| 5 | on page 3, immediately below line 26, by inserting the | ||||||
| 6 | following:

| 7 | "Section 10. The Department of Commerce and Economic | ||||||
| 8 | Opportunity Law of the
Civil Administrative Code of Illinois is | ||||||
| 9 | amended by adding Section 605-1030 as follows:
| ||||||
| 10 | (20 ILCS 605/605-1030 new) | ||||||
| 11 | Sec. 605-1030. Office of Minority Economic Empowerment. | ||||||
| 12 | (a) The Office of Minority Economic Empowerment (the | ||||||
| 13 | Office) is hereby created within the Department. The Office | ||||||
| 14 | shall assist minority-owned businesses, women-owned | ||||||
| 15 | businesses, veteran-owned businesses, and businesses owned by | ||||||
| |||||||
| |||||||
| 1 | persons with disabilities through targeted programs, | ||||||
| 2 | resources, and outreach and promotional activities. The Office | ||||||
| 3 | shall engage in or conduct the following activities: | ||||||
| 4 | (1) promoting and conducting outreach efforts with | ||||||
| 5 | respect of the making of small business loans pursuant to | ||||||
| 6 | Section 9-4.3 of the Build Illinois Act, and assisting | ||||||
| 7 | minority-owned businesses, women-owned businesses, | ||||||
| 8 | veteran-owned businesses, and businesses owned by persons | ||||||
| 9 | with disabilities in applying for and receiving loan funds | ||||||
| 10 | under that Act; | ||||||
| 11 | (2) providing and hosting workshops and public forums | ||||||
| 12 | and engaging in outreach efforts for minority-owned | ||||||
| 13 | businesses, women-owned businesses, veteran-owned | ||||||
| 14 | businesses, and businesses owned by persons with | ||||||
| 15 | disabilities to encourage participation in programs under | ||||||
| 16 | the Business Enterprise for Minorities, Women, and Persons | ||||||
| 17 | with Disabilities Act, and assisting those enterprises in | ||||||
| 18 | becoming designated under that Act; | ||||||
| 19 | (3) providing and hosting workshops and public forums | ||||||
| 20 | and engaging in outreach efforts that assist and educate | ||||||
| 21 | minority-owned businesses, women-owned businesses, | ||||||
| 22 | veteran-owned businesses, and businesses owned by persons | ||||||
| 23 | with disabilities on the process of applying for and | ||||||
| 24 | becoming certified to apply for State grant funds under the | ||||||
| 25 | Grant Accountability and Transparency Act; | ||||||
| 26 | (4) providing and hosting workshops and public forums | ||||||
| |||||||
| |||||||
| 1 | and engaging in outreach efforts that assist and educate | ||||||
| 2 | aspiring and existing minority-owned businesses, | ||||||
| 3 | women-owned businesses, veteran-owned businesses, and | ||||||
| 4 | businesses owned by persons with disabilities with | ||||||
| 5 | understanding concepts such as, but not limited to, | ||||||
| 6 | business formation, business planning, capital access, and | ||||||
| 7 | marketing a business; | ||||||
| 8 | (5) administering programs established by the | ||||||
| 9 | Department or the General Assembly to provide grants to | ||||||
| 10 | minority-owned business, woman-owned businesses, | ||||||
| 11 | veteran-owned businesses, and businesses owned by persons | ||||||
| 12 | with disabilities; | ||||||
| 13 | (6) coordinating assistance for businesses with other | ||||||
| 14 | State agencies; | ||||||
| 15 | (7) providing staff, administration, and related | ||||||
| 16 | support required to administer this Section; and | ||||||
| 17 | (8) establishing applications, notifications, | ||||||
| 18 | contracts, and other forms and procedures, and adopting | ||||||
| 19 | rules deemed necessary and appropriate. | ||||||
| 20 | The Office may use vendors or contract work to carry out | ||||||
| 21 | the purposes of this Act. | ||||||
| 22 | (b) In order to facilitate and encourage the growth of | ||||||
| 23 | supplier diversity, the Office may have at least one employee | ||||||
| 24 | who serves as a supplier diversity program manager to: (i) | ||||||
| 25 | collect reports and information concerning entities that | ||||||
| 26 | manage supplier diversity programs; and (ii) conduct public | ||||||
| |||||||
| |||||||
| 1 | workshops focused on specific industries to collaboratively | ||||||
| 2 | connect diverse enterprises with entities that manage supplier | ||||||
| 3 | diversity programs. The workshops shall be modeled after | ||||||
| 4 | Illinois Commerce Commission hearings for utilities and | ||||||
| 5 | railroads and shall include a collaborative discussion of filed | ||||||
| 6 | supplier diversity reports. The program manager shall hold | ||||||
| 7 | public workshops for relevant industries including, but not | ||||||
| 8 | limited to, gaming, hospitals, public and private higher | ||||||
| 9 | education, Economic Development for a Growing Economy tax | ||||||
| 10 | credits, museums, and professional sports teams. In addition, | ||||||
| 11 | the Department shall compile and publish on its website a | ||||||
| 12 | master database for all points of contract for supplier | ||||||
| 13 | diversity programs, including certifications accepted and | ||||||
| 14 | links to the most recent supplier diversity reports submitted | ||||||
| 15 | under: | ||||||
| 16 | (1) Section 405-530 of the Department of Central | ||||||
| 17 | Management Services Law of the Civil Administrative Code of | ||||||
| 18 | Illinois; | ||||||
| 19 | (2) Section 5.3 of the Illinois Health Facilities | ||||||
| 20 | Planning Act; | ||||||
| 21 | (3) Section 8k of the Business Enterprise for | ||||||
| 22 | Minorities, Women, and Persons with Disabilities Act; | ||||||
| 23 | (4) Section 5-57 of the Economic Development for a | ||||||
| 24 | Growing Economy Tax Credit Act; | ||||||
| 25 | (5) Section 5-117 of the Public Utilities Act; | ||||||
| 26 | (6) Section 12.2 of the Illinois Horse Racing Act of | ||||||
| |||||||
| |||||||
| 1 | 1975; or | ||||||
| 2 | (7) Section 10 of the Railroad Supplier Diversity Act. | ||||||
| 3 | (c) For the purposes of this Section: | ||||||
| 4 | "Minority-owned business", "women-owned business", and | ||||||
| 5 | "business owned by a person with a disability" have the | ||||||
| 6 | meanings provided under the Business Enterprise for | ||||||
| 7 | Minorities, Women, and Persons with Disabilities Act. | ||||||
| 8 | "Veteran-owned business" means a business which is at least | ||||||
| 9 | 51% owned by one or more veterans, or, in the case of a | ||||||
| 10 | corporation, at least 51% of the stock in which is owned by one | ||||||
| 11 | or more veterans, and the management and daily business | ||||||
| 12 | operations of which are controlled by one or more of the | ||||||
| 13 | veterans who own it.

| 14 | Section 15. The Economic Development for a Growing Economy | ||||||
| 15 | Tax Credit Act is amended by changing Section 5-57 as follows:
| ||||||
| 16 | (35 ILCS 10/5-57) | ||||||
| 17 | Sec. 5-57. Diversity policy Supplier diversity goals; | ||||||
| 18 | reports. | ||||||
| 19 | (a) Each taxpayer claiming a credit under this Act shall, | ||||||
| 20 | no later than April 15 of each taxable year for which the | ||||||
| 21 | taxpayer claims a credit under this Act, submit to the | ||||||
| 22 | Department of Commerce and Economic Opportunity an annual | ||||||
| 23 | report containing the information described in subsections | ||||||
| 24 | (b), (c), (d), and (e) of Section 5-117 of the Public Utilities | ||||||
| |||||||
| |||||||
| 1 | Act. Those reports shall be submitted in the form and manner | ||||||
| 2 | required by the Department of Commerce and Economic | ||||||
| 3 | Opportunity. | ||||||
| 4 | (b) Any taxpayer seeking to claim a credit under this Act | ||||||
| 5 | that fails to timely submit the required report shall not | ||||||
| 6 | receive a credit for that taxable year unless and until such | ||||||
| 7 | report is finalized and submitted to the Department. This | ||||||
| 8 | subsection shall apply only to actual spending, per vendor on | ||||||
| 9 | an annualized basis, that exceeds $10,000 or 10% of the | ||||||
| 10 | taxpayer's vendor spending, whichever is less.
| ||||||
| 11 | (c) Each taxpayer claiming a credit under this Act shall, | ||||||
| 12 | no later than April 15 of each taxable year for which the | ||||||
| 13 | taxpayer claims a credit under this Act, submit to the | ||||||
| 14 | Department an annual report detailing the diversity of the | ||||||
| 15 | taxpayer's own workforce, including full-time and part-time | ||||||
| 16 | employees, contractors, and board members. The report shall be | ||||||
| 17 | submitted in the form and manner required by the Department. | ||||||
| 18 | Any taxpayer seeking to claim a credit under this Act that | ||||||
| 19 | fails to timely submit the required report shall not receive a | ||||||
| 20 | credit for that taxable year unless and until such report is | ||||||
| 21 | finalized and submitted to the Department. | ||||||
