  2    from the special snowmobile fund.

  1  1    Section 1.  Section 321G.1, subsection 21, Code 2017, is
  1  2 amended to read as follows:
  1  3    21.  "Public land" means land owned by the federal
  1  4 government, the state, or political subdivisions of the state
  1  5 and land acquired or developed for public recreation pursuant
  1  6 to section 321G.7.  "Public land" includes but is not limited
  1  7 to a roadway or highway.
  1  8    Sec. 2.  Section 321G.7, subsection 2, Code 2017, is amended
  1  9 to read as follows:
  1 10    2.  The department shall remit the fees, including user
  1 11 permit fees collected pursuant to section 321G.4A, to the
  1 12 treasurer of state, who shall place the money in a special
  1 13 snowmobile fund. The money is appropriated to the department
  1 14 for the snowmobile programs of the state. The programs shall
  1 15 include grants, subgrants, contracts, or cost=sharing of
  1 16 snowmobile programs with political subdivisions or incorporated
  1 17 private organizations or both, which may include the purchase,
  1 18 ownership, and maintenance of trail grooming equipment, in
  1 19 accordance with rules adopted by the commission. Snowmobile
  1 20 fees may be used to support snowmobile programs on a usage
  1 21 basis. At least fifty seventy percent of the special fund
  1 22 shall be available for political subdivisions or incorporated
  1 23 private organizations or both. Moneys from the special fund
  1 24 not used by the political subdivisions or incorporated private
  1 25 organizations or both shall remain in the fund and may be used
  1 26 by the department for the administration of the snowmobile
  1 27 programs. Notwithstanding section 8.33, moneys in the special
  1 28 fund shall not revert to the general fund of the state at
  1 29 the end of a fiscal year. Notwithstanding section 12C.7,
  1 30 subsection 2, interest or earnings on moneys in the special
  1 31 fund shall remain in the fund.
  1 32    Sec. 3.  Section 321G.7, Code 2017, is amended by adding the
  1 33 following new subsection:
  1 34    NEW SUBSECTION.  3.  Notwithstanding any provision of law
  1 35 to the contrary, the department may donate trail grooming
  2  1 equipment owned by the department to a political subdivision
  2  2 or incorporated private organization receiving moneys from the
  2  3 fund after the useful life of the trail grooming equipment to
  2  4 the department has expired.
  2  5    Sec. 4.  Section 321G.8, Code 2017, is amended by adding the
  2  6 following new subsection:
  2  7    NEW SUBSECTION.  3.  Snowmobiles registered in an organized
  2  8 special event authorized pursuant to section 321G.16 when such
  2  9 snowmobiles are operated within the boundaries of the event.
  2 10                           EXPLANATION
  2 11 The inclusion of this explanation does not constitute agreement with
  2 12 the explanation's substance by the members of the general assembly.
  2 13    This bill defines "public land" as the term relates to
  2 14 snowmobile operation under Code chapter 321G to include
  2 15 roadways and highways. Under current law, the operation of
  2 16 snowmobiles on roadways and highways is regulated by Code
  2 17 section 321G.9.
  2 18    The bill increases the share of the special snowmobile fund
  2 19 to be allocated to political subdivisions or incorporated
  2 20 private organizations from 50 percent to 70 percent, and allows
  2 21 political subdivisions and incorporated private organizations
  2 22 to use moneys from the fund for the purchase, ownership, and
  2 23 maintenance of trail grooming equipment. Under current law,
  2 24 the remainder of the fund is allocated to the department of
  2 25 natural resources (DNR) for administration of snowmobile
  2 26 programs. The bill permits the DNR to donate trail grooming
  2 27 equipment owned by the DNR to a political subdivision or
  2 28 incorporated private organization receiving moneys from the
  2 29 fund after the useful life of the trail grooming equipment to
  2 30 the DNR has expired.
  2 31    The bill exempts from the snowmobile registration
  2 32 requirements snowmobiles registered in an organized special
  2 33 event authorized by the DNR when such snowmobiles are operated
  2 34 within the boundaries of the event.
