AMENDMENT TO HOUSE BILL 2924
AMENDMENT NO. ______. Amend House Bill 2924 on page 1, line
10, by replacing "under the authority of" with "receiving
funding from"; and
on page 3, immediately below line 26, by inserting the
following:
"Section 10. The Department of Commerce and Economic
Opportunity Law of the Civil Administrative Code of Illinois is
amended by adding Section 605-1030 as follows:
(20 ILCS 605/605-1030 new)
Sec. 605-1030. Office of Minority Economic Empowerment.
(a) The Office of Minority Economic Empowerment (the
Office) is hereby created within the Department. The Office
shall assist minority-owned businesses, women-owned
businesses, veteran-owned businesses, and businesses owned by

persons with disabilities through targeted programs,
resources, and outreach and promotional activities. The Office
shall engage in or conduct the following activities:
(1) promoting and conducting outreach efforts with
respect of the making of small business loans pursuant to
Section 9-4.3 of the Build Illinois Act, and assisting
minority-owned businesses, women-owned businesses,
veteran-owned businesses, and businesses owned by persons
with disabilities in applying for and receiving loan funds
under that Act;
(2) providing and hosting workshops and public forums
and engaging in outreach efforts for minority-owned
businesses, women-owned businesses, veteran-owned
businesses, and businesses owned by persons with
disabilities to encourage participation in programs under
the Business Enterprise for Minorities, Women, and Persons
with Disabilities Act, and assisting those enterprises in
becoming designated under that Act;
(3) providing and hosting workshops and public forums
and engaging in outreach efforts that assist and educate
minority-owned businesses, women-owned businesses,
veteran-owned businesses, and businesses owned by persons
with disabilities on the process of applying for and
becoming certified to apply for State grant funds under the
Grant Accountability and Transparency Act;
(4) providing and hosting workshops and public forums

and engaging in outreach efforts that assist and educate
aspiring and existing minority-owned businesses,
women-owned businesses, veteran-owned businesses, and
businesses owned by persons with disabilities with
understanding concepts such as, but not limited to,
business formation, business planning, capital access, and
marketing a business;
(5) administering programs established by the
Department or the General Assembly to provide grants to
minority-owned business, woman-owned businesses,
veteran-owned businesses, and businesses owned by persons
with disabilities;
(6) coordinating assistance for businesses with other
State agencies;
(7) providing staff, administration, and related
support required to administer this Section; and
(8) establishing applications, notifications,
contracts, and other forms and procedures, and adopting
rules deemed necessary and appropriate.
The Office may use vendors or contract work to carry out
the purposes of this Act.
(b) In order to facilitate and encourage the growth of
supplier diversity, the Office may have at least one employee
who serves as a supplier diversity program manager to: (i)
collect reports and information concerning entities that
manage supplier diversity programs; and (ii) conduct public

workshops focused on specific industries to collaboratively
connect diverse enterprises with entities that manage supplier
diversity programs. The workshops shall be modeled after
Illinois Commerce Commission hearings for utilities and
railroads and shall include a collaborative discussion of filed
supplier diversity reports. The program manager shall hold
public workshops for relevant industries including, but not
limited to, gaming, hospitals, public and private higher
education, Economic Development for a Growing Economy tax
credits, museums, and professional sports teams. In addition,
the Department shall compile and publish on its website a
master database for all points of contract for supplier
diversity programs, including certifications accepted and
links to the most recent supplier diversity reports submitted
under:
(1) Section 405-530 of the Department of Central
Management Services Law of the Civil Administrative Code of
Illinois;
(2) Section 5.3 of the Illinois Health Facilities
Planning Act;
(3) Section 8k of the Business Enterprise for
Minorities, Women, and Persons with Disabilities Act;
(4) Section 5-57 of the Economic Development for a
Growing Economy Tax Credit Act;
(5) Section 5-117 of the Public Utilities Act;
(6) Section 12.2 of the Illinois Horse Racing Act of

1975; or
(7) Section 10 of the Railroad Supplier Diversity Act.
(c) For the purposes of this Section:
"Minority-owned business", "women-owned business", and
"business owned by a person with a disability" have the
meanings provided under the Business Enterprise for
Minorities, Women, and Persons with Disabilities Act.
"Veteran-owned business" means a business which is at least
51% owned by one or more veterans, or, in the case of a
corporation, at least 51% of the stock in which is owned by one
or more veterans, and the management and daily business
operations of which are controlled by one or more of the
veterans who own it.
Section 15. The Economic Development for a Growing Economy
Tax Credit Act is amended by changing Section 5-57 as follows:

Sec. 5-57. Diversity policy Supplier diversity goals;
reports.
(a) Each taxpayer claiming a credit under this Act shall,
no later than April 15 of each taxable year for which the
taxpayer claims a credit under this Act, submit to the
Department of Commerce and Economic Opportunity an annual
report containing the information described in subsections
(b), (c), (d), and (e) of Section 5-117 of the Public Utilities

Act. Those reports shall be submitted in the form and manner
required by the Department of Commerce and Economic
Opportunity.
(b) Any taxpayer seeking to claim a credit under this Act
that fails to timely submit the required report shall not
receive a credit for that taxable year unless and until such
report is finalized and submitted to the Department. This
subsection shall apply only to actual spending, per vendor on
an annualized basis, that exceeds $10,000 or 10% of the
taxpayer's vendor spending, whichever is less.
(c) Each taxpayer claiming a credit under this Act shall,
no later than April 15 of each taxable year for which the
taxpayer claims a credit under this Act, submit to the
Department an annual report detailing the diversity of the
taxpayer's own workforce, including full-time and part-time
employees, contractors, and board members. The report shall be
submitted in the form and manner required by the Department.
Any taxpayer seeking to claim a credit under this Act that
fails to timely submit the required report shall not receive a
credit for that taxable year unless and until such report is
finalized and submitted to the Department.
