AMENDMENT TO HOUSE BILL 4259
2 AMENDMENT NO. ______. Amend House Bill 4259 by replacing
3everything after the enacting clause with the following:
4 "Section 5. The Illinois Vehicle Code is amended by
5changing Section 8-102 and by adding Section 3-414.5 as
6follows:
7 (625 ILCS 5/3-414.5 new)
8 Sec. 3-414.5. Multi-year registration.
9 (a) The Secretary may, in his or her discretion, permit the
10owner of a motor vehicle of the first division, a motor vehicle
11of the second division weighing not more than 8,000 pounds, or
12a motor vehicle of the second division applying for a C Class
13registration plate to register the motor vehicle for a period
14of 2 years.
15 (1) If the vehicle to be registered is required to
16 undergo emissions inspections, the 2-year registration

1 must coincide with the emissions inspection cycle.
2 (2) An applicant for a 2-year registration shall apply
3 online or by completing and mailing the appropriate 2-year
4 registration application form to the address indicated on
5 the form.
6 (3) The owner of a vehicle with a 2-year registration
7 may transfer that registration to another vehicle with the
8 same emissions inspection cycle, if applicable. The owner
9 of a vehicle with a 2-year registration who discontinues
10 use of the registration before the expiration of the 2-year
11 period is not entitled to a complete or prorated refund of
12 the registration fee.
13 (4) The fee for a 2-year registration shall be twice
14 the applicable annual registration fee for the vehicle
15 being registered.
16 If a vehicle issued a registration under this subsection is
17subject to an annual surcharge under Section 3-806 or 3-815,
18the Secretary shall collect the surcharge for each registration
19year of the multi-year registration at the same time the
20Secretary collects the one-time registration fee.
21 (b) Beginning January 1, 2021, the Secretary shall permit
22the owner of a trailer to register the trailer for a period of
23one year or for an extended registration period of up to 5
24years.
25 (1) The extended trailer registration shall be based on
26 a recurring 5-year registration period. The trailer owner

1 may apply for an extended registration for the number of
2 years remaining in the current 5-year cycle at the time of
3 the registration application.
4 (2) An applicant for an extended trailer registration
5 shall apply online or by completing and mailing the
6 appropriate extended trailer registration application form
7 to the address indicated on the form.
8 (3) The owner of a trailer with an extended
9 registration may transfer that registration to another
10 trailer of the same weight class. The owner of a trailer
11 with an extended registration who discontinues use of the
12 registration before the registration period expires is not
13 entitled to a complete or prorated refund of the
14 registration fee.
15 (4) The fee for an extended registration shall be the
16 same as the applicable annual registration fee for the
17 trailer being registered, multiplied by the number of years
18 or partial years remaining in the current 5-year cycle at
19 the time of the registration application.
20 (c) The Secretary of State may adopt rules to implement
21this Section.

23 Sec. 8-102. Alternate methods of giving proof.
24 (a) Except as provided in subsection (b), proof Proof of
25financial responsibility, when required under Section 8-101 or

18-101.1, may be given by filing with the Secretary of State one
2of the following:
3 1. A bond as provided in Section 8-103;
4 2. An insurance policy or other proof of insurance in a
5 form to be prescribed by the Secretary as provided in
6 Section 8-108;
7 3. A certificate of self-insurance issued by the
8 Director;
9 4. A certificate of self-insurance issued to the
10 Regional Transportation Authority by the Director naming
11 municipal or non-municipal public carriers included
12 therein;
13 5. A certificate of coverage issued by an
14 intergovernmental risk management association evidencing
15 coverages which meet or exceed the amounts required under
16 this Code.
17 (b) Beginning January 1, 2020, in lieu of filing the
18documents required by subsection (a), each owner of a vehicle
19required to obtain minimum liability insurance under Section
208-101 or 8-101.1 shall attest that the vehicle is insured in at
21least the minimum required amount.
22 (1) The Secretary shall create a form on which the
23 vehicle owner shall attest that the vehicle is insured in
24 at least the minimum required amount. The attestation form
25 shall be submitted with each registration application.
26 (2) The attestation form shall be valid for the full

1 registration period; however, if at any time the Secretary
2 has reason to believe that the owner does not have the
3 minimum required amount of insurance for a vehicle, the
4 Secretary may require the owner to file with the Secretary
5 documentation as set forth in subsection (a) of this
6 Section.
7 (3) If the owner fails to provide the required
8 documentation within 7 calendar days after the request is
9 made, the Secretary may suspend the vehicle registration.
10 The registration shall remain suspended until such time as
11 the required documentation is provided to and reviewed by
12 the Secretary.
13 (4) The owner of a vehicle that is self-insured shall
14 attest that the funds available to pay liability claims
15 related to the operation of the vehicle are equivalent to
16 or greater than the minimum liability insurance
17 requirements under Section 8-101 or 8-101.1.
18 (c) The Secretary of State may adopt rules to implement
19this Section.

21 Section 99. Effective date. This Act takes effect January
