1.
As
used
in
this
section,
unless
the
context
otherwise
3
requires:
4
a.
“Bidder”
means
a
person
or
entity
authorized
to
transact
5
business
in
this
state
who
submits
a
bid
for
a
contract
for
any
6
construction,
good,
or
service
with
a
governmental
entity.
7
b.
“Governmental
entity”
means
the
state,
a
political
8
subdivision
of
the
state,
public
school
corporations,
and
all
9
officers,
boards,
or
commissions.

c.
“Harassment”
means
persistent,
repetitive,
or
highly
11
egregious
conduct
based
on
age,
race,
creed,
color,
sex,
sexual
12
orientation,
gender
identity,
national
origin,
religion,
or
13
disability
that
is
directed
at
a
specific
individual
or
group
14
of
individuals
that
a
reasonable
person
would
interpret
as
15
intentional
harassment,
taking
into
consideration
the
full
16
context
in
which
the
conduct
occurs,
which
conduct
threatens
17
to
impair
the
ability
of
a
person
to
perform
the
duties
of
18
employment.

2.
A
bidder
who
submits
a
bid
for
a
contract
for
any
20
construction,
good,
or
service
with
a
governmental
entity
shall
21
have
an
anti-harassment
policy.
The
bidder
shall
provide
a
22
copy
of
the
policy
with
the
bid.

EXPLANATION
24
The
inclusion
of
this
explanation
does
not
constitute
agreement
with
25
the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
requires
a
bidder
for
a
contract
with
a
27
governmental
entity
to
have
in
place
a
policy
that
prohibits
28
harassment
of
a
person
based
on
the
age,
race,
creed,
29
color,
sex,
sexual
orientation,
gender
identity,
national
30
origin,
religion,
or
disability
of
such
person.
The
bidder
31
shall
include
a
copy
of
the
policy
with
the
bid.
The
bill
32
provides
definitions
for
“bidder”,
“governmental
entity”,
and
33
“harassment”
as
they
apply
to
the
bidding
requirement.
