  3 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

  1  1    Section 1.  NEW SECTION.  136D.3A  Use of tanning devices by
  1  2 minors prohibited.
  1  3    A tanning facility shall not allow a person under eighteen
  1  4 years of age to use a tanning device.
  1  5    Sec. 2.  Section 136D.4, subsection 1, paragraphs a and b,
  1  6 Code 2015, are amended to read as follows:
  1  7    a.  A warning sign in a conspicuous location without
  1  8 obstruction and readily visible to persons entering the
  1  9 establishment. The signs shall comply with rules adopted by
  1 10 the department.
  1 11    b.  A warning sign for each tanning device, in a conspicuous
  1 12 location without obstruction and readily visible to a person
  1 13 preparing to use the device. The sign shall comply with rules
  1 14 adopted by the department.
  1 15    Sec. 3.  Section 136D.4, subsection 2, Code 2015, is amended
  1 16 to read as follows:
  1 17    2.  A tanning facility shall provide each customer prior to
  1 18 use of a tanning device with a written warning statement that
  1 19 complies with rules adopted by the department.
  1 20                           EXPLANATION
  1 21 The inclusion of this explanation does not constitute agreement with
  1 22 the explanation's substance by the members of the general assembly.
  1 23    This bill relates to tanning facilities and creates new Code
  1 24 section 136D.3A prohibiting a tanning facility from allowing a
  1 25 person under 18 years of age to use a tanning device.  The bill
  1 26 also provides that warning signs shall be free from obstruction
  1 27 and that a written warning statement shall be provided to each
  1 28 customer prior to use of a tanning device.
  1 29    A person who violates a provision of Code chapter 136D is
  1 30 subject to a civil penalty and an injunction restraining any
  1 31 violation.
