As
used
in
this
section:

a.
“Person”
means
the
same
as
in
section
4.1.
4
b.
“Remotely
operated
aerial
vehicle”
means
an
aircraft
5
that
is
operated
without
the
possibility
of
direct
human
6
intervention
from
within
or
on
the
aircraft.
7
2.
a.
Except
as
provided
in
paragraphs
“b”
and
“c”
,
8
a
person
shall
not
use
a
remotely
operated
aerial
vehicle
9
anywhere
in
this
state
unless
the
person
obtains
a
permit
to
10
use
the
remotely
operated
aerial
vehicle
from
the
department
11
of
public
safety.
Such
a
permit
shall
only
be
valid
for
an
12
unarmed
remotely
operated
aerial
vehicle
that
is
capable
13
of
streaming
or
recording
images
of
or
detecting
sound
14
from
the
single-family
residence
of
the
permittee
or
other
15
nonresidential
property
owned
or
controlled
by
the
permittee.

A
person
may
use
an
unarmed
remotely
operated
aerial
17
vehicle
without
a
permit
if
the
remotely
operated
aerial
18
vehicle
does
not
have
the
capability
of
streaming
or
recording
19
images
or
detecting
sound,
and
the
person
operates
the
remotely
20
operated
aerial
vehicle
over
the
single-family
residence
of
the
21
person
or
other
nonresidential
property
owned
or
controlled
by
22
the
person.

c.
A
law
enforcement
agency
may
use
an
unarmed
remotely
24
operated
aerial
vehicle
without
obtaining
a
permit
if
25
authorized
by
a
search
warrant.

3.
A
person
who
violates
this
section
shall
be
assessed
27
a
civil
penalty
in
the
amount
of
one
hundred
dollars
for
a
28
first
violation
and
two
hundred
fifty
dollars
for
a
second
or
29
subsequent
violation.

4.
The
department
of
public
safety
shall
adopt
rules
31
pursuant
to
chapter
17A
to
administer
this
section.

This
bill
regulates
the
use
of
remotely
operated
aerial

vehicles.

The
bill
defines
“remotely
operated
aerial
vehicle”
to
mean

an
aircraft
that
is
operated
without
the
possibility
of
direct

human

within
or
on
the
aircraft.

Under
the
bill,
a
person
shall
not
use
a
remotely
operated

aerial
vehicle
anywhere
in
this
state
unless
the
person
obtains

permit

the

from
the

department
of
public
safety.
Such
a
permit
shall

be

bill

law
enforcement
agency
to
use
an

remotely
operated
aerial
vehicle
without
a
permit
under

the
authority
of
a

warrant.

A
person
who
violates
the
bill
shall
be
assessed
a
civil
24
penalty
in
the
amount
of
$100
for
a
first
violation
and
$250
25
for
a
second
or
subsequent
violation.

The
department
of
public
safety
is
required
to
adopt
rules
27
to
administer
the
bill.
