AMENDMENT TO HOUSE BILL 1438
AMENDMENT NO. ______. Amend House Bill 1438 by replacing
everything after the enacting clause with the following:
"Section 5. The Life Care Facilities Act is amended by
adding Section 13 as follows:
(210 ILCS 40/13 new)
Sec. 13. Continuing Care Retirement Community Transparency
Task Force.
(a) There is created a Continuing Care Retirement Community
Transparency Task Force consisting of the following members:
(1) The Director of Aging, or the Director's designee.
(2) The Director of Public Health, or the Director's
designee.
(3) One member of the House of Representatives
appointed by the Speaker of the House of Representatives.
(4) One member of the House of Representatives

appointed by the Minority Leader of the House of
Representatives.
(5) One member of the Senate appointed by the President
of the Senate.
(6) One member of the Senate appointed by the Minority
Leader of the Senate.
(7) One member from each of the following organizations
appointed by the Director of Public Health:
(A) 2 representatives selected from
recommendations of a statewide organization
representing retired people;
(B) 2 representatives selected from
recommendations of a statewide organization
representing Alzheimer's research;
(C) 2 representatives selected from
recommendations of a statewide organization
representing Illinois nursing home communities;
(D) One representative selected from
recommendations of a senior living facility housing 50
residents or more; and
(E) One representative selected from
recommendations of a senior living facility housing
fewer than 50 residents.
(b) The Task Force is created to research and collect
information on transparency and consumer protection issues
related to life care contracts. The Task Force shall review

existing legal frameworks to identify all existing consumer
protections for residents living in continuing care retirement
communities and all areas in which more consumer protections
for continuing care retirement community residents are
necessary. The Task Force shall identify any shortcomings of
the definition of "life care contract" in Section 2 and
determine whether that definition should be expanded to include
more senior living facilities.
(c) The members appointed to the Task Force pursuant to
subsection (a) shall be appointed no later than 30 days after
the effective date of this amendatory Act of the 101st General
Assembly.
(d) The first meeting of the Task Force shall be no later
than 30 days after all members of the Task Force have been
appointed. The members of the Task Force shall receive no
compensation for their services but may be reimbursed for
expenses from appropriations made for that purpose.
(e) The Department of Public Health shall provide
administrative and other support to the Task Force.
(f) The Task Force shall report its findings to the
Governor and General Assembly by December 31, 2019.
(G) This Section is repealed on January 1, 2020.
Section 99. Effective date. This Act takes effect upon
becoming law.".
