AMENDMENT TO HOUSE BILL 616
AMENDMENT NO. ______. Amend House Bill 616 by replacing
everything after the enacting clause with the following:
"Section 5. The Developmental Disability and Mental
Disability Services Act is amended by adding Section 8-5 and
by adding Article VIII as follows:

ARTICLE VIII. ADULT LIVING ARRANGEMENTS
FOR YOUTH IN TRANSITION
(405 ILCS 80/8-5 new)
Sec. 8-5. Transitioning youth; extended services and adult
living arrangements.
(a) Notwithstanding any other provision of law to the
contrary, the Department of Human Services' Division of
Developmental Disabilities and the Department of Children and

Family Services shall adopt rules that permit a licensed child
care institution (CCI) or children's group home (CGH) that
provides residential developmental disability services to
youth under the age of 22 to allow a youth to continue to
remain in his or her CGH or CCI placement if an independent
service coordination agency has not secured an adult placement
for the youth by the youth's 22nd birthday. Such extended
residential developmental disability services shall be
reimbursed at the same rate as residential developmental
disability services provided to youth under the age of 22. A
licensed CCI or CGH that provides extended residential
developmental disability services as authorized under this
subsection shall not be issued any notice of violation or
citation for providing such services.
(b) The Department of Human Services shall establish a
separate service line to transition youth receiving services
in a licensed children's residential setting to an adult
living arrangement that (i) is outside the Home and
Community-Based Services waiver, (ii) is not a
community-integrated living arrangement or a State-operated
developmental center, and (iii) provides the same level of
support the youth received at his or her previous children's
residential setting placement.
(c) All State agencies that fund children's residential
services must begin transition planning for adult residential
placement on or before a youth's 20th birthday.

(d) Nothing in this Section shall be construed to reduce
the level or type of services and supports provided to a youth
beyond his or her 22nd birthday.".
