AMENDMENT TO HOUSE BILL 4628
AMENDMENT NO. ______. Amend House Bill 4628 by replacing
everything after the enacting clause with the following:
"Section 1. Short title. This Act may be cited as the
Retail Sale of Tianeptine Prohibition Act.
Section 5. Retail sale of tianeptine products.
(a) Beginning January 1, 2025, no person shall sell, offer
to sell, or distribute in the State any product containing
tianeptine.
(b) This prohibition does not apply to any product
containing tianeptine that is lawfully dispensed or prescribed
by a pharmacist or a health care professional. In this
subsection (b), "health care professional" means any person
who treats human ailments and is subject to licensure or
regulation by this State, including students and residents.

Section 10. Sentence. A violation of Section 5 is a
business offense, punishable by a minimum fine of $1,500 for
each violation.
