S.F. 408 Section 1. Section 321.344A, subsection 2, unnumbered 1 paragraph 1, Code 2011, is amended to read as follows: 2 A peace officer may shall initiate an investigation not 3 more than seven calendar days after receiving a report of a 4 violation pursuant to this section . The peace officer may 5 request that the owner of the vehicle supply information 6 identifying the driver of the vehicle in accordance with 7 section 321.484 , or in the case of a commercial motor vehicle, 8 the peace officer may request that the employer of the driver 9 provide information identifying the driver of the vehicle. 10 Sec. 2. Section 805.8A, subsection 14, paragraph h, Code 11 2011, is amended to read as follows: 12 h. Railroad crossing violations. 13 (1) For violations under sections 321.341 , 321.342 , 14 321.343 , and 321.344 , and 321.344B , the scheduled fine is two 15 hundred dollars. 16 (2) For a violation under section 321.344B, the scheduled 17 fine is three hundred dollars. 18 EXPLANATION 19 This bill requires a peace officer’s investigation of every 20 reported railroad crossing violation by a vehicle operator. 21 Currently, the initiation of an investigation is optional. 22 The bill increases the scheduled fine for a railroad 23 crossing violation by a vehicle operator which creates an 24 immediate threat to the safety of a person or property from 25 $200 to $300.
