  2    may be inspected by a licensed veterinarian in lieu of the
  3    department of agriculture and land stewardship.

  1  1    Section 1.  Section 162.10B, Code 2015, is amended to read
  1  2 as follows:
  1  3    162.10B  Commercial establishments == inspecting state
  1  4 licensees and registrants.
  1  5    1.  The department may inspect the commercial establishment
  1  6 of a registrant or state licensee by entering onto its
  1  7 business premises at any time during normal working hours. The
  1  8 department may inspect records required to be maintained by the
  1  9 state licensee or registrant as provided in this chapter. If
  1 10 the owner or person in charge of the commercial establishment
  1 11 refuses admittance, the department may obtain an administrative
  1 12 search warrant issued under section 808.14.
  1 13    2.  a.  Notwithstanding subsection 1, a commercial breeder
  1 14 who is a state licensee may elect to have an annual inspection
  1 15 conducted by a veterinarian licensed to practice veterinary
  1 16 medicine under chapter 169 in lieu of the department.  In order
  1 17 to exercise this election, all of the following must apply:
  1 18    (1)  The department or a veterinarian acting under an
  1 19 existing election must not have recorded an inspection
  1 20 violation committed by the commercial breeder during the prior
  1 21 four years.
  1 22    (2)  The commercial breeder must notify the department of the
  1 23 election as required by the department.
  1 24    b.  The commercial breeder's election expires at the end of
  1 25 twelve months.
  1 26    c.  The veterinarian shall conduct the inspection according
  1 27 to the same requirements and shall have the same access to the
  1 28 commercial breeder's premises as the department would have had
  1 29 in conducting the inspection.  The veterinarian shall file
  1 30 an inspection report with the department as required by the
  1 31 department.  The veterinarian shall sign the report, verifying
  1 32 that the inspection complied with the department's inspection
  1 33 requirements and that the veterinarian had access to the
  1 34 commercial breeder's premises.  The department must receive the
  1 35 report within twenty days following the date of the inspection.
  2  1    d.  The cost of an inspection conducted by a veterinarian
  2  2 shall be paid by the commercial breeder.
  2  3    e.  A commercial breeder may elect to have a veterinarian
  2  4 conduct an inspection under this section every other year.
  2  5                           EXPLANATION
  2  6 The inclusion of this explanation does not constitute agreement with
  2  7 the explanation's substance by the members of the general assembly.
  2  8    This bill provides that a commercial breeder of dogs or cats
  2  9 holding a state license issued by the department of agriculture
  2 10 and land stewardship may elect to have an annual inspection
  2 11 conducted by a licensed veterinarian in lieu of the department.
  2 12 In order to exercise this election, the commercial breeder must
  2 13 not have committed an inspection violation during the past four
  2 14 years and must comply with notice requirements established
  2 15 by the department.  The veterinarian must file an inspection
  2 16 report with the department.  The cost of the inspection is
  2 17 to be borne by the commercial breeder.  The department must
  2 18 conduct an inspection every other year.
