Section 481A.67, subsections 2 and 3, Code 2017, 1 2 are amended to read as follows: 1 3 2. a. Notwithstanding any provision of law to the contrary, 1 4 the natural resource commission shall adopt rules pursuant to 1 5 chapter 17A establishing seasons and daily catch limits for the 1 6 noncommercial harvest of turtles in any waters of the state 1 7 pursuant to section 483A.28. Seasons established pursuant to 1 8 this subsection shall not apply to the noncommercial harvest of 1 9 snapping turtles. 1 10 b. (1) The annual season for the noncommercial harvest of 1 11 turtles shall begin on July 15 and end on May 15. 1 12 (2) Beginning on July 15, 2017, the following limits on the 1 13 noncommercial harvest of turtles are applicable: 1 14 (a) Daily catch limit: 1 15 (i) Four common snapping turtles. 1 16 (ii) One spiny or smooth softshell turtle. 1 17 (iii) One painted turtle. 1 18 (b) A person with a valid fishing license issued pursuant to 1 19 chapter 483A is entitled to take and possess a maximum amount 1 20 of turtles as provided in section 483A.28. 1 21 (3) This paragraph "b" is repealed effective July 1, 2021. 1 22 3. a. Notwithstanding any provision of law to the contrary, 1 23 the natural resource commission shall adopt rules pursuant to 1 24 chapter 17A establishing seasons and daily catch limits for the 1 25 commercial harvest of turtles in any waters of the state. 1 26 b. (1) The annual season for the commercial harvest of 1 27 turtles shall begin on July 15 and end on May 15. 1 28 (2) Beginning on July 15, 2017, the following limits on the 1 29 commercial harvest of turtles are applicable: 1 30 (a) Daily catch limit: 1 31 (i) Ten common snapping turtles. 1 32 (ii) Ten spiny and smooth softshell turtles, in aggregate. 1 33 (iii) Five painted turtles. 1 34 (b) Possession limit: 1 35 (i) Thirty common snapping turtles. 2 1 (ii) Thirty spiny and smooth softshell turtles, in 2 2 aggregate. 2 3 (iii) Fifteen painted turtles. 2 4 (3) This paragraph "b" is repealed effective July 1, 2021. 2 5 Sec. 2. Section 481A.67, Code 2017, is amended by adding the 2 6 following new subsection: 2 7 NEW SUBSECTION. 3A. Beginning on the effective date of 2 8 this Act, a person shall not be issued or allowed to renew a 2 9 commercial turtle harvester license pursuant to chapter 482 2 10 unless the person held a commercial turtle harvester license at 2 11 any time during the period beginning on January 1, 2015, and 2 12 ending on the effective date of this Act. This subsection is 2 13 repealed effective July 1, 2021. 2 14 Sec. 3. RESCISSION OF AMENDMENTS TO ADMINISTRATIVE RULES. 2 15 1. The amendments to 571 Iowa administrative code, 2 16 chapter 86, as appearing in ARC 2951C, as published in the 2 17 Iowa administrative bulletin, volume XXXIX, number 17, dated 2 18 February 15, 2017, pp. 1685=1687, are rescinded. 2 19 2. As soon as practicable, the Iowa administrative code 2 20 editor shall restore the language of the Iowa administrative 2 21 code chapter referenced in subsection 1 of this section to the 2 22 language that existed on February 14, 2017. 2 23 Sec. 4. EFFECTIVE UPON ENACTMENT. This Act, being deemed of 2 24 immediate importance, takes effect upon enactment. 2 25 EXPLANATION 2 26 The inclusion of this explanation does not constitute agreement with 2 27 the explanation's substance by the members of the general assembly. 2 28 This bill relates to the noncommercial and commercial 2 29 harvest of turtles. 2 30 The bill provides that the annual season for the 2 31 noncommercial and commercial harvest of turtles shall begin on 2 32 July 15 and end May 15. 2 33 The bill also specifies daily catch limits and possession 2 34 limits on the noncommercial and commercial harvest of turtles, 2 35 beginning on July 15, 2017. These provisions are repealed 3 1 effective July 1, 2021. 3 2 The bill provides that, beginning on the effective date of 3 3 the bill, a person shall not be issued or allowed to renew a 3 4 commercial turtle harvester license unless the person held such 3 5 a license at any time during the period beginning on January 3 6 1, 2015, and ending on the effective date of the bill. This 3 7 provision is repealed effective July 1, 2021. 3 8 The bill rescinds amendments to specified rules relating 3 9 to harvesting commercial and noncommercial turtles that were 3 10 published in the Iowa administrative code on February 15, 2017, 3 11 and directs the Iowa administrative code editor to restore the 3 12 language of the Iowa administrative code to the language that 3 13 existed on February 14, 2017. 3 14 The bill is effective upon enactment.
