AMENDMENT TO HOUSE BILL 4259
2 AMENDMENT NO. ______. Amend House Bill 4259 by replacing
3everything after the enacting clause with the following:
4 "Section 5. The Illinois Vehicle Code is amended by
5changing Section 8-102 and by adding Section 3-414.5 as
6follows:
7 (625 ILCS 5/3-414.5 new)
8 Sec. 3-414.5. Multi-year registration.
9 (a) The Secretary of State shall permit the owner of a
10motor vehicle of the first division or a motor vehicle of the
11second division weighing not more than 8,000 pounds or a motor
12vehicle of the second division applying for a C class
13registration plate to register the motor vehicle for a period
14of 2 years if the owner selects to register his or her motor
15vehicle under this Section.
16 (1) If the motor vehicle to be registered is required

1 to undergo emissions inspections, the 2-year registration
2 must coincide with the emissions inspection cycle.
3 (2) An applicant for a 2-year registration shall apply
4 online or by completing and mailing the appropriate 2-year
5 registration application form to the address indicated on
6 the form.
7 (3) The owner of a motor vehicle with a 2-year
8 registration may transfer that registration to another
9 motor vehicle with the same emissions inspection
10 requirements, if applicable. The owner of a motor vehicle
11 with a 2-year registration who discontinues use of the
12 registration before the expiration of the 2-year period is
13 not entitled to a complete or a prorated refund of the
14 registration fee.
15 (4) The fee for a 2-year registration shall be twice
16 the applicable annual registration fee for the motor
17 vehicle being registered. If the owner of a motor vehicle
18 issued registration under this subsection is subject to an
19 annual surcharge under Section 3-806 or 3-815, the
20 Secretary of State shall collect the surcharge for each
21 registration year of the multi-year registration at the
22 same time the Secretary of State collects the one-time
23 registration fee.
24 (b) The Secretary of State shall permit the owner of a
25trailer to register the trailer for a period of either one year
26or up to an extended 5-year registration period.

1 (1) The registration shall be based on a recurring
2 5-year registration period. The trailer owner may apply for
3 an annual registration, registration for the full 5 years,
4 or for the number of years remaining in the current 5-year
5 cycle at the time of the registration application.
6 (2) An applicant for a 5-year trailer registration
7 shall apply online or by completing and mailing the
8 appropriate 5-year registration application form to the
9 address indicated on the form.
10 (3) The owner of a trailer with a 5-year registration
11 may transfer that registration to another trailer of the
12 same weight class. The owner of a trailer with a 5-year
13 registration who discontinues use of the registration
14 before the expiration of the 5-year period is not entitled
15 to a complete or a prorated refund of the registration fee.
16 (4) The fee for a 5-year registration shall be the same
17 as the applicable annual registration fee for the trailer
18 being registered multiplied by the number of years
19 remaining in the current 5-year cycle at the time of the
20 registration application.
21 (c) The Secretary of State may adopt rules to implement
22this Section.

24 Sec. 8-102. Alternate methods of giving proof.
25 (a) Except as provided in subsection (b), proof Proof of

1financial responsibility, when required under Section 8-101 or
28-101.1, may be given by filing with the Secretary of State one
3of the following:
4 1. A bond as provided in Section 8-103;
5 2. An insurance policy or other proof of insurance in a
6 form to be prescribed by the Secretary as provided in
7 Section 8-108;
8 3. A certificate of self-insurance issued by the
9 Director;
10 4. A certificate of self-insurance issued to the
11 Regional Transportation Authority by the Director naming
12 municipal or non-municipal public carriers included
13 therein;
14 5. A certificate of coverage issued by an
15 intergovernmental risk management association evidencing
16 coverages which meet or exceed the amounts required under
17 this Code.
18 (b) Beginning January 1, 2020, in lieu of filing the
19documents required by subsection (a), each owner of a vehicle
20required to obtain minimum liability insurance under Section
218-101 or 8-101.1 shall attest that the vehicle is insured in at
22least the minimum required amount.
23 (1) The Secretary shall create a form on which the
24 vehicle owner shall attest that the vehicle is insured in
25 at least the minimum required amount. The attestation form
26 shall be submitted with each registration application.

1 (2) The attestation form shall be valid for the full
2 registration period; however, if at any time the Secretary
3 has reason to believe that the owner does not have the
4 minimum required amount of insurance for a vehicle, the
5 Secretary may require the owner to file with the Secretary
6 documentation as set forth in subsection (a) of this
7 Section.
8 (3) If the owner fails to provide the required
9 documentation within 7 calendar days after the request is
10 made, the Secretary may suspend the vehicle registration.
11 The registration shall remain suspended until such time as
12 the required documentation is provided to and reviewed by
13 the Secretary.
14 (4) The owner of a vehicle that is self-insured shall
15 attest that the funds available to pay liability claims
16 related to the operation of the vehicle are equivalent to
17 or greater than the minimum liability insurance
18 requirements under Section 8-101 or 8-101.1.
19 (c) The Secretary of State may adopt rules to implement
20this Section.

22 Section 99. Effective date. This Act takes effect January
