MEDICAID MANAGED CARE == UNPAID CLEAN CLAIMS == 1 2 INTEREST PENALTY. The department of human services shall adopt 1 3 rules pursuant to chapter 17A and shall amend Medicaid managed 1 4 care contracts to require that a managed care organization pay 1 5 an interest penalty of one and one=half percent of the claim 1 6 amount to the person submitting the claim for any clean claim 1 7 not paid within sixty days of timely filing. For the purposes 1 8 of this section, "clean claim" means a claim for which all 1 9 information required for processing the claim is available. 1 10 EXPLANATION 1 11 The inclusion of this explanation does not constitute agreement with 1 12 the explanation's substance by the members of the general assembly. 1 13 This bill requires the department of human services 1 14 (DHS) to adopt rules pursuant to Code chapter 17A and amend 1 15 Medicaid managed care contracts to require that a managed 1 16 care organization pay an interest penalty of 1.5 percent of 1 17 the claim amount to the person submitting the claim for any 1 18 clean claim not paid within 60 days of timely filing.
