S.F. 382 Section 1. NEW SECTION . 455B.280 Sale of water to 1 recipients outside the state —— report. 2 1. For purposes of this section, “entity” includes a public 3 utility including but not limited to a county water system or a 4 rural water system. 5 2. By January 31 of each year, an entity that sells water 6 withdrawn in this state to a recipient outside the state shall 7 submit to the department a report detailing the origin of 8 the water extracted within the state, the identity of each 9 out-of-state recipient, the purpose of each out-of-state 10 recipient’s water usage, and the amount of water in gallons 11 that the entity withdrew in this state and sold to a recipient 12 in the previous calendar year. The department shall make the 13 reports publicly accessible on the department’s internet site. 14 EXPLANATION 15 The inclusion of this explanation does not constitute agreement with 16 the explanation’s substance by the members of the general assembly. 17 This bill relates to the sale of water to a recipient outside 18 the state. The bill requires an entity, as defined in the 19 bill, that sells water withdrawn in this state to a recipient 20 outside the state to submit to the department of natural 21 resources (DNR), by January 31 of each year, a report detailing 22 the origin of the water extracted within the state, the 23 identity of each out-of-state recipient, the purpose of each 24 out-of-state recipient’s water usage, and the amount of water 25 in gallons that the entity withdrew in this state and sold to a 26 recipient in the previous calendar year. DNR shall make the 27 reports publicly accessible on the department’s internet site. 28 By operation of law, a person who violates the bill is subject 29 to civil enforcement, which may include a civil penalty not to 30 exceed $500 for each day a violation occurs. 31 -1- LSB 2432XS (2) 90 js/rn 1/ 1
