S.F. 92 Section 1. Section 235E.2, subsection 9, Code 2023, is 1 amended to read as follows: 2 9. a. A person required by this section to report a 3 suspected case of dependent adult abuse pursuant to subsection 4 2 who knowingly and willfully fails to do so within twenty-four 5 hours commits a simple misdemeanor. 6 b. A person required by subsection 2 to report a suspected 7 case of dependent adult abuse who knowingly fails to do so or 8 who knowingly interferes with the making of such a report or 9 applies a requirement that results in such a failure is civilly 10 liable for the damages proximately caused by the failure. 11 c. A person who reports or causes to be reported false 12 information regarding a suspected case of dependent adult abuse 13 pursuant to subsection 2, knowing that the information is false 14 or that the abuse did not occur, commits a simple misdemeanor. 15 EXPLANATION 16 The inclusion of this explanation does not constitute agreement with 17 the explanation’s substance by the members of the general assembly. 18 This bill relates to the reporting of false information 19 regarding suspected dependent adult abuse in facilities and 20 programs. 21 The bill provides that a person who reports or causes to 22 be reported false information regarding a suspected case of 23 dependent adult abuse, knowing that the information is false 24 or that the abuse did not occur, commits a simple misdemeanor. 25 A simple misdemeanor is punishable by confinement for no more 26 than 30 days and a fine of at least $105 but not more than $855. 27 -1- LSB 1137XS (2) 90 pf/rh 1/ 1
