S.F. _____ Section 1. Section 99D.19, Code 2017, is amended by adding 1 the following new subsection: 2 NEW SUBSECTION . 3. The records of the commission shall be 3 governed by the provisions of chapter 22, provided that, in 4 addition to records that may be kept confidential pursuant to 5 section 22.7, the following records provided by a licensee to 6 the commission shall be kept confidential, unless otherwise 7 ordered by a court, by the lawful custodian of the records, or 8 by another person duly authorized to release such information: 9 a. Promotional play receipts records. 10 b. Patron and customer records. 11 c. Surveillance records. 12 d. Security reports and network audits. 13 e. Internal control records. 14 f. Employee records. 15 g. Any audit information and records, except for those books 16 and records as described in subsection 1 of this section, that 17 are obtained by the commission in connection with the annual 18 audit under section 99D.20. 19 Sec. 2. Section 99F.12, subsection 3, Code 2017, is amended 20 to read as follows: 21 3. The Except as provided in subsection 4, the books 22 and records kept by a licensee as provided by this section 23 are public records and the examination, publication, and 24 dissemination of the books and records are governed by the 25 provisions of chapter 22 . 26 Sec. 3. Section 99F.12, Code 2017, is amended by adding the 27 following new subsection: 28 NEW SUBSECTION . 4. Any audit information and records, except for those books 7 and records as described in subsection 1 of this section, that 8 are obtained by the commission in connection with the annual 9 audit under section 99F.13. 10 EXPLANATION 11 The inclusion of this explanation does not constitute agreement with 12 the explanation’s substance by the members of the general assembly. 13 This bill provides that certain records provided by a 14 licensee under Code chapter 99D or 99F to the racing and gaming 15 commission shall be kept confidential by the commission unless 16 otherwise ordered by a court, by the lawful custodian of the 17 records, or by another person duly authorized to release 18 such information. The bill lists the records to be kept 19 confidential as promotional play receipts records, patron and 20 customer records, surveillance records, security reports and 21 network audits, internal control records, employee records, and 22 most audit information and records that are obtained by the 23 commission in connection with the annual audit conducted under 24 Code section 99D.20 or 99F.13, as applicable. 25 -2- LSB 2158XC (4) 87 ec/nh 2/ 2
