Section 99D.19, Code 2017, is amended by adding 1 2 the following new subsection: 1 3 NEW SUBSECTION. 3. The records of the commission shall be 1 4 governed by the provisions of chapter 22, provided that, in 1 5 addition to records that may be kept confidential pursuant to 1 6 section 22.7, the following records provided by a licensee to 1 7 the commission shall be kept confidential, unless otherwise 1 8 ordered by a court, by the lawful custodian of the records, or 1 9 by another person duly authorized to release such information: 1 10 a. Promotional play receipts records. 1 11 b. Patron and customer records. 1 12 c. Surveillance records. 1 13 d. Security reports and network audits. 1 14 e. Internal control records. 1 15 f. Employee records. 1 16 g. Any audit information and records, except for those books 1 17 and records as described in subsection 1 of this section, that 1 18 are obtained by the commission in connection with the annual 1 19 audit under section 99D.20. 1 20 Sec. 2. Section 99F.12, subsection 3, Code 2017, is amended 1 21 to read as follows: 1 22 3.TheExcept as provided in subsection 4, the books 1 23 and records kept by a licensee as provided by this section 1 24 are public records and the examination, publication, and 1 25 dissemination of the books and records are governed by the 1 26 provisions of chapter 22. 1 27 Sec. 3. Section 99F.12, Code 2017, is amended by adding the 1 28 following new subsection: 1 29 NEW SUBSECTION. 4. The records of the commission shall be 1 30 governed by the provisions of chapter 22, provided that, in 1 31 addition to records that may be kept confidential pursuant to 1 32 section 22.7, the following records provided by a licensee to 1 33 the commission shall be kept confidential, unless otherwise 1 34 ordered by a court, by the lawful custodian of the records, or 1 35 by another person duly authorized to release such information: 2 1 a. Any audit information and records, except for those books 2 8 and records as described in subsection 1 of this section, that 2 9 are obtained by the commission in connection with the annual 2 10 audit under section 99F.13. 2 11 EXPLANATION 2 12 The inclusion of this explanation does not constitute agreement with 2 13 the explanation's substance by the members of the general assembly. 2 14 This bill provides that certain records provided by a 2 15 licensee under Code chapter 99D or 99F to the racing and gaming 2 16 commission shall be kept confidential by the commission unless 2 17 otherwise ordered by a court, by the lawful custodian of the 2 18 records, or by another person duly authorized to release 2 19 such information. The bill lists the records to be kept 2 20 confidential as promotional play receipts records, patron and 2 21 customer records, surveillance records, security reports and 2 22 network audits, internal control records, employee records, and 2 23 most audit information and records that are obtained by the 2 24 commission in connection with the annual audit conducted under 2 25 Code section 99D.20 or 99F.13, as applicable.
