| 1 | AMENDMENT TO HOUSE BILL 971
| ||||||
| 2 | AMENDMENT NO. ______. Amend House Bill 971 by replacing | ||||||
| 3 | everything after the enacting clause with the following:

| 4 | "Section 5. The Illinois Public Aid Code is amended by | ||||||
| 5 | changing Section 8A-18 as follows:
| ||||||
| 6 | (305 ILCS 5/8A-18) | ||||||
| 7 | Sec. 8A-18. Application assistance fraud; SNAP; AABD; | ||||||
| 8 | TANF. It is a Class C misdemeanor for any person, including an | ||||||
| 9 | individual, firm, corporation, association, partnership, or | ||||||
| 10 | joint venture, or any employee or agent of any of those, to | ||||||
| 11 | assist or represent another person in completing or submitting | ||||||
| 12 | an application for benefits under the federal Supplemental | ||||||
| 13 | Nutrition Assistance Program (SNAP), the State's Aid to the | ||||||
| 14 | Aged, Blind, or Disabled (AABD) program, or the State's | ||||||
| 15 | Temporary Assistance for Needy Families (TANF) program, in | ||||||
| 16 | exchange for a portion of the applicant's SNAP, AABD, or TANF | ||||||
| |||||||
| |||||||
| 1 | benefits or cash or any other form of payment from any other | ||||||
| 2 | source. An applicant who receives such assistance or | ||||||
| 3 | representation is not in violation of this Section. | ||||||
| 4 | Nothing in this Section shall be construed as prohibiting | ||||||
| 5 | an applicant from using the services of a non-profit | ||||||
| 6 | organization, a licensed attorney, or any other authorized | ||||||
| 7 | organization or agency that receives State or federal funding | ||||||
| 8 | to assist persons in the preparation of an application for | ||||||
| 9 | SNAP, AABD, or TANF benefits or in appealing a denial of an | ||||||
| 10 | application for SNAP, AABD, or TANF benefits. Nothing in this | ||||||
| 11 | Section shall be construed as prohibiting an applicant from | ||||||
| 12 | receiving such assistance or representation when appealing a | ||||||
| 13 | denial of an application for SNAP, AABD, or TANF benefits.
