Section
331.301,
subsection
16,
Code
2021,
is

amended
to
read
as
follows:

16.
a.
The
board
of
supervisors
may
by
ordinance
or

resolution
prohibit
or
limit
the
use
of
consumer
fireworks
or

display
fireworks,
as
described
in
section
727.2
,
if
the
board
5
determines
that
the
use
of
such
devices
would
constitute
a
6
threat
to
public
safety
or
private
property,
or
if
the
board
7
determines
that
the
use
of
such
devices
would
constitute
a
8
nuisance
to
neighboring
landowners.

b.
The
board
of
supervisors
may
by
ordinance
or
resolution

prohibit
or
limit
the
sale
of
any
variety
of
consumer

fireworks,
as
described
in
section
727.2,
if
the
board

determines
there
is
clear
and
convincing
evidence
that
the
sale

of
such
consumer
fireworks
would
constitute
a
threat
to
public

safety
or
public
health.

city
council

and
