||
| 21 | under Section 1-10 of the Police and Community Relations | ||||||
| 22 | Improvement Act and shall provide specialized training in | ||||||
| 23 | that policy for Illinois State Police officers. | ||||||
| 24 | (5) Juvenile police officer; training. The Division of | ||||||
| 25 | the Academy and Training shall provide or approve | ||||||
| 26 | specialized training for Illinois State Police officers | ||||||
| |||||||
| |||||||
| 1 | serving, or seeking to serve, as juvenile police officers, | ||||||
| 2 | as that term is defined in paragraph (17) of Section 1-3 of | ||||||
| 3 | the Juvenile Court Act of 1987. The training shall include | ||||||
| 4 | initial and continuing education requirements approved by | ||||||
| 5 | the Director of the Illinois State Police. Illinois State | ||||||
| 6 | Police officers who successfully complete the training | ||||||
| 7 | under this subsection may be designated as juvenile police | ||||||
| 8 | officers and may perform duties consistent with that | ||||||
| 9 | designation, including the questioning of juveniles on | ||||||
| 10 | school grounds as provided under Section 22-88 of the | ||||||
| 11 | School Code. Juvenile specialist; training. The Division | ||||||
| 12 | of the Academy and Training shall provide specialized | ||||||
| 13 | juvenile training for Illinois State Police officers who | ||||||
| 14 | meet the definition of "juvenile police officer" as | ||||||
| 15 | defined under paragraph (17) of Section 1-3 of the | ||||||
| 16 | Juvenile Court Act of 1987. Juvenile specialists may | ||||||
| 17 | complete questioning of juveniles on school grounds as | ||||||
| 18 | provided under Section 22-88 of the School Code. | ||||||
| 19 | (6) Peer support program; training. The Division of | ||||||
| 20 | the Academy and Training shall cooperate with the Office | ||||||
| 21 | of the Director to provide peer support advisors with | ||||||
| 22 | appropriate specialized training in counseling to conduct | ||||||
| 23 | peer support counseling sessions under Section 10 of the | ||||||
| 24 | First Responders Suicide Prevention Act. | ||||||
| 25 | (7) Police dog training standards; training. All | ||||||
| 26 | police dogs used by the Illinois State Police for drug | ||||||
| |||||||
| |||||||
| 1 | enforcement purposes pursuant to the Cannabis Control Act, | ||||||
| 2 | the Illinois Controlled Substances Act, and the | ||||||
| 3 | Methamphetamine Control and Community Protection Act shall | ||||||
| 4 | be trained by programs that meet the certification | ||||||
| 5 | requirements set by the Director or the Director's | ||||||
| 6 | designee. Satisfactory completion of the training shall be | ||||||
| 7 | evidenced by a certificate issued by the Division of the | ||||||
| 8 | Academy and Training. | ||||||
| 9 | (8) Safe2Help; training. The Division of the Academy | ||||||
| 10 | and Training shall cooperate with the Division of Criminal | ||||||
| 11 | Investigation to ensure all program personnel or call | ||||||
| 12 | center staff, or both, are appropriately trained in the | ||||||
| 13 | areas described in subsection (f) of Section 10 of the | ||||||
| 14 | Student Confidential Reporting Act. (10) | ||||||
| 15 | (c-5) In-service training. | ||||||
| 16 | (1) At least once, the Division of the Academy and | ||||||
| 17 | Training shall develop and require the following | ||||||
| 18 | in-service training opportunities to be completed by | ||||||
| 19 | Illinois State Police officers: | ||||||
| 20 | (A) Cell phone medical information; training. | ||||||
| 21 | Training required under this subparagraph (A) shall | ||||||
| 22 | provide instruction on accessing and using medical | ||||||
| 23 | information stored in cell phones. The Division may | ||||||
| 24 | use the program approved under Section 2310-711 of the | ||||||
| 25 | Department of Public Health Powers and Duties Law of | ||||||
| 26 | the Civil Administrative Code of Illinois to develop | ||||||
| |||||||
| |||||||
| 1 | the Division's program. | ||||||
| 2 | (B) Autism spectrum disorders; training. Training | ||||||
| 3 | required under this subparagraph (B) shall instruct | ||||||
| 4 | Illinois State Police officers on the nature of autism | ||||||
| 5 | spectrum disorders and in identifying and | ||||||
| 6 | appropriately responding to individuals with autism | ||||||
| 7 | spectrum disorders. The Illinois State Police shall | ||||||
| 8 | review the training curriculum and may consult with | ||||||
| 9 | the Department of Public Health or the Department of | ||||||
| 10 | Human Services to update the training curriculum as | ||||||
| 11 | needed. | ||||||
| 12 | (2) At least every year, the Division of the Academy | ||||||
| 13 | and Training shall provide the following in-service | ||||||
| 14 | training to Illinois State Police officers: | ||||||
| 15 | (A) Cultural diversity; training. | ||||||
| 16 | (i) Training required under this subparagraph | ||||||
| 17 | (A) shall provide training and continuing | ||||||
| 18 | education to Illinois State Police officers | ||||||
| 19 | concerning cultural diversity, including topics | ||||||
| 20 | such as sensitivity toward racial and ethnic | ||||||
| 21 | differences. | ||||||
| 22 | (ii) This training and continuing education | ||||||
| 23 | shall, among other things, emphasize that the | ||||||
| 24 | primary purpose of enforcement of the Illinois | ||||||
| 25 | Vehicle Code is safety and equal, uniform, and | ||||||
| 26 | non-discriminatory enforcement of the law. | ||||||
| |||||||
| |||||||
| 1 | (B) Minimum annual in-service training | ||||||
| 2 | requirements. Minimum annual in-service training | ||||||
| 3 | includes: | ||||||
| 4 | (i) crisis intervention training; | ||||||
| 5 | (ii) emergency medical response training and | ||||||
| 6 | certification; | ||||||
| 7 | (iii) firearm qualification training; | ||||||
| 8 | (iv) law updates; and | ||||||
| 9 | (v) officer wellness and mental health. | ||||||
| 10 | (C) Firearms restraining orders; training. | ||||||
| 11 | Training required under this subparagraph (C) shall | ||||||
| 12 | provide instruction on the processes used to file a | ||||||
| 13 | firearms restraining order, to identify situations in | ||||||
| 14 | which a firearms restraining order is appropriate, and | ||||||
| 15 | to safely promote the usage of the firearms | ||||||
| 16 | restraining order in different situations. | ||||||
| 17 | (3) At least every 3 years, the Division of the | ||||||
| 18 | Academy and Training shall provide the following | ||||||
| 19 | in-service training to Illinois State Police officers: | ||||||
| 20 | (A) Arrest and use of force and control tactics; | ||||||
| 21 | training. Training required under this subparagraph | ||||||
| 22 | (A) shall provide to Illinois State Police officers | ||||||
| 23 | training and continuing education concerning knowledge | ||||||
| 24 | of policies and laws regulating the use of force; | ||||||
| 25 | shall equip officers with tactics and skills, | ||||||
| 26 | including de-escalation techniques, to prevent or | ||||||
| |||||||
| |||||||
| 1 | reduce the need to use force or, when force must be | ||||||
| 2 | used, to use force that is objectively reasonable, | ||||||
| 3 | necessary, and proportional under the totality of the | ||||||
| 4 | circumstances; and shall ensure appropriate | ||||||
| 5 | supervision and accountability. The training shall | ||||||
| 6 | consist of at least 30 hours and shall include: | ||||||
| 7 | (i) at least 12 hours of hands-on, | ||||||
| 8 | scenario-based role-playing; | ||||||
| 9 | (ii) at least 6 hours of instruction on use of | ||||||
| 10 | force techniques, including the use of | ||||||
| 11 | de-escalation techniques to prevent or reduce the | ||||||
| 12 | need for force whenever safe and feasible; | ||||||
| 13 | (iii) specific training on the law concerning | ||||||
| 14 | stops, searches, and the use of force under the | ||||||
| 15 | Fourth Amendment to the United States | ||||||
| 16 | Constitution; | ||||||
| 17 | (iv) specific training on officer safety | ||||||
| 18 | techniques, including cover, concealment, and | ||||||
| 19 | time; and | ||||||
| 20 | (v) at least 6 hours of training focused on | ||||||
| 21 | high-risk traffic stops. | ||||||
| 22 | (B) Minimum triennial in-service training | ||||||
| 23 | requirements. Minimum triennial in-service training | ||||||
| 24 | required this under this subparagraph (B) includes | ||||||
| 25 | training and continuing education to Illinois State | ||||||
| 26 | Police officers concerning: | ||||||
| |||||||
| |||||||
| 1 | (i) constitutional and proper use of law | ||||||
| 2 | enforcement authority; | ||||||
| 3 | (ii) civil and human rights; | ||||||
| 4 | (iii) cultural competency, including implicit | ||||||
| 5 | bias and racial and ethnic sensitivity; and | ||||||
| 6 | (iv) procedural justice. | ||||||
| 7 | (C) Mandated reporter; training. Training required | ||||||
| 8 | under this subparagraph (C) must be approved by the | ||||||
| 9 | Department of Children and Family Services as provided | ||||||
| 10 | under Section 4 of the Abused and Neglected Child | ||||||
| 11 | Reporting Act and includes training on the reporting | ||||||
| 12 | of child abuse and neglect. | ||||||
| 13 | (D) Sexual assault and sexual abuse; training. | ||||||
| 14 | (i) Training required under this subparagraph | ||||||
| 15 | (D) shall include in-service training on sexual | ||||||
| 16 | assault and sexual abuse response and training on | ||||||
| 17 | report writing requirements, including, but not | ||||||
| 18 | limited to, the following: | ||||||
| 19 | (a) recognizing the symptoms of trauma; | ||||||
| 20 | (b) understanding the role trauma has | ||||||
| 21 | played in a victim's life; | ||||||
| 22 | (c) responding to the needs and concerns | ||||||
| 23 | of a victim; | ||||||
| 24 | (d) delivering services in a | ||||||
| 25 | compassionate, sensitive, and nonjudgmental | ||||||
| 26 | manner; | ||||||
| |||||||
| |||||||
| 1 | (e) interviewing techniques in accordance | ||||||
| 2 | with the curriculum standards in subdivision | ||||||
| 3 | (iii) of this subparagraph; | ||||||
| 4 | (f) understanding cultural perceptions and | ||||||
| 5 | common myths of sexual assault and sexual | ||||||
| 6 | abuse; and | ||||||
| 7 | (g) report writing techniques in | ||||||
| 8 | accordance with the curriculum standards in | ||||||
| 9 | subdivision (iii) of this subparagraph and the | ||||||
| 10 | Sexual Assault Incident Procedure Act. | ||||||
| 11 | (ii) Instructors providing training under this | ||||||
| 12 | subparagraph (D) (G) shall have successfully | ||||||
| 13 | completed training on evidence-based, | ||||||
| 14 | trauma-informed, victim-centered responses to | ||||||
| 15 | cases of sexual assault and sexual abuse and shall | ||||||
| 16 | have experience responding to sexual assault and | ||||||
| 17 | sexual abuse cases. | ||||||
| 18 | (iii) The Illinois State Police shall adopt | ||||||
| 19 | rules, in consultation with the Office of the | ||||||
| 20 | Attorney General and the Illinois Law Enforcement | ||||||
| 21 | Training Standards Board, to determine the | ||||||
| 22 | specific training requirements. The rules adopted | ||||||
| 23 | by the Illinois State Police shall include, at a | ||||||
| 24 | minimum, both of the following: | ||||||
| 25 | (a) evidence-based curriculum standards | ||||||
| 26 | for report writing and immediate response to | ||||||
| |||||||
| |||||||
| 1 | sexual assault and sexual abuse, including | ||||||
| 2 | trauma-informed, victim-centered interview | ||||||
| 3 | techniques, which have been demonstrated to | ||||||
| 4 | minimize retraumatization, for all Illinois | ||||||
| 5 | State Police officers; and | ||||||
| 6 | (b) evidence-based curriculum standards | ||||||
| 7 | for trauma-informed, victim-centered | ||||||
| 8 | investigation and interviewing techniques, | ||||||
| 9 | which have been demonstrated to minimize | ||||||
| 10 | retraumatization, for cases of sexual assault | ||||||
| 11 | and sexual abuse for all Illinois State Police | ||||||
| 12 | officers who conduct sexual assault and sexual | ||||||
| 13 | abuse investigations. | ||||||
| 14 | (4) At least every 5 years, the Division of the | ||||||
| 15 | Academy and Training shall provide the following | ||||||
| 16 | in-service training to Illinois State Police officers: | ||||||
| 17 | (A) Psychology of domestic violence; training. | ||||||
| 18 | Training under this subparagraph (A) shall provide aid | ||||||
| 19 | in understanding the actions of domestic violence | ||||||
| 20 | victims and abusers and the actions needed to prevent | ||||||
| 21 | further victimization of those who have been abused. | ||||||
| 22 | The training shall focus specifically on looking | ||||||
| 23 | beyond physical evidence to the psychology of domestic | ||||||
| 24 | violence situations by studying the dynamics of the | ||||||
| 25 | aggressor-victim relationship, separately evaluating | ||||||
| 26 | claims where both parties claim to be the victim, and | ||||||
| |||||||
| |||||||
| 1 | assessing the long-term effects of domestic violence | ||||||
| 2 | situations. | ||||||
| 3 | (c-10) Cadet training. The Division of the Academy and | ||||||
| 4 | Training shall provide the following basic training to | ||||||
| 5 | Illinois State Police cadets or ensure the following training | ||||||
| 6 | was completed prior to an Illinois State Police cadet becoming | ||||||
| 7 | an Illinois State Police officer: | ||||||
| 8 | (1) Animal fighting awareness and humane response; | ||||||
| 9 | training. Training required under this paragraph (1) shall | ||||||
| 10 | include a training program in animal fighting awareness | ||||||
| 11 | and humane response for Illinois State Police cadets. The | ||||||
| 12 | purpose of that training shall be for Illinois State | ||||||
| 13 | Police officers to identify animal fighting operations and | ||||||
| 14 | respond appropriately. Training under this paragraph (1) | ||||||
| 15 | shall include a humane response component that provides | ||||||
| 16 | guidelines for appropriate law enforcement response to | ||||||
| 17 | animal abuse, cruelty, and neglect, or similar condition, | ||||||
| 18 | as well as training on canine behavior and nonlethal ways | ||||||
| 19 | to subdue a canine. | ||||||
| 20 | (2) Arrest and use of force and control tactics and | ||||||
| 21 | officer safety; training. Training required under this | ||||||
| 22 | paragraph (2) must include, without limitation, training | ||||||
| 23 | on officer safety techniques, such as cover, concealment, | ||||||
| 24 | and time. | ||||||
| 25 | (3) Arrest of a parent or an immediate family member; | ||||||
| 26 | training. Training required under this paragraph (3) shall | ||||||
| |||||||
| |||||||
| 1 | instruct Illinois State Police cadets on trauma-informed | ||||||
| 2 | responses designed to ensure the physical safety and | ||||||
| 3 | well-being of a child of an arrested parent or immediate | ||||||
| 4 | family member, which must include, without limitation: (A) | ||||||
| 5 | training in understanding the trauma experienced by the | ||||||
| 6 | child while maintaining the integrity of the arrest and | ||||||
| 7 | safety of officers, suspects, and other involved | ||||||
| 8 | individuals; (B) training in de-escalation tactics that | ||||||
| 9 | would include the use of force when reasonably necessary; | ||||||
| 10 | and (C) training in understanding and inquiring whether a | ||||||
| 11 | child will require supervision and care. | ||||||
| 12 | (4) Autism and other developmental or physical | ||||||
| 13 | disabilities; training. Training required under this | ||||||
| 14 | paragraph (4) shall instruct Illinois State Police cadets | ||||||
| 15 | on identifying and interacting with persons with autism | ||||||
| 16 | and other developmental or physical disabilities, reducing | ||||||
| 17 | barriers to reporting crimes against persons with autism, | ||||||
| 18 | and addressing the unique challenges presented by cases | ||||||
| 19 | involving victims or witnesses with autism and other | ||||||
| 20 | developmental disabilities. | ||||||
| 21 | (5) Cell phone medical information; training. Training | ||||||
| 22 | required under this paragraph (5) shall instruct Illinois | ||||||
| 23 | State Police cadets to access and use medical information | ||||||
| 24 | stored in cell phones. The Division of the Academy and | ||||||
| 25 | Training may use the program approved under Section | ||||||
| 26 | 2310-711 of the Department of Public Health Powers and | ||||||
| |||||||
| |||||||
| 1 | Duties Law of the Civil Administrative Code of Illinois to | ||||||
| 2 | develop the training required under this paragraph (5). | ||||||
| 3 | (6) Compliance with the Health Care Violence | ||||||
| 4 | Prevention Act; training. Training required under this | ||||||
| 5 | paragraph (6) shall provide an appropriate level of | ||||||
| 6 | training for Illinois State Police cadets concerning the | ||||||
| 7 | Health Care Violence Prevention Act. | ||||||
| 8 | (7) Constitutional law; training. Training required | ||||||
| 9 | under this paragraph (7) shall instruct Illinois State | ||||||
| 10 | Police cadets on constitutional and proper use of law | ||||||
| 11 | enforcement authority, procedural justice, civil rights, | ||||||
| 12 | human rights, and cultural competency, including implicit | ||||||
| 13 | bias and racial and ethnic sensitivity. | ||||||
| 14 | (8) Courtroom testimony; training. | ||||||
| 15 | (9) Crime victims; training. Training required under | ||||||
| 16 | this paragraph (9) shall provide instruction in techniques | ||||||
| 17 | designed to promote effective communication at the initial | ||||||
| 18 | contact with crime victims and to comprehensively explain | ||||||
| 19 | to victims and witnesses their rights under the Rights of | ||||||
| 20 | Crime Victims and Witnesses Act and the Crime Victims | ||||||
| 21 | Compensation Act. | ||||||
| 22 | (10) Criminal law; training. | ||||||
| 23 | (11) Crisis intervention team and mental health | ||||||
| 24 | awareness; training. Training required under this | ||||||
| 25 | paragraph (11) shall include a specialty certification | ||||||
| 26 | course of at least 40 hours, addressing specialized | ||||||
| |||||||
| |||||||
| 1 | policing responses to people with mental illnesses. The | ||||||
| 2 | Division of the Academy and Training shall conduct Crisis | ||||||
| 3 | Intervention Team training programs that train officers to | ||||||
| 4 | identify signs and symptoms of mental illness, to | ||||||
| 5 | de-escalate situations involving individuals who appear to | ||||||
| 6 | have a mental illness and connect individuals in crisis to | ||||||
| 7 | treatment. | ||||||
| 8 | (12) Cultural diversity; training. | ||||||
| 9 | (A) The training required under this paragraph | ||||||
| 10 | (12) shall provide training to Illinois State Police | ||||||
| 11 | cadets concerning cultural competency and cultural | ||||||
| 12 | diversity, including sensitivity toward racial and | ||||||
| 13 | ethnic differences. | ||||||
| 14 | (B) This training shall include, but not be | ||||||
| 15 | limited to, an emphasis on the fact that the primary | ||||||
| 16 | purpose of enforcement of the Illinois Vehicle Code is | ||||||
| 17 | safety, equal, and uniform and non-discriminatory | ||||||
| 18 | enforcement under the law. | ||||||
| 19 | (13) De-escalation and use of force; training. | ||||||
| 20 | Training required under this paragraph (13) must consist | ||||||
| 21 | of at least 6 hours of instruction on use of force | ||||||
| 22 | techniques, including the use of de-escalation techniques | ||||||
| 23 | to prevent or reduce the need for force whenever safe and | ||||||
| 24 | feasible. | ||||||
| 25 | (14) Domestic violence; training. Training required | ||||||
| 26 | under this paragraph (14) shall provide aid in | ||||||
| |||||||
| |||||||
| 1 | understanding the actions of domestic violence victims and | ||||||
| 2 | abusers and to prevent further victimization of those who | ||||||
| 3 | have been abused, focusing specifically on looking beyond | ||||||
| 4 | the physical evidence to the psychology of domestic | ||||||
| 5 | violence situations, such as the dynamics of the | ||||||
| 6 | aggressor-victim relationship, separately evaluating | ||||||
| 7 | claims where both parties claim to be the victim, and | ||||||
| 8 | long-term effects. | ||||||
| 9 | (15) Effective recognition of and responses to stress, | ||||||
| 10 | trauma, and post-traumatic stress; training. Training | ||||||
| 11 | required under this paragraph (15) shall instruct Illinois | ||||||
| 12 | State Police cadets to recognize and respond to stress, | ||||||
| 13 | trauma, and post-traumatic stress experienced by law | ||||||
| 14 | enforcement officers. The training must be consistent with | ||||||
| 15 | Section 25 of the Illinois Mental Health First Aid | ||||||
| 16 | Training Act in a peer setting, including recognizing | ||||||
| 17 | signs and symptoms of work-related cumulative stress, | ||||||
| 18 | issues that may lead to suicide, and solutions for | ||||||
| 19 | intervention with peer support resources. | ||||||
| 20 | (16) Elder abuse; training. Training required under | ||||||
| 21 | this paragraph (16) shall teach Illinois State Police | ||||||
| 22 | cadets to recognize neglect and financial exploitation | ||||||
| 23 | against the elderly and adults with disabilities. The | ||||||
| 24 | training shall also teach Illinois State Police cadets to | ||||||
| 25 | recognize self-neglect by the elderly and adults with | ||||||
| 26 | disabilities. In this subparagraph, "adults with | ||||||
| |||||||
| |||||||
| 1 | disabilities" has the meaning given to that term in the | ||||||
| 2 | Adult Protective Services Act. | ||||||
| 3 | (17) Electronic control devices; training. Training | ||||||
| 4 | required under this paragraph (17) shall include training | ||||||
| 5 | in the use of electronic control devices, including the | ||||||
| 6 | psychological and physiological effects of the use of | ||||||
| 7 | those devices on humans. | ||||||
| 8 | (18) Epinephrine auto-injector administration; | ||||||
| 9 | training. Training required under this paragraph (18) | ||||||
| 10 | shall instruct Illinois State Police cadets to recognize | ||||||
| 11 | and respond to anaphylaxis. The training must comply with | ||||||
| 12 | subsection (c) of Section 40 of the Illinois State Police | ||||||
| 13 | Act. | ||||||
| 14 | (19) Evidence collection; training. Training required | ||||||
| 15 | under this paragraph (19) must include proper procedures | ||||||
| 16 | for collecting, handling, and preserving evidence, and | ||||||
| 17 | rules of law. | ||||||
| 18 | (20) Firearms restraining orders; training. Providing | ||||||
| 19 | instruction on the process used to file a firearms | ||||||
| 20 | restraining order and how to identify situations in which | ||||||
| 21 | a firearms restraining order is appropriate and how to | ||||||
| 22 | safely promote the usage of the firearms restraining order | ||||||
| 23 | in different situations. | ||||||
| 24 | (21) Firearms; training. Successful completion of a | ||||||
| 25 | 40-hour course of training in use of a suitable type | ||||||
| 26 | firearm shall be a condition precedent to the possession | ||||||
| |||||||
| |||||||
| 1 | and use of that respective firearm in connection with the | ||||||
| 2 | officer's official duties. To satisfy the requirements of | ||||||
| 3 | this Act, the training must include the following: | ||||||
| 4 | (A) Instruction in the dangers of misuse of the | ||||||
| 5 | firearm, safety rules, and care and cleaning of the | ||||||
| 6 | firearm. | ||||||
| 7 | (B) Practice firing on a range and qualification | ||||||
| 8 | with the firearm in accordance with the standards | ||||||
| 9 | established by the Board. | ||||||
| 10 | (C) Instruction in the legal use of firearms under | ||||||
| 11 | the Criminal Code of 2012 and relevant court | ||||||
| 12 | decisions. | ||||||
| 13 | (D) A forceful presentation of the ethical and | ||||||
| 14 | moral considerations assumed by any person who uses a | ||||||
| 15 | firearm. | ||||||
| 16 | (22) First-aid; training. First-aid training must | ||||||
| 17 | include cardiopulmonary resuscitation. | ||||||
| 18 | (23) Hate crimes; training. Training required under | ||||||
| 19 | this paragraph (23) shall instruct Illinois State Police | ||||||
| 20 | cadets in identifying, responding to, and reporting all | ||||||
| 21 | hate crimes. | ||||||
| 22 | (24) High-risk traffic stops; training. Training | ||||||
| 23 | required under this paragraph (24) must consist of at | ||||||
| 24 | least 6 hours of training focused on high-risk traffic | ||||||
| 25 | stops. | ||||||
| 26 | (25) High-speed vehicle chase; training. Training | ||||||
| |||||||
| |||||||
| 1 | required under this paragraph (25) shall instruct Illinois | ||||||
| 2 | State Police cadets on the hazards of high-speed police | ||||||
| 3 | vehicle chases with an emphasis on alternatives to the | ||||||
| 4 | high-speed vehicle chase. | ||||||
| 5 | (26) Human relations; training. | ||||||
| 6 | (27) Human trafficking; training. Training required | ||||||
| 7 | under this paragraph (27) shall instruct Illinois State | ||||||
| 8 | Police cadets in the detection and investigation of all | ||||||
| 9 | forms of human trafficking, including, but not limited to, | ||||||
| 10 | involuntary servitude under subsection (b) of Section 10-9 | ||||||
| 11 | of the Criminal Code of 2012, involuntary sexual servitude | ||||||
| 12 | of a minor under subsection (c) of Section 10-9 of the | ||||||
| 13 | Criminal Code of 2012, and trafficking in persons under | ||||||
| 14 | subsection (d) of Section 10-9 of the Criminal Code of | ||||||
| 15 | 2012. This program shall be made available to all cadets | ||||||
| 16 | and Illinois State Police officers. | ||||||
| 17 | (28) Juvenile law; training. Training required under | ||||||
| 18 | this paragraph (28) shall instruct Illinois State Police | ||||||
| 19 | cadets on juvenile law and the proper processing and | ||||||
| 20 | handling of juvenile offenders. | ||||||
| 21 | (29) Mandated reporter; training. Training required | ||||||
| 22 | under this paragraph (29) must be approved by the | ||||||
| 23 | Department of Children and Family Services as provided | ||||||
| 24 | under Section 4 of the Abused and Neglected Child | ||||||
| 25 | Reporting Act and includes training on the reporting of | ||||||
| 26 | child abuse and neglect. | ||||||
| |||||||
| |||||||
| 1 | (30) Mental conditions and crises, training. Training | ||||||
| 2 | required under this paragraph (30) shall include, without | ||||||
| 3 | limitation, (A) recognizing the disease of addiction, (B) | ||||||
| 4 | recognizing situations which require immediate assistance, | ||||||
| 5 | and (C) responding in a manner that safeguards and | ||||||
| 6 | provides assistance to individuals in need of mental | ||||||
| 7 | treatment. | ||||||
| 8 | (31) Officer wellness and suicide prevention; | ||||||
| 9 | training. The training required under this paragraph (31) | ||||||
| 10 | shall include instruction on job-related stress management | ||||||
| 11 | techniques, skills for recognizing signs and symptoms of | ||||||
| 12 | work-related cumulative stress, recognition of other | ||||||
| 13 | issues that may lead to officer suicide, solutions for | ||||||
| 14 | intervention, and a presentation on available peer support | ||||||
| 15 | resources. | ||||||
| 16 | (32) Officer-worn body cameras; training. | ||||||
| 17 | (A) As used in this paragraph (32), "officer-worn | ||||||
| 18 | body camera" has the meaning given to that term in | ||||||
| 19 | Article 10 of the Law Enforcement Officer-Worn Body | ||||||
| 20 | Camera Act. | ||||||
| 21 | (B) The training required under this paragraph | ||||||
| 22 | (32) shall provide training in the use of officer-worn | ||||||
| 23 | body cameras to cadets who will use officer-worn body | ||||||
| 24 | cameras. | ||||||
| 25 | (33) Opioid antagonists; training. | ||||||
| 26 | (A) As used in this paragraph (33), "opioid | ||||||
| |||||||
| |||||||
| 1 | antagonist" has the meaning given to that term in | ||||||
| 2 | subsection (e) of Section 5-23 of the Substance Use | ||||||
| 3 | Disorder Act. | ||||||
| 4 | (B) Training required under this paragraph (33) | ||||||
| 5 | shall instruct Illinois State Police cadets to | ||||||
| 6 | administer opioid antagonists. | ||||||
| 7 | (34) Persons arrested while under the influence of | ||||||
| 8 | alcohol or drugs; training. Training required under this | ||||||
| 9 | paragraph (34) shall comply with Illinois State Police | ||||||
| 10 | policy adopted under Section 2605-54. The training shall | ||||||
| 11 | be consistent with the Substance Use Disorder Act and | ||||||
| 12 | shall provide guidance for the arrest of persons under the | ||||||
| 13 | influence of alcohol or drugs, proper medical attention if | ||||||
| 14 | warranted, and care and release of those persons from | ||||||
| 15 | custody. The training shall provide guidance concerning | ||||||
| 16 | the release of persons arrested under the influence of | ||||||
| 17 | alcohol or drugs who are under the age of 21 years of age, | ||||||
| 18 | which shall include, but shall not be limited to, | ||||||
| 19 | instructions requiring the arresting officer to make a | ||||||
| 20 | reasonable attempt to contact a responsible adult who is | ||||||
| 21 | willing to take custody of the person who is under the | ||||||
| 22 | influence of alcohol or drugs. | ||||||
| 23 | (35) Physical training. | ||||||
| 24 | (36) Post-traumatic stress disorder; training. | ||||||
| 25 | Training required under this paragraph (36) shall equip | ||||||
| 26 | Illinois State Police cadets to identify the symptoms of | ||||||
| |||||||
| |||||||
| 1 | post-traumatic stress disorder and to respond | ||||||
| 2 | appropriately to individuals exhibiting those symptoms. | ||||||
| 3 | (37) Report writing; training. Training required under | ||||||
| 4 | this paragraph (37) shall instruct Illinois State Police | ||||||
| 5 | cadets on writing reports and proper documentation of | ||||||
| 6 | statements. | ||||||
| 7 | (38) Scenario training. At least 12 hours of hands-on, | ||||||
| 8 | scenario-based role-playing. | ||||||
| 9 | (39) Search and seizure; training. Training required | ||||||
| 10 | under this paragraph (39) shall instruct Illinois State | ||||||
| 11 | Police cadets on search and seizure, including temporary | ||||||
| 12 | questioning. | ||||||
| 13 | (40) Sexual assault and sexual abuse; training. | ||||||
| 14 | Training required under this paragraph (40) shall instruct | ||||||
| 15 | Illinois State Police cadets on sexual assault and sexual | ||||||
| 16 | abuse response and report writing training requirements, | ||||||
| 17 | including, but not limited to, the following: | ||||||
| 18 | (A) recognizing the symptoms of trauma; | ||||||
| 19 | (B) understanding the role trauma has played in a | ||||||
| 20 | victim's life; | ||||||
| 21 | (C) responding to the needs and concerns of a | ||||||
| 22 | victim; | ||||||
| 23 | (D) delivering services in a compassionate, | ||||||
| 24 | sensitive, and nonjudgmental manner; | ||||||
| 25 | (E) interviewing techniques in accordance with the | ||||||
| 26 | curriculum standards in subsection (f) of Section | ||||||
| |||||||
| |||||||
| 1 | 10.19 of the Illinois Police Training Act; | ||||||
| 2 | (F) understanding cultural perceptions and common | ||||||
| 3 | myths of sexual assault and sexual abuse; and | ||||||
| 4 | (G) report-writing techniques in accordance with | ||||||
| 5 | the curriculum standards in subsection (f) of Section | ||||||
| 6 | 10.19 of the Illinois Police Training Act and the | ||||||
| 7 | Sexual Assault Incident Procedure Act. | ||||||
| 8 | (41) Traffic control and crash investigation; | ||||||
| 9 | training. | ||||||
| 10 | (d) The Division of the Academy and Training shall | ||||||
| 11 | administer and conduct a program consistent with 18 U.S.C. | ||||||
| 12 | 926B and 926C for qualified active and retired Illinois State | ||||||
| 13 | Police officers. | ||||||

| 19 | Sec. 10.30. Training; eligibility; juvenile officers. | ||||||
| 20 | (a) The Board shall conduct or approve a training program, | ||||||
| 21 | including continuing educational requirements, for law | ||||||
| 22 | enforcement officers of local law enforcement agencies serving | ||||||
| 23 | as Juvenile Officers pursuant to the respective provisions of | ||||||
| 24 | the Juvenile Court Act of 1987. Except as provided under | ||||||
| |||||||
| |||||||
| 1 | subsection (d), only law enforcement officers who successfully | ||||||
| 2 | complete the training program, including continuing | ||||||
| 3 | educational requirements, may be assigned or continue as | ||||||
| 4 | juvenile officers. Satisfactory completion of the training | ||||||
| 5 | program shall be evidenced by a certificate issued to the law | ||||||
| 6 | enforcement officer by the Board. | ||||||
| 7 | (b) The Board shall set eligibility requirements for law | ||||||
| 8 | enforcement officers entering an initial training program | ||||||
| 9 | under subsection (a). The Board's eligibility requirements | ||||||
| 10 | shall include a provision authorizing the Board to waive any | ||||||
| 11 | eligibility requirement for an agency that demonstrates the | ||||||
| 12 | requirement would create a hardship for the agency. | ||||||
| 13 | (c) Within one year after the effective date of this | ||||||
| 14 | amendatory Act of the 104th General Assembly, the Board shall | ||||||
| 15 | adopt administrative rules addressing the details of the | ||||||
| 16 | training program, including standards for eligibility, | ||||||
| 17 | requirements for continued education, recognition and credit | ||||||
| 18 | for prior trainings completed, and the process for renewal. | ||||||
| 19 | (d) The administrative rules shall provide that a law | ||||||
| 20 | enforcement officer who, prior to the adoption of the | ||||||
| 21 | administrative rules, has completed the necessary initial | ||||||
| 22 | juvenile officers training prescribed by the Board may | ||||||
| 23 | continue to serve as a juvenile officer until certified. | ||||||
| 24 | Application for initial certification for such officer must be | ||||||
| 25 | made no later than January 1, 2028. Such officer is not | ||||||
| 26 | required to retake the initial juvenile officer training | ||||||
| |||||||
| |||||||
| 1 | prescribed by the Board prior to certification."; and | ||||||
