  1 A Joint Resolution proposing an amendment to the Constitution
  2    of the State of Iowa relating to an individual's right to
  3    acquire, keep, possess, transport, carry, transfer, and use
  4    arms.
  5 BE IT RESOLVED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

  1  1    Section 1.  The following amendment to the Constitution of
  1  2 the State of Iowa is proposed:
  1  3    Article I of the Constitution of the State of Iowa is amended
  1  4 by adding the following new section:
  1  5 Right to acquire, keep, possess, transport, carry, transfer,
  1  6 and use arms.SEC. 1A.  The right of an individual to acquire,
  1  7 keep, possess, transport, carry, transfer, and use arms to
  1  8 defend life and liberty and for all other legitimate purposes
  1  9 is fundamental and shall not be infringed upon or denied.
  1 10 Mandatory licensing, registration, or special taxation as a
  1 11 condition of the exercise of this right is prohibited, and any
  1 12 other restriction shall be subject to strict scrutiny.
  1 13    Sec. 2.  REFERRAL AND PUBLICATION.  The foregoing proposed
  1 14 amendment to the Constitution of the State of Iowa is referred
  1 15 to the general assembly to be chosen at the next general
  1 16 election for members of the general assembly and the secretary
  1 17 of state is directed to cause the same to be published for
  1 18 three consecutive months previous to the date of that election
  1 19 as provided by law.
  1 20                           EXPLANATION
  1 21 The inclusion of this explanation does not constitute agreement with
  1 22 the explanation's substance by the members of the general assembly.
  1 23    This joint resolution proposes an amendment to the
  1 24 Constitution of the State of Iowa providing that the right of
  1 25 an individual to acquire, keep, possess, transport, carry,
  1 26 transfer, and use arms to defend life and liberty and for all
  1 27 other legitimate purposes is fundamental and shall not be
  1 28 infringed upon or denied. Mandatory licensing, registration,
  1 29 or special taxation as a condition of the exercise of this
  1 30 right is prohibited, and any other restriction shall be subject
  1 31 to strict scrutiny.
  1 32    The joint resolution, if adopted, would be referred to the
  1 33 next general assembly for adoption a second time before being
  1 34 submitted to the electorate for ratification.
