1 | AMENDMENT TO HOUSE BILL 3335

2 | AMENDMENT NO. ______. Amend House Bill 3335 by replacing | ||||||
3 | everything after the enacting clause with the following:
| ||||||
4 | "Section 5. The Unified Code of Corrections is amended by | ||||||
5 | adding Section 3-14-4.6 as follows:
| ||||||
6 | (730 ILCS 5/3-14-4.6 new) | ||||||
7 | Sec. 3-14-4.6. Rental stipends for persons released from | ||||||
8 | Department correctional institutions and facilities. | ||||||
9 | (a) The Department of Corrections may provide temporary | ||||||
10 | housing assistance for a person being released from a | ||||||
11 | correctional institution or facility of the Department of | ||||||
12 | Corrections through the use of rental stipends, for a period | ||||||
13 | not to exceed 12 months, if the Department finds that such | ||||||
14 | assistance will support the person's release into the | ||||||
15 | community by preventing housing instability or homelessness or
| ||||||
16 | if a person is unable to find housing as a condition of the |

1 | person's
release from a correctional facility. A person may | ||||||
2 | not receive a combined total of rental stipends in excess of 12 | ||||||
3 | months for each release from a correctional institution or | ||||||
4 | facility of the Department of Corrections. | ||||||
5 | (b) The Department of Corrections shall establish policies | ||||||
6 | for prioritizing funds available for rental stipends under | ||||||
7 | this Section for persons at risk of becoming homeless or | ||||||
8 | becoming homeless without assistance while taking into account | ||||||
9 | risk to reoffend. If housing is outlined as part of a person's | ||||||
10 | release
agreement, the Department of Corrections must use the | ||||||
11 | rental stipend
to find the person safe housing. | ||||||
12 | (c) Stipends must be provided in conjunction with | ||||||
13 | additional transition
support programming or services that | ||||||
14 | enable an offender to participate in
services including, but | ||||||
15 | not limited to, substance abuse treatment, mental
health | ||||||
16 | treatment, sex offender treatment, educational programming,
| ||||||
17 | technology competency, employment programming, or a | ||||||
18 | combination of those programs or services. | ||||||
19 | (d) The Department shall maintain a list of housing | ||||||
20 | providers that meets the
requirements of this Section. | ||||||
21 | However, the final determination in use of the stipend is to
be | ||||||
22 | determined by the individual not the landlord or the | ||||||
23 | Department of
Corrections. | ||||||
24 | The Department of Corrections must gather data in order to | ||||||
25 | best demonstrate
whether rental stipends are effective in | ||||||
26 | reducing recidivism. |

1 | Subject to the availability of amounts appropriated for | ||||||
2 | this specific
purpose, the Illinois Housing Development | ||||||
3 | Authority shall conduct an outcome
evaluation and benefit-cost | ||||||
4 | analysis of the rental stipend. The analysis
shall take into | ||||||
5 | account impacts on homelessness, recidivism, criminal
justice | ||||||
6 | costs, use of public services, and other factors determined to | ||||||
7 | be
appropriate by the Illinois Housing Development Authority. | ||||||
8 | The Department of Corrections shall cooperate with the
| ||||||
9 | organizations tracking this progress including but not limited | ||||||
10 | to, Saint
Leonard's Ministries and the Illinois Department of | ||||||
11 | Housing to facilitate
access to data or other resources | ||||||
12 | necessary to complete the analysis
required under this | ||||||
13 | Section. A final report to the Governor and appropriate
| ||||||
14 | committees of the General Assembly shall be submitted on or | ||||||
15 | before December 1, 2025. ".
