S.F. _____ H.F. _____ Section 1. Section 124.208, subsection 6, Code 2013, is 1 amended by adding the following new paragraphs: 2 NEW PARAGRAPH . bk. Methasterone 3 (2[alpha],17[alpha]-dimethyl-5[alpha]-androstan-17[beta]-ol-3-one). 4 NEW PARAGRAPH . bl. Prostanozol 5 (17[beta]-hydroxy-5[alpha]-androstano[3,2-c]pyrazole). 6 Sec. 2. Section 124.553, subsection 1, Code 2013, is amended 7 by adding the following new paragraph: 8 NEW PARAGRAPH . d. A prescription database or monitoring 9 program in another jurisdiction pursuant to subsection 8. 10 Sec. 3. Section 124.553, Code 2013, is amended by adding the 11 following new subsection: 12 NEW SUBSECTION . 8. The board may enter into agreements for 13 the mutual exchange of information among prescription database 14 or monitoring programs in other jurisdictions. Any agreement 15 entered into pursuant to this subsection shall specify that all 16 the information exchanged shall be used and disseminated in 17 accordance with the laws of this state. 18 EXPLANATION 19 This bill adds substances to the list of substances 20 classified as controlled substances and relates to the exchange 21 of information among prescription databases and monitoring 22 programs. 23 The bill classifies the anabolic steroids methasterone 24 and prostanozol as schedule III controlled substances. The 25 criteria used to classify a substance as a schedule III 26 controlled substance is established in Code section 124.207. 27 It is a class “C” felony pursuant to Code section 28 124.401(1)(c)(8) for any unauthorized person to violate a 29 provision of Code section 124.401 involving a controlled 30 substance placed on schedule I, II, or III pursuant to the 31 bill. A class “C” felony for this particular offense is 32 punishable by confinement for no more than 10 years and a fine 33 of at least $1,000 but not more than $50,000. 34 If a person possesses a controlled substance in violation of 35 -1- LSB 1154DP (3) 85 jm/nh 1/ 2
S.F. _____ H.F. _____ Code section 124.401(5) as a first offense, the person commits 1 a serious misdemeanor. A serious misdemeanor is punishable 2 by confinement for no more than one year and a fine of at 3 least $315 but not more than $1,875. A second offense is an 4 aggravated misdemeanor punishable by confinement for no more 5 than two years and a fine of at least $625 but not more than 6 $6,250. A subsequent offense is a class “D” felony punishable 7 by confinement for no more than five years and a fine of at 8 least $750 but not more than $7,500. 9 The bill also authorizes the board of pharmacy to enter 10 into agreements with other jurisdictions in order to exchange 11 information from the Iowa prescription monitoring program with 12 similar programs in other jurisdictions. 13 The bill requires that any agreement entered into shall 14 specify that all the information exchanged shall be used and 15 disseminated in accordance with the laws of this state. 16 The Iowa prescription monitoring program is used by 17 prescribing practitioners and pharmacists on a need-to-know 18 basis for facilitating early identification of patients who 19 may be at risk for addiction, or who may be using, abusing, 20 or diverting drugs for unlawful or otherwise unauthorized 21 purposes. 22 -2- LSB 1154DP (3) 85 jm/nh 2/ 2
