S.F. _____ Section 1. Section 414.1, subsection 1, Code 2017, is 1 amended to read as follows: 2 1. a. For the purpose of promoting the health, safety, 3 morals, or the general welfare of the community or for the 4 purpose of preserving historically significant areas of 5 the community, any city is hereby empowered to regulate and 6 restrict the height, number of stories, and size of buildings 7 and other structures, the percentage of lot that may be 8 occupied, the size of yards, courts, and other open spaces, the 9 density of population, and the location and use of buildings, 10 structures, and land for trade, industry, residence, or other 11 purposes. 12 b. A city shall not, after January 1, 2018, adopt or enforce 13 any regulation or restriction related to the occupancy of 14 residential rental property that is based upon the existence 15 of familial or nonfamilial relationships between the occupants 16 of such rental property. 17 EXPLANATION 18 The inclusion of this explanation does not constitute agreement with 19 the explanation’s substance by the members of the general assembly. 20 This bill relates to the authority of cities to regulate and 21 restrict the occupancy of residential rental property. 22 The bill provides that a city shall not, after January 1, 23 2018, adopt or enforce any regulation or restriction related 24 to the occupancy of residential rental property based upon the 25 familial or nonfamilial relationships of the occupants. 26 -1- LSB 1306SC (2) 87 aw/sc 1/ 1
