AMENDMENT TO HOUSE BILL 4277
AMENDMENT NO. ______. Amend House Bill 4277 by replacing
everything after the enacting clause with the following:
"Section 5. The Illinois Public Aid Code is amended by
adding Section 11-5.5 as follows:
(305 ILCS 5/11-5.5 new)
Sec. 11-5.5. Provisional eligibility determinations and
policies and procedures to comply with federal deadlines for
eligibility determinations.
(a) The General Assembly finds that it is in the best
interest of the State to process on an expedited basis
applications for Medicaid and Medicaid long-term care benefits
that are submitted by or on behalf of elderly persons in need
of long-term care services in order to comply with federal
deadlines for eligibility determinations as provided in 42
U.S.C. 1396a(a)(8) and 42 CFR 435.

(b) It is the intent of the General Assembly that the
provisions of this Section be liberally construed to permit the
maximum number of applicants to benefit, regardless of the age
of the application, and for the State to meet the federal
eligibility processing deadlines.
Section 99. Effective date. This Act takes effect upon
becoming law.".
