  1  1    Section 1.  Section 100C.2, subsection 4, paragraph b, Code
  1  2 2015, is amended to read as follows:
  1  3    b.  An employee or subcontractor of a certified alarm system
  1  4 contractor who is an alarm system installer, and who is not
  1  5 licensed pursuant to chapter 103 shall obtain and maintain
  1  6 certification as an alarm system installer and shall meet and
  1  7 maintain qualifications established by the state fire marshal
  1  8 by rule.
  1  9    Sec. 2.  Section 100C.10, subsection 3, Code 2015, is amended
  1 10 to read as follows:
  1 11    3.  The state fire marshal, or the state fire marshal's
  1 12 designee, and the chairperson of the electrical examining
  1 13 board created in section 103.2 shall be a nonvoting ex officio
  1 14 members member of the board.
  1 15    Sec. 3.  Section 105.18, subsection 3, paragraph d, Code
  1 16 2015, is amended by striking the paragraph.
  1 17    Sec. 4.  REPEAL.  Chapter 103, Code 2015, is repealed.
  1 18    Sec. 5.  TRANSITION PROVISIONS.  The division of state fire
  1 19 marshal of the department of public safety shall adopt rules
  1 20 establishing a procedure for the refunding of license fees
  1 21 remitted by licensees under chapter 103 on a prorated basis
  1 22 corresponding to the period remaining after December 31, 2015,
  1 23 and prior to a license's expiration date.
  1 24    Sec. 6.  EFFECTIVE DATE.  The sections of this Act amending
  1 25 sections 100C.2, 100C.10, and 105.18 and repealing chapter 103,
  1 26 take effect December 31, 2015.
  1 27                           EXPLANATION
  1 28 The inclusion of this explanation does not constitute agreement with
  1 29 the explanation's substance by the members of the general assembly.
  1 30    This bill repeals Code chapter 103, providing for statewide
  1 31 licensure of electricians and electrical contractors.  The
  1 32 effect of this repeal would be to allow political subdivisions
  1 33 to administer and regulate electricians, electrical
  1 34 contractors, and electrical inspections. The bill directs the
  1 35 division of state fire marshal of the department of public
  2  1 safety to adopt rules providing for refunding license fees on
  2  2 a prorated basis corresponding to the period remaining after
  2  3 the repeal and prior to a license's expiration date. The
  2  4 bill makes conforming changes within Code chapter 100C, which
  2  5 regulates the licensing of fire extinguishing and alarm system
  2  6 contractors and installers and Code chapter 105 regulating
  2  7 plumbers, mechanical professionals, and contractors.
  2  8    Provisions of the bill regarding the adoption of rules for
  2  9 prorating license fees take effect July 1 after the bill's
  2 10 enactment. The remaining provisions of the bill take effect
  2 11 December 31, 2015.
