S.F. 445 Section 1. Section 257.31, subsection 5, paragraph j, Code 1 2019, is amended to read as follows: 2 j. Unusual need to continue providing a program or other 3 special assistance to non-English speaking limited English 4 proficient pupils after the expiration of the five-year period 5 of years specified in section 280.4 . 6 Sec. 2. Section 280.4, subsection 3, paragraph a, Code 2019, 7 is amended to read as follows: 8 a. In order to provide funds for the excess costs of 9 instruction of limited English proficient students specified 10 in paragraph “b” above the costs of instruction of pupils in 11 a regular curriculum, students identified as limited English 12 proficient shall be assigned an additional weighting of 13 twenty-two hundredths two hundred ninety-five thousandths , and 14 that weighting shall be included in the weighted enrollment of 15 the school district of residence for a period not exceeding 16 five the period of years specified in paragraph “b” . However, 17 the school budget review committee may grant supplemental aid 18 or a modified supplemental amount to a school district to 19 continue funding a program for students after the expiration of 20 the five-year specified period of years . 21 Sec. 3. Section 282.18, subsection 7, paragraph b, 22 subparagraph (1), Code 2019, is amended to read as follows: 23 (1) The board of directors of the district of residence 24 shall pay to the receiving district the sum of the state cost 25 per pupil for the previous school year plus either the teacher 26 leadership supplement state cost per pupil for the previous 27 fiscal year as provided in section 257.9 or the teacher 28 leadership supplement foundation aid for the previous fiscal 29 year as provided in section 284.13, subsection 1 , paragraph “d” , 30 if both the district of residence and the receiving district 31 are receiving such supplements, plus any moneys received for 32 the pupil as a result of the non-English speaking limited 33 English proficient weighting under section 280.4, subsection 34 3 , for the previous school year multiplied by the state cost 35 -1- LSB 1648SV (2) 88 md/jh 1/ 3

If the pupil participating in 1 open enrollment is also an eligible pupil under section 261E.6 , 2 the receiving district shall pay the tuition reimbursement 3 amount to an eligible postsecondary institution as provided in 4 section 261E.7 . 5 Sec. 4. Section 282.18, subsection 16, paragraph a, Code 6 2019, is amended to read as follows: 7 a. If a request under this section is for transfer to the 8 research and development school, as described in chapter 256G , 9 the student who is the subject of the request shall be included 10 in the basic enrollment of the student’s district of residence 11 and the board of directors of the district of residence shall 12 pay to the research and development school the state cost per 13 pupil for the previous school year, plus any moneys received 14 for the pupil as a result of the non-English speaking limited 15 English proficient weighting under section 280.4, subsection 16 3 , for the previous school year multiplied by the state cost 17 per pupil for the previous year. 18 Sec. 5. EFFECTIVE DATE. This Act, being deemed of immediate 19 importance, takes effect upon enactment. 20 Sec. 6. APPLICABILITY. This Act applies to school budget 21 years beginning on or after July 1, 2019. 22 EXPLANATION 23 The inclusion of this explanation does not constitute agreement with 24 the explanation’s substance by the members of the general assembly. 25 This bill relates to limited English proficient education by 26 increasing the amount of supplementary weighting for limited 27 English proficient students. 28 Current Code section 280.4 provides supplementary weighting 29 for the excess costs of instruction of limited English 30 proficient students. The current amount of the additional 31 weighting for students identified as limited English proficient 32 is 0.22 per student. The weighting is provided for those 33 students first determined to be limited English proficient for 34 a budget year beginning on or after July 1, 2010, and may be 35 -2- LSB 1648SV (2) 88 md/jh 2/ 3
S.F. 445 included in the weighted enrollment of the school district for 1 a period not exceeding five years. 2 The bill increases the amount of the additional weighting 3 for students identified as limited English proficient from 0.22 4 per student to 0.295 per student. 5 The bill also makes statutory changes to provide uniformity 6 in referring to limited English proficient pupils. 7 The bill takes effect upon enactment and applies to school 8 budget years beginning on or after July 1, 2019. 9 -3- LSB 1648SV (2) 88 md/jh 3/ 3
