Section
1.
MEDICAID
EXTENDED
POSTPARTUM
COVERAGE

OPTION.
The
department
of
health
and
human
services
shall
2
submit
a
Medicaid
state
plan
amendment
to
the
centers
for
3
Medicare
and
Medicaid
services
of
the
United
States
department
4
of
health
and
human
services
for
approval
of
the
option
5
to
provide
twelve
months
of
continuous
postpartum
coverage
6
under
the
Medicaid
program
to
pregnant
women
enrolled
in
the
7
Medicaid
program
in
accordance
with
sections
9812
and
9822
8
of
the
federal
American
Rescue
Plan
Act
of
2021,
Pub.
L.
No.
9
117-2,
as
amended
by
section
5113
of
the
federal
Consolidated
10
Appropriations
Act
of
2023.

Sec.
2.
EFFECTIVE
DATE.
This
Act,
being
deemed
of
immediate
12
importance,
takes
effect
upon
enactment.

EXPLANATION
14
The
inclusion
of
this
explanation
does
not
constitute
agreement
with
15
the
explanation’s
substance
by
the
members
of
the
general
assembly.

Under
current
federal
law,
pregnant
Medicaid
beneficiaries
17
are
eligible
for
at
least
pregnancy-related
services
through
18
the
end
of
the
month
in
which
the
60-day
period
beginning
on
19
the
last
day
of
the
pregnancy
ends.

Provisions
of
the
federal
American
Rescue
Plan
Act
of
2021
21
(H.R.
1319)
provide
the
option
to
states
to
submit
a
state
22
plan
amendment
to
provide
postpartum
Medicaid
coverage
for
12
23
months
after
the
end
of
a
pregnancy
for
a
five-year
period.
A
24
provision
under
the
federal
Consolidated
Appropriations
Act
of
25
2023
removed
the
five-year
limitation.

This
bill
requires
the
department
of
health
and
human
27
services
(HHS)
to
submit
a
Medicaid
state
plan
amendment
to
the
28
centers
for
Medicare
and
Medicaid
services
of
the
United
States
29
department
of
health
and
human
services
for
approval
of
the
new
30
option
to
provide
12
months
of
continuous
postpartum
coverage
31
under
the
Medicaid
program
to
pregnant
women
enrolled
in
the
32
Medicaid
program.

The
bill
takes
effect
upon
enactment.
