1 | AMENDMENT TO HOUSE BILL 1047
| ||||||
2 | AMENDMENT NO. ______. Amend House Bill 1047 by replacing | ||||||
3 | everything after the enacting clause with the following:
| ||||||
4 | "Section 5. The Wildlife Code is amended by changing | ||||||
5 | Sections 1.13, 2.6, 2.7, and 2.13 as follows:
| ||||||
6 | (520 ILCS 5/1.13) (from Ch. 61, par. 1.13)
| ||||||
7 | Sec. 1.13. The Department is authorized to issue a "Public | ||||||
8 | Hunting Grounds
for Waterfowl" daily usage stamp at a fee not | ||||||
9 | to exceed $10
for duck hunting areas, and not to exceed $15 for | ||||||
10 | Canada goose
hunting areas; and assess a daily "Public Hunting | ||||||
11 | Grounds for Game Birds Pheasants " fee not to exceed $25 ($35 | ||||||
12 | for non-residents) in 2008 and increasing by $5 every third | ||||||
13 | year until the maximum fee is $50 ($60 for non-residents).
Each | ||||||
14 | person shall obtain such a stamp from the Department to be | ||||||
15 | attached
to the permit
assigned to a person, or pay the daily | ||||||
16 | fee to hunt game birds pheasants , under the provisions of the |

1 | rules and regulations made
by the Department for the operation | ||||||
2 | of State Public Hunting Grounds. Rulemaking authority to | ||||||
3 | implement this amendatory Act of the 95th General Assembly, if | ||||||
4 | any, is conditioned on the rules being adopted in accordance | ||||||
5 | with all provisions of the Illinois Administrative Procedure | ||||||
6 | Act and all rules and procedures of the Joint Committee on | ||||||
7 | Administrative Rules; any purported rule not so adopted, for | ||||||
8 | whatever reason, is unauthorized.
| ||||||
9 | The Department is authorized to permit hunters to harvest | ||||||
10 | both male and
female hand reared pheasants , bobwhite quail, | ||||||
11 | chukar partridge, and gray partridge released on such public | ||||||
12 | hunting grounds. The Department is further authorized to permit | ||||||
13 | hunters to harvest hand-reared game birds on State Public | ||||||
14 | Hunting Grounds during a season set by administrative rule | ||||||
15 | between the dates of September 1 and March 31, both inclusive.

16 | The Department shall cause an administrative rule, setting
| ||||||
17 | forth the rules
and regulations for the operation of Public | ||||||
18 | Hunting Areas on lands and waters
owned or leased by this | ||||||
19 | State.

2 | Section
1.13 . Dogs may be used in hunting with either shotgun | ||||||
3 | or bow and arrow.

4 | It shall be unlawful to take or possess more than the daily | ||||||
5 | limit and
possession limit of cock pheasants. The daily and | ||||||
6 | possession limits for
cock pheasants shall be set annually by | ||||||
7 | the Director of the Department and
shall not exceed a daily | ||||||
8 | limit of 3 and a possession limit of 6, except as
provided by | ||||||
9 | Sections 1.13, 3.27 and 3.28 of this Act.

10 | It is unlawful to remove plumage of pheasants in the field | ||||||
11 | or while being
transported from the field to one's home or to a | ||||||
12 | commercial preservation
facility.
| ||||||
13 | It shall be unlawful to take or possess hen pheasants at | ||||||
14 | any time,
except as provided in Section 2.4, 3.23 or 3.27.
| ||||||
15 | The provisions of this Section are subject to modification | ||||||
16 | by
administrative rule.

It shall be unlawful for any person to take quail | ||||||

31st, both inclusive , except as | ||||||
23 | provided in Section
1.13 . Dogs may be used in hunting with | ||||||

15 | set annually by the Director of
the Department which cannot | ||||||
16 | exceed a daily take limit of 6 and a possession
limit of 12. | ||||||
17 | Dogs may be used in hunting with either gun or bow and arrow.
