Section
1.
Section
135B.5,
subsection
1,
Code
2018,
is
1
amended
to
read
as
follows:

1.
Upon
receipt
of
an
application
for
license
and
the
3
license
fee,
the
department
shall
issue
a
license
if
the
4
applicant
and
hospital
facilities
comply
with
this
chapter
5
and
the
rules
of
the
department.
Each
licensee
shall
receive
6
annual
reapproval
upon
payment
of
five
hundred
dollars
and
7
upon
filing
of
an
application
form
which
is
available
from
the
8
department.
The
annual
licensure
fee
shall
be
dedicated
to
9
support
and
provide
educational
programs
on
regulatory
issues
10
for
hospitals
licensed
under
this
chapter
in
consultation
11
with
the
hospital
licensing
board.
Licenses
shall
be
either
12
general
or
restricted
in
form.
Each
license
shall
be
issued
13
only
for
the
premises
and
persons
or
governmental
units
named
14
in
the
application
and
is
not
transferable
or
assignable
except
15
with
the
written
approval
of
the
department.
The
department
16
shall
only
approve
the
transfer
or
assignment
of
a
license
of
17
a
hospital
that
offers
only
behavioral
health
services
to
a
18
person
or
governmental
unit
for
the
sole
purpose
of
offering
19
behavioral
health
services.
Licenses
shall
be
posted
in
a
20
conspicuous
place
on
the
licensed
premises
as
prescribed
by
21
rule
of
the
department.

The
inclusion

this
explanation
does
not
constitute
agreement
with

the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
allows
the
department
of
inspections
and
appeals
26
to
approve
the
transfer
or
assignment
of
a
license
of
a
27
hospital
that
offers
only
behavioral
health
services
to
a
28
person
or
governmental
unit
for
the
sole
purpose
of
offering
29
behavioral
health
services.
