  1  1    Section 1.  Section 257.13, subsection 1, Code 2015, is
  1  2 amended to read as follows:
  1  3    1.  For the school budget year beginning July 1, 2001, and
  1  4 succeeding budget years beginning before July 1, 2016, if a
  1  5 district's actual enrollment for the budget year, determined
  1  6 under section 257.6, is greater than its budget enrollment for
  1  7 the budget year, the district shall be eligible to receive an
  1  8 on=time funding budget adjustment. The adjustment shall be in
  1  9 an amount equal to the difference between the actual enrollment
  1 10 for the budget year and the budget enrollment for the budget
  1 11 year, multiplied by the district cost per pupil.
  1 12    Sec. 2.  Section 257.13, Code 2015, is amended by adding the
  1 13 following new subsection:
  1 14    NEW SUBSECTION.  4.  This section is repealed July 1, 2016.
  1 15    Sec. 3.  NEW SECTION.  257.13A  School district enrollment
  1 16 supplement program == appropriation.
  1 17    1.  A school district enrollment supplement program is
  1 18 established to provide additional funding for school districts
  1 19 in which the district's actual enrollment for the budget year
  1 20 exceeds the budget enrollment for the budget year.  For the
  1 21 school budget year beginning July 1, 2016, and succeeding
  1 22 budget years, if a district's actual enrollment for the budget
  1 23 year, determined under section 257.6, is greater than its
  1 24 budget enrollment for the budget year, the district may submit
  1 25 a request to the school budget review committee for a school
  1 26 district enrollment supplement.  A request for an enrollment
  1 27 supplement pursuant to this section must be received by the
  1 28 school budget review committee by November 1.  The school
  1 29 budget review committee shall approve the request for the
  1 30 enrollment supplement if the district meets the requirements of
  1 31 this section and for the amount specified in subsection 3.
  1 32    2.  For each fiscal year beginning on or after July 1, 2016,
  1 33 there is appropriated from the general fund of the state to the
  1 34 department of education an amount necessary to make all school
  1 35 district enrollment supplement payments under this section, as
  2  1 calculated in subsection 3.
  2  2    3.  The amount of each eligible school district's enrollment
  2  3 supplement shall be the difference between the school
  2  4 district's actual enrollment for the budget year minus the
  2  5 school district's budget enrollment for the budget year
  2  6 multiplied by the regular program state cost per pupil for the
  2  7 budget year.
  2  8    4.  School district enrollment supplement payments shall be
  2  9 paid by the department of education in a lump sum at the same
  2 10 time and in the same manner as the first monthly installment
  2 11 is paid on or after January 1 of the budget year under section
  2 12 257.16, subsection 2.
  2 13    5.  School district enrollment supplement payments received
  2 14 under this section are miscellaneous income and shall be
  2 15 deposited in the general fund of the school district. However,
  2 16 the school district enrollment supplement amount shall not be
  2 17 included in district cost.  An enrollment supplement under this
  2 18 chapter shall not affect the receipt or amount of a budget
  2 19 adjustment received under section 257.14.
  2 20    6.  Except for an adjustment to an amount under section
  2 21 257.31, subsection 5, participation in the school district
  2 22 enrollment supplement program under this section shall not
  2 23 affect a school district's eligibility to receive an amount
  2 24 from the school budget review committee under section 257.31.
  2 25    Sec. 4.  Section 257.31, subsection 5, paragraph a, Code
  2 26 2015, is amended to read as follows:
  2 27    a.  Any unusual increase or decrease in enrollment.  In
  2 28 deciding a school district's need for additional funds under
  2 29 this paragraph, the school budget review committee shall
  2 30 consider school district enrollment supplement amounts received
  2 31 by the school district under section 257.13A for the same
  2 32 budget year, and may accordingly adjust amounts granted for the
  2 33 purposes of this paragraph.
  2 34                           EXPLANATION
  2 35 The inclusion of this explanation does not constitute agreement with
  3  1 the explanation's substance by the members of the general assembly.
  3  2    Current Code section 257.13 provides that if a school
  3  3 district's actual enrollment for the budget year is greater
  3  4 than its budget enrollment for the budget year, the district
  3  5 shall be eligible to receive an on=time funding budget
  3  6 adjustment approved by the school budget review committee.
  3  7 This bill specifies that the provisions of current Code section
  3  8 257.13 apply to school budget years beginning before July 1,
  3  9 2016, and establishes a repeal date of July 1, 2016, for Code
  3 10 section 257.13.
  3 11    The bill establishes a school district enrollment supplement
  3 12 program to provide additional funding for school districts in
  3 13 which the district's actual enrollment for the budget year
  3 14 exceeds the budget enrollment for the budget year.  For the
  3 15 school budget year beginning July 1, 2016, and succeeding
  3 16 budget years, if a district's actual enrollment for the budget
  3 17 year is greater than its budget enrollment for the budget
  3 18 year, the district may submit a request to the school budget
  3 19 review committee for a school district enrollment supplement.
  3 20 The school budget review committee is required to approve the
  3 21 request for the enrollment supplement if the district meets the
  3 22 requirements of the bill.
  3 23    The amount of each eligible school district's enrollment
  3 24 supplement is the difference between the school district's
  3 25 actual enrollment for the budget year minus the school
  3 26 district's budget enrollment for the budget year multiplied by
  3 27 the regular program state cost per pupil for the budget year.
  3 28    The bill establishes a standing appropriation for each
  3 29 fiscal year beginning on or after July 1, 2016, for an amount
  3 30 necessary to make all school district enrollment supplement
  3 31 payments under the bill. The bill specifies that school
  3 32 district enrollment supplement payments are miscellaneous
  3 33 income and must be deposited in the school district's general
  3 34 fund. However, the enrollment supplement amount is not to be
  3 35 included in district cost. The bill further specifies that an
  4  1 enrollment supplement does not affect the receipt or amount
  4  2 of a budget adjustment received under Code section 257.14,
  4  3 and, except for an adjustment to the amount, does not affect
  4  4 a school district's eligibility to receive an amount from the
  4  5 school budget review committee under Code section 257.31 based
  4  6 on an increase in enrollment.
