There is appropriated from the general fund of the state 4 to the department of justice for the fiscal year beginning July 5 1, 2021, and ending June 30, 2022, the following amounts, or 6 so much thereof as is necessary, to be used for the purposes 7 designated: 8 a. For the general office of attorney general for 9 salaries, support, maintenance, and miscellaneous purposes, 10 including the prosecuting attorneys training program, matching 11 funds for federal violence against women grant programs, 12 victim assistance grants, the office of drug control policy 13 prosecuting attorney program, and odometer fraud enforcement: 14 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 6,006,268 15 As a condition of receiving the appropriation provided 16 in this lettered paragraph, the department of justice shall 17 maintain a record of the estimated time incurred representing 18 each agency or department. 19 The general office of attorney general may temporarily 20 exceed and draw more than the amount appropriated in this 21 lettered paragraph and incur a negative cash balance as long 22 as there are receivables equal to or greater than the negative 23 balances and the amount appropriated in this lettered paragraph 24 is not exceeded at the close of the fiscal year. 25 b. For victim assistance grants: 26 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 5,016,708 27 The moneys appropriated in this lettered paragraph shall be 28 used to provide grants to care providers providing services to 29 crime victims of domestic abuse or to crime victims of rape and 30 sexual assault. 31 The balance of the victim compensation fund established 32 in section 915.94 may be used to provide salary and support 33 of not more than 24.00 full-time equivalent positions and to 34 provide maintenance for the victim compensation functions 35 -1- LSB 1014XG (13) 89 as/tm 1/ 39

In addition to the full-time 1 equivalent positions authorized pursuant to this paragraph, 2 5.00 full-time equivalent positions are authorized and shall 3 be used by the department of justice to employ one accountant 4 and four program planners. The department of justice may 5 employ the additional 5.00 full-time equivalent positions 6 authorized pursuant to this paragraph that are in excess of the 7 number of full-time equivalent positions authorized only if 8 the department of justice receives sufficient federal moneys 9 to maintain employment for the additional full-time equivalent 10 positions during the current fiscal year. The department 11 of justice shall only employ the additional 5.00 full-time 12 equivalent positions in succeeding fiscal years if sufficient 13 federal moneys are received during each succeeding fiscal year. 14 The department of justice shall transfer at least $150,000 15 from the victim compensation fund established in section 915.94 16 to the victim assistance grant program established in section 17 13.31. 18 Notwithstanding section 8.33, moneys appropriated in this 19 lettered paragraph that remain unencumbered or unobligated at 20 the close of the fiscal year shall not revert but shall remain 21 available for expenditure for the purposes designated until the 22 close of the succeeding fiscal year. 23 c. The department of justice, in submitting budget 27 estimates for the fiscal year beginning July 1, 2022, pursuant 28 to section 8.23, shall include a report of funding from sources 29 other than amounts appropriated directly from the general fund 30 of the state to the department of justice or to the office of 31 consumer advocate. These funding sources shall include but 32 are not limited to reimbursements from other state agencies, 33 commissions, boards, or similar entities, and reimbursements 34 from special funds or internal accounts within the department 35 -2- LSB 1014XG (13) 89 as/tm 2/ 39

The department of justice shall also report actual 1 reimbursements for the fiscal year beginning July 1, 2020, 2 and actual and expected reimbursements for the fiscal year 3 beginning July 1, 2021. 4 b. The department of justice shall include the report 5 required under paragraph “a”, as well as information regarding 6 any revisions occurring as a result of reimbursements actually 7 received or expected at a later date, in a report to the 8 co-chairpersons and ranking members of the joint appropriations 9 subcommittee on the justice system and the legislative services 10 agency. The department of justice shall submit the report on 11 or before January 15, 2022. 12 3. a. The department of justice shall fully reimburse 13 the costs and necessary related expenses incurred by the Iowa 14 law enforcement academy to continue to employ one additional 15 instructor position who shall provide training for human 16 trafficking-related issues throughout the state. 17 b. The department of justice shall obtain the moneys 18 necessary to reimburse the Iowa law enforcement academy to 19 employ such an instructor from unrestricted moneys from either 20 the victim compensation fund established in section 915.94, the 21 human trafficking victim fund established in section 915.95, or 22 the human trafficking enforcement fund established in 2015 Iowa 23 Acts, chapter 138, section 141. 24 4. REPORT OF MONEY AWARDS. The attorney general shall 25 submit a report to the general assembly and the department of 26 management all money settlement awards and court money awards 27 which were awarded to the state of Iowa. The attorney general 28 shall report which funds are designated to receive the moneys 29 and under what legal authority the designation is being made. 30 Reports must be submitted within 30 days following a money 31 settlement award or a court money award. 32 Sec. 2. OFFICE OF CONSUMER ADVOCATE. There is appropriated 33 from the department of commerce revolving fund created in 34 section 546.12 to the office of consumer advocate of the 35 -3- LSB 1014XG (13) 89 as/tm 3/ 39

It is the intent of the general assembly that each 8 lease negotiated by the department of corrections with a 9 private corporation for the purpose of providing private 10 industry employment of inmates in a correctional institution 11 shall prohibit the private corporation from utilizing inmate 12 labor for partisan political purposes for any person seeking 13 election to public office in this state and that a violation 14 of this requirement shall result in a termination of the lease 15 agreement. 16 b. It is the intent of the general assembly that as a 17 condition of receiving the appropriation provided in this 18 subsection the department of corrections shall not enter into 19 a lease or contractual agreement pursuant to section 904.809 20 with a private corporation for the use of building space for 21 the purpose of providing inmate employment without providing 22 that the terms of the lease or contract establish safeguards to 23 restrict, to the greatest extent feasible, access by inmates 24 working for the private corporation to personal identifying 25 information of citizens. 26 2. Each judicial district department of correctional 5 services, within the moneys available, shall continue programs 6 and plans established within that district to provide for 7 intensive supervision, sex offender treatment, diversion of 8 low-risk offenders to the least restrictive sanction available, 9 job development, and expanded use of intermediate criminal 10 sanctions. 11 4. Each judicial district department of correctional 12 services shall provide alternatives to prison consistent with 13 chapter 901B. The alternatives to prison shall ensure public 14 safety while providing maximum rehabilitation to the offender. 15 A judicial district department of correctional services may 16 also establish a day program. 17 5. The governor’s office of drug control policy shall 18 consider federal grants made to the department of corrections 19 for the benefit of each of the eight judicial district 20 departments of correctional services as local government 21 grants, as defined pursuant to federal regulations. 22 6. The department of corrections shall continue to contract 23 with a judicial district department of correctional services to 24 provide for the rental of electronic monitoring equipment which 25 shall be available statewide. 26 7. The public safety assessment shall not be utilized 27 in pretrial hearings when determining whether to detain or 28 release a defendant before trial, and the use of the public 29 safety assessment pilot program shall be terminated as of the 30 effective date of this subsection, until such time the use of 31 the public safety assessment has been specifically authorized 32 by the general assembly. 33 Sec. 6. DEPARTMENT OF CORRECTIONS —— REALLOCATION OF 34 APPROPRIATIONS. Notwithstanding section 8.39, within the 35 -9- LSB 1014XG (13) 89 as/tm 9/ 39
S.F. _____ H.F. _____ moneys appropriated in this division of this Act to the 1 department of corrections, the department may reallocate the 2 moneys appropriated and allocated as necessary to best fulfill 3 the needs of the correctional institutions, administration 4 of the department, and the judicial district departments of 5 correctional services. However, in addition to complying with 6 the requirements of sections 904.116 and 905.8 and providing 7 notice to the legislative services agency, the department 8 of corrections shall also provide notice to the department 9 of management, prior to the effective date of the revision 10 or reallocation of an appropriation made pursuant to this 11 section. The department of corrections shall not reallocate an 12 appropriation or allocation for the purpose of eliminating any 13 program. 14 Sec. 7. INTENT —— REPORTS. 15 1. The department of corrections, in cooperation with 16 townships, the Iowa cemetery associations, and other nonprofit 17 or governmental entities, may use inmate labor during the 18 fiscal year beginning July 1, 2021, to restore or preserve 19 rural cemeteries and historical landmarks. The department, in 20 cooperation with the counties, may also use inmate labor to 21 clean up roads, major water sources, and other water sources 22 around the state. 23 2. On a quarterly basis, the department shall provide 24 a status report regarding private-sector employment to the 25 legislative services agency beginning on July 1, 2021. The 26 report shall include the number of offenders employed in the 27 private sector, the combined number of hours worked by the 28 offenders, the total amount of allowances, and the distribution 29 of allowances pursuant to section 904.702, including any moneys 30 deposited in the general fund of the state. 31 Sec. 8. ELECTRONIC MONITORING REPORT. The department of 32 corrections shall submit a report on electronic monitoring to 33 the general assembly, to the co-chairpersons and the ranking 34 members of the joint appropriations subcommittee on the justice 35 -10- LSB 1014XG (13) 89 as/tm 10/ 39
S.F. _____ H.F. _____ system, and to the legislative services agency by January 1 15, 2022. The report shall specifically address the number 2 of persons being electronically monitored and break down the 3 number of persons being electronically monitored by offense 4 committed. The report shall also include a comparison of any 5 data from the prior fiscal year with the current fiscal year. 6 Sec. 9. STATE AGENCY PURCHASES FROM PRISON INDUSTRIES. 7 1. As used in this section, unless the context otherwise 8 requires, “state agency” means the government of the state 9 of Iowa, including but not limited to all executive branch 10 departments, agencies, boards, bureaus, and commissions, the 11 judicial branch, the general assembly and all legislative 12 agencies, institutions within the purview of the state board of 13 regents, and any corporation whose primary function is to act 14 as an instrumentality of the state. 15 2. State agencies are encouraged to purchase products from 16 Iowa state industries, as defined in section 904.802, when 17 purchases are required and the products are available from 18 Iowa state industries. State agencies shall obtain bids from 19 Iowa state industries for purchases of office furniture during 20 the fiscal year beginning July 1, 2021, exceeding $5,000 or 21 in accordance with applicable administrative rules related to 22 purchases for the agency. 23 Sec. 10. IOWA LAW ENFORCEMENT ACADEMY. 24 1. There is appropriated from the general fund of the 25 state to the Iowa law enforcement academy for the fiscal year 26 beginning July 1, 2021, and ending June 30, 2022, the following 27 amount, or so much thereof as is necessary, to be used for the 28 purposes designated: 29 a. For salaries, support, maintenance, and miscellaneous 30 purposes, including jailer training and technical assistance: 31 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 1,193,868 32 b. The Iowa law enforcement academy may temporarily exceed 33 and draw more than the amount appropriated in this subsection 34 and incur a negative cash balance as long as there are 35 -11- LSB 1014XG (13) 89 as/tm 11/ 39
S.F. _____ H.F. _____ receivables equal to or greater than the negative balance and 1 the amount appropriated in this subsection is not exceeded at 2 the close of the fiscal year. 3 2. The Iowa law enforcement academy may select at least 4 five automobiles of the department of public safety, division 5 of state patrol, prior to turning over the automobiles to 6 the department of administrative services to be disposed 7 of by public auction, and the Iowa law enforcement academy 8 may exchange any automobile owned by the academy for each 9 automobile selected if the selected automobile is used in 10 training law enforcement officers at the academy. However, any 11 automobile exchanged by the academy shall be substituted for 12 the selected vehicle of the department of public safety and 13 sold by public auction with the receipts being deposited in the 14 depreciation fund maintained pursuant to section 8A.365 to the 15 credit of the department of public safety, division of state 16 patrol. 17 3. The Iowa law enforcement academy shall provide training 18 for domestic abuse and human trafficking-related issues 19 throughout the state. The training shall be offered at no 20 cost to the attendees and the training shall not replace any 21 existing domestic abuse or human trafficking training offered 22 by the academy. 23 Sec. 11. STATE PUBLIC DEFENDER. There is appropriated from 24 the general fund of the state to the office of the state public 25 defender of the department of inspections and appeals for the 26 fiscal year beginning July 1, 2021, and ending June 30, 2022, 27 the following amounts, or so much thereof as is necessary, to 28 be used for the purposes designated: 29 1. The governor’s office of drug control policy shall 26 consider federal grants made to the department of corrections 27 for the benefit of each of the eight judicial district 28 departments of correctional services as local government 29 grants, as defined pursuant to federal regulations. 30 6. The department of corrections shall continue to contract 31 with a judicial district department of correctional services to 32 provide for the rental of electronic monitoring equipment which 33 shall be available statewide. 34 7. The public safety assessment shall not be utilized 35 -27- LSB 1014XG (13) 89 as/tm 27/ 39
S.F. _____ H.F. _____ in pretrial hearings when determining whether to detain or 1 release a defendant before trial, and the use of the public 2 safety assessment pilot program shall be terminated as of the 3 effective date of this subsection, until such time the use of 4 the public safety assessment has been specifically authorized 5 by the general assembly. 6 Sec. 26. DEPARTMENT OF CORRECTIONS —— REALLOCATION OF 7 APPROPRIATIONS. Notwithstanding section 8.39, within the 8 moneys appropriated in this division of this Act to the 9 department of corrections, the department may reallocate the 10 moneys appropriated and allocated as necessary to best fulfill 11 the needs of the correctional institutions, administration 12 of the department, and the judicial district departments of 13 correctional services. However, in addition to complying with 14 the requirements of sections 904.116 and 905.8 and providing 15 notice to the legislative services agency, the department 16 of corrections shall also provide notice to the department 17 of management, prior to the effective date of the revision 18 or reallocation of an appropriation made pursuant to this 19 section. The department of corrections shall not reallocate an 20 appropriation or allocation for the purpose of eliminating any 21 program. 22 Sec. 27. INTENT —— REPORTS. 23 1. The department of corrections, in cooperation with 24 townships, the Iowa cemetery associations, and other nonprofit 25 or governmental entities, may use inmate labor during the 26 fiscal year beginning July 1, 2022, to restore or preserve 27 rural cemeteries and historical landmarks. The department, in 28 cooperation with the counties, may also use inmate labor to 29 clean up roads, major water sources, and other water sources 30 around the state. 31 2. On a quarterly basis, the department shall provide 32 a status report regarding private-sector employment to the 33 legislative services agency beginning on July 1, 2022. The 34 report shall include the number of offenders employed in the 35 -28- LSB 1014XG (13) 89 as/tm 28/ 39
S.F. _____ H.F. _____ private sector, the combined number of hours worked by the 1 offenders, the total amount of allowances, and the distribution 2 of allowances pursuant to section 904.702, including any moneys 3 deposited in the general fund of the state. 4 Sec. 28. ELECTRONIC MONITORING REPORT. The department of 5 corrections shall submit a report on electronic monitoring to 6 the general assembly, to the co-chairpersons and the ranking 7 members of the joint appropriations subcommittee on the justice 8 system, and to the legislative services agency by January 9 15, 2023. The report shall specifically address the number 10 of persons being electronically monitored and break down the 11 number of persons being electronically monitored by offense 12 committed. The report shall also include a comparison of any 13 data from the prior fiscal year with the current fiscal year. 14 Sec. 29. STATE AGENCY PURCHASES FROM PRISON INDUSTRIES. 15 1. As used in this section, unless the context otherwise 16 requires, “state agency” means the government of the state 17 of Iowa, including but not limited to all executive branch 18 departments, agencies, boards, bureaus, and commissions, the 19 judicial branch, the general assembly and all legislative 20 agencies, institutions within the purview of the state board of 21 regents, and any corporation whose primary function is to act 22 as an instrumentality of the state. 23 2. State agencies are encouraged to purchase products from 24 Iowa state industries, as defined in section 904.802, when 25 purchases are required and the products are available from 26 Iowa state industries. State agencies shall obtain bids from 27 Iowa state industries for purchases of office furniture during 28 the fiscal year beginning July 1, 2022, exceeding $5,000 or 29 in accordance with applicable administrative rules related to 30 purchases for the agency. 31 Sec. 30. IOWA LAW ENFORCEMENT ACADEMY. 32 1. There is appropriated from the general fund of the 33 state to the Iowa law enforcement academy for the fiscal year 34 beginning July 1, 2022, and ending June 30, 2023, the following 35 -29- LSB 1014XG (13) 89 as/tm 29/ 39

However, any 19 automobile exchanged by the academy shall be substituted for 20 the selected vehicle of the department of public safety and 21 sold by public auction with the receipts being deposited in the 22 depreciation fund maintained pursuant to section 8A.365 to the 23 credit of the department of public safety, division of state 24 patrol. 25 3. The Iowa law enforcement academy shall provide training 26 for domestic abuse and human trafficking-related issues 27 throughout the state. The training shall be offered at no 28 cost to the attendees and the training shall not replace any 29 existing domestic abuse or human trafficking training offered 30 by the academy. 31 Sec. 31.
